Thank you for joining us here on kron. 4 news at noon. Im Justine Waldman and ongoing case thats over 20 years old continues before judge today as the fight for Scott Petersons innocence. Proceeds he los angeles Innocence Project, some of petersons family members and a skeptical private investigator are not convinced that the right man is behind bars for the deaths of Laci Peterson and her unborn son. Connor kron 4 s Charles Clifford joins us now live from redwood city with details about their efforts to try to overturn Scott Petersons conviction. Inside a mateo county courtroom tuesday morning, Scott Peterson appeared via video conference. Lawyers with the la Innocence Project. Attorneys from the Stanislaus County District Attorneys Office and members of the Peterson Family were also in the room in 2004 peterson was convicted of murdering his wife laci and their unborn son. Connor in modesto, back in 2002 at the original trial, peterson was sentenced to death, but that was later changed to life in prison is currently serving out his sentence at mule creek state prison east of sacramento. Peterson has maintained his innocence since laceys disappearance earlier this year, the Innocence Project submitted multiple Court Filings requesting access to the large amount of evidence that was gathered during the original investigation in its Court Filings, the Innocence Project suggested that someone other than peterson may have been responsible for lacis death. They also took issue with how the original case was handled and say that intense Media Attention during the investigation may have influenced the case among the items theyre seeking to examine is any evidence related to a burned out van. It was found near the peterson home around the time of lisas disappearance. They also want new dna testing done on blood found inside that van in court on tuesday, the judge scheduled 3 additional hearings to discuss the different aspects of the Innocence Project requests. Scott peterson only spoke briefly to say that he prefers attending to attend. Via video conference. But for now in redwood city, Charles Clifford kron, 4 news. Charles, thank you so much. And now to go over what happened today in court in the Scott Peterson case. Were joined live here with our legal analyst michael cardoza. So we can discuss this more. Michael, thank you so much for joining us. So what do you make of what happened today . What step is this in the case now to possibly has the innocence saying get the right person behind bars. Well, first of all, the fact the innocent project took this case speaks volumes. They dont many of the cases that are present so in my mind, i wonder you guys know that we dont know about this case that youve already discovered, but youre not telling that said today was what they call a case management. It means where are both sides going . Thats the question of the judge. Lets set some dates i think they have 3 court dates in april may and june. So the court can keep track of whats going im really excited about this because i guarantee you that the Innocence Project with the attorneys that they have and how smart those people are and the money they have to vet this case to investigate it. Im really excited for them to go through all of the evidence in the case. And finally, at the end of it, we can put to rest number one, whether it gets a new trial or whether thats the end of because this is the end of the road where Scott Peterson, unless they come up with some have new evidence. This is his last chance here to get a possibly another court. So some of this new evidence that the innocent project is going to be. Looking at that they they want to examine. Is this different out van that was found near the peterson home around the time of lisas disappearance. And they also want some new dna testing done on blood that was found inside the van. I would imagine that the way dna testing was done back in 2002, 3, 4, is much different than it is now. But those are the 2 key things that im gathering. Maybe, you know, Something Else you can share with us that the Innocence Project is really looking at is like, well, maybe maybe theres more to what has been said already. Well, to be clear, heres whats important about that. Laci went missing. And on that day. Theres a question of whether there was a burglary taking place across the street. It the house of across the street and whether laci came upon the burglars and they took her in that and she left dna in that van because of they find dna in that band of laceys. That circumstantial evidence thats going to in essence help Scott Peterson, the men sleigh. And the question is, did that burglary happened on the day that she went missing . Ortizs happened the day after because of it happened the day after then theres not much that is nothing to do with laci disappearing the day before. Heres what im excitedsabout. I am telling you the discovery, the request for information from the Innocence Project to the District Attorneys Office is going to weight. 3rd row questions about let see everything you have that has to do with this case. The das office. They were in court today. In fact, the x District Attorney of the county was court today, even though i believe shes retired. Now she was in court along with dave harris, who was still in modesto as a da. Theyre going fight some of that discovery and say, no, were not going to give or its not important. Theyre going to be some brooks in that courtroom because im telling you this innocent project is thorough. They do an intelligent investigation and i guess is going to be much more thorough than the defense was able to do back when this case was being dry. So im excited about seeing okay. What did you have das office . What do you have Police Department that you didnt give to the defense back during the trial . If anything, but so just the time. Start now for the Innocence Project in order to conduct investigation. They were given a tight sixmonth deadline. Theyre going to be looking at new and old evidence. And there is also i have a question on the other side of that about what happens next that been given 6 months by the judge to do this. Discovery. They keep in mind that they can be moved depending on how cooperative the defense is and how cooperative the das office is in giving up the evidence that thoy have the documentary, the Scientific Evidence because they may not want to give some of that up to the if the judge sees that, the judge may say, wait a minute, i know i put this out 6 but were going need more time. The judge will decide because both sides will come into court and argue about certain pieces of evidence. Ken, the da give us a will. The da give us, for example, hammer that was found in house or at the van so we can do new dna testing. Michael were not given that has nothing to do with the it is. Project has a court know we need water them to give it to so thats why i say theyre going to be some downey brooks in court about what the das office and the Police Department asked to give whats in future argument ends like that until they get what, if anything, they need to be there at the end, theyre going to shut it down, say we couldnt find anything or they will bring newlydiscovered exculpatory evidence. Potion and the court will then decide as Scott Peterson gets a trial. The next issue that will where will it be trying there are the judge has set a couple of other dates. Some in april may and june, a hearing a motion to seal some dna testing motions. I mean, so this is like moving along here. But are we just like as citizens project just stirring something up again, that doesnt need to be poked at. No, i think it needs to be pumped that i said from the getgo and i a lot on this case. I did a lot of commentary on the case and i was also asked by the defense to do a mock cross examination of Scott Peterson. So i you know, awful lot about this case. So, no, theyre not just spoken in the dark. Theyre not doing a fishing expedition. And as i said at the beginning of this interview, innocent project doesnt take every case. They only take ones that they think they can make a difference. So thats why i say do they know something . We dont know or they simply saying something that they feel that there was a full and complete investigation into. For example, the match in that or the burglary that allegedly happened across the street on the day that laci went missing. Theyre going to look at all of that all of so thats why i say now theyre not. Theyre just not on sterns some of should they dont do they enough other cases to look at. So im excited to see what happens. And i guarantee you they going to come investigation and bet in of this case. Im really excited for and im excited for the new Court Hearings because like i said, theyre going to be some donny brooks in that courtroom about what the dea and cop should give up. And peterson is going to appear via video for all 3. He other person. Now he doesnt. And i you know, i dont blame so, you curry and when there house somewhere in state prison to disrupt their day. Let them in a bus to take them to the county jail. They dont want to do all of and he its not going make any difference to the legal arguments. Weather is in the quarter and well break. So i completely get what hes doing. But my heart does go out to the roads family because they they had enough of but now a stand and youve got to be sure thats scott peters and is in fact guilty and not an innocent man sitting in prison. In developing news now, the fbi raid of a prison where former employees have been charged with sexually abusing inmates. As we have just reported agencys computers and documents from their 8 former employees, including the former warden are charged with sexually abusing inmates all at the womens prison in dublin. This has been a years long investigation and we spoke with a volunteer with the California Coalition for women prisoners, and she believes that this raid has to do with the lawsuits against the federal Corrections Institute and the federal bureau of in prisons. Were 2 years that ive been visiting people at dublin theres so much retaliation for people who speak and for survivors who bravely talk about whats been happening there needs to be like overhaul the prison system in order for this abuse to stop. The scandal has been one of many issues plaguing the federal bureau of prisons. The Governors Office is Just Announced that the chp has conducted a number of sting operations leading to 168 arrests at 360 stolen cars being recovered in the east bay. They also recovered 16 crime linked guns since the surge in the chp presence was announced on february 14th. This was all part of a program between oakland and the chp in an attempt to solve crime. The Governors Office says the chp will continue to have and expanded and visible force in oakland focused on deterring and responding to crime. Theyre currently 72 chp officers assigned to oakland assisting in this role. Its all part of governor newsoms 10 point action plan to support oaklands efforts to improve Street Safety and beautification a woman is now facing charges for a car theft where San Pablo Police say she stole a car with the child. Still inside of it, police say this car was stolen yesterday afternoon on california avenue. They say Surveillance Video shows the woman taking that car. Richmond police say they found the child in the car unharmed near barrett avenue and hay street. Police say the woman took the victims phone from the car. They used the location of that phone tracked the woman down in oakland and officers say that they saw 2 women get inside of a car and Martin Luther king avenue when they tried to stop that car took off. And after a short chase, the woman got out of the car and started running east on first street. They say they were able to catch only the driver. Police say they confirm she was the woman in the Surveillance Video and booked her into the Contra Costa County jail on vehicle theft and kidnapping charges. 3 people from santa rosa, including a child were injured after their plane crashed in mendocino county. Authorities say that this plane was carrying 2 adults and a 2 yearold it took off from t airport in humboldt county on fdaafternoon. It was headed for santa rosa when it lost power. 5 minutes after takeoff. The pilot tried to fixthproblem, but the plane was too low to the ground. So they deployed the parachute, slowing it down and thats how it was able to get to the ground. The plane landed in some trees about 100 feet off of the ground and then it fell. Authorities say the victim, although all of them there, they only suffered a few scratches. The crash is still being investigated. Were not in that space, thankfully because weve got some decent rain. So im not as concerned about this. Having said that, always a good idea to be careful. And you can see that we do have the wind advisory thats gonna for spots like fairfield and vallejo said they are out of the Sacramento National Weather Service office and i could see that we might get a little bit of that tomorrow where we are to something bay area wide. Were looking out for this wind obviously wednesday afternoon through friday morning. We could see wind. 25 to 35 Miles Per Hour and gusts up to about 45 Miles Per Hour. You can see it goes right through wednesday into thursday where the wind really gets kick. Writes, thank you to the Concord City Council is holding off on implementing a rent control ordinance. It approved last week. Kron fours Michael Thomas explains why. This rent stabilization ordinance in concord has been an issue for years and the new changes were set to go into effect in early april. But recently the city clerk received a referendum petition that now could put the decision in the hands of voters this november. Last january, conquered officials wanted to enact more tenant protections and they wanted to do this by amending the citys residential Tenant Protection Program and increasing protections for just cause evictions. Now, this would expand the citys rent registry and establish a rent stabilization program. But it would also limit annual rent increases to 3 or 60 of the Consumer Price index. Whichever was cheaper. The change would apply to all multifamily complexes or 2 or more unit rentals that were built before february of 1995. It would also require landlords to have just cause before evicting tenants. The Council Passes ordinance last month voting 4 to one in favor of the ordinance. But some say the changes punish landlords, adding that the rent raises would be too low. So last week, concord city clerk received a proposed referendum petition indicating plans to gather signatures and police in on the ballot in november. In response, the citys Attorney Says it has 10 Business Days to prepare an issue, an impartial summary and the petitioners will have 30 days together around 7200 signatures from registered conquered voters. Once they verify those signatures with the county officials then that the city would have to either repeal the ordinance or place it on the ballot this november. As of right now, those changes that were approved have been halted. And as we get more information over the next 30 days. Well continue to keep you updated. And California Attorney general rob bonta is taking action to reduce gun violence with the help of the new program. Some developing news or following us that a person has been hit and killed by a caltrain. This was on. Chestnut street again in redwood city just south of the station. Officials say a person was on the track for an unknown reason when they were hit. About 9 oclock this morning, a bus bridge was set up for a little while, but the tracks of now reopened its back now in regular service. Estimated 174 passengers were on board, but no one inside the train was injured. Gun violence continues to plague the nation and California Attorney general rob bonta says the state is taking action to ensure guns are kept away from people who are prohibited from owning them. Our capitol correspondent Eytan Wallace has the story. Well, just take a look at all of these guns. These represent just a handful of the more than 1000 firearms. The California Department of justice sees last year from people prohibited from owning them gun after gun after these make up a tiny portion of the 1443 firearms. The states season 2023 from california not legally allowed to have them. Among the items seized more than 327,000 rounds of ammunition. 683 handguns, 364 rifles, 216 shotguns. 88 ghost guns as an unregistered guns that can be assembled at home. And 39 of what the state considers assault weapons. The goal is simple here. Keep the number of illegally armed individuals as low as possible. That attorney general rob bonta says is specifically the goal of californias armed prohibited persons system program. Also known as apps. It takes date of all the legal gun purchases and 3 plus million legal gun owners in the state and cross references it with a list of the more than 23,000 californians who are prohibited from owning a gun most of the time either because they were convicted of a violent felony or misdemeanor were placed under a Domestic Violence or other restraining order or are experiencing severe mental illness. If theyre found with a gun or deemed to about one before ending up on the list, the state will come and take it away because of this program. Organs are off our streets and out of dangerous hands. More schools, places of worship, dance studios, workplaces and neighborhoods. They are all safer. He notes the program is especially crucial in the state where more than 3,000 people die of gun violence every year bonta has long maintained the program does not target legal gun owners, something republicans in the legislature agree with. But while they acknowledge the state has ramped up investigations to confiscate guns from people banned from owning them assembly. Minority leader James Gallagher points out. The state still has a backlog of some 8,900 people who are under active investigation. In a statement he wrote while attorney general rob bonta chased headlines, the department of justice has barely put a dent in californias backlog of the legal gun owners removing fewer people from the app system last year than the year before reducing the backlog of a legal gun owners must be the doj absolute highest priority. We can save a life through a common sense. Usually compliant action. We should. And with our apps program, we are and bonta says his team will continue to go through the list of prohibited gun owners regularly. Police have not decided to reopen the case of a 63 yearold asian woman who died in san Franciscos Bayview last year. Yang thing lou died after falling on the sidewalk and hitting her head at the intersection of 3rd burt. And despite witnesses saying someone pushed her from behind, investigators ruled her death an accident and now a year after closing the case, police say new evidence has now emerged last week they arrested and charged the person who reportedly assaulted a 71 yearold asian woman just 5 blocks away from where fell. Police did not confirm the person interviewed in the attack is the same person they arrested last week. But Charles Young with the Asian Justice Movement is demanding Police Release video of that first attack. As conclusion reached that, that death was an accident. And so now here we are the next and the same person apparently attacked another elderly asian woman. And so i think its high time for the public to be able to judge for themselves. I think one way that we could do that is by viewing the video of that first attack. He also says this. Hes pleased that the case has been reopened. He also wants police to find out if the victim was targeted because she was asian. The San Francisco rules committee discussed reviving the Homeward Bound Program. They will take Public Comment at next weeks meeting before supervisors vote on it. Kron 4 Sarah Stinson has the latest. A San Francisco program has been offering unhoused people a ticket back to their home towns for nearly 20 years. It allows us the opportunity to offer the ability to reunify with their family. A ticket expenses to get back to their home. The Homeward Bound Program started under thenmayor Gavin Newsoms office with the goal to help 1000 people annually supervisor ahsha suffice. As in recent years, the program has dwindled. Hes now working to revive it while also running against mayor london breed for her job this november under mayor breed. It was buried in the bureaucracy. And it dropped to just a couple 100 people a year. Homeward bound has become a resource for organizations like glide Memorial Church in foundation. The chief Public Affairs officer is glad to see the city reinvesting in it. It is one tool in the tool box. And i think we want to be looking at all of that. It is not for everyone agrees after years of living on the streets, this man got reconnected with his family with the help of the San Francisco nonprofit miracle messages. Founder kevin adler says its important this program is only offered to people who are actually from another city, which is not the majority of those living on the streets. According to a study by ucsf. 90 of the unsheltered population in california are from this state. 75 became homeless in the same county. They last had housing programs like homeward as long as theyre not doing greyhound therapy. But there actually. You know, you stop the we doing some Due Diligence on where the person is going stay, making sure that theres a plan. That was sara stinson reporting. Mayor london breed announced a new goal of helping 1000 people a year with homewood brat bound during her state of the city address. Last week we did reach out about supervisors initiative wanting to revive this program. Her office sent us a statement that reads in part the proposed legislation before the board of supervisors does nothing that will expand the use of the program in any way or help more people get connected to their homes. Its window dressing that delivers no real change. Drivers have been increasingly using illegal license plate changers out of structures to avoid paying automatic tolls. Its a move thats costing Transportation Agency is a lot of money. So this year as a license plate flipper, it goes from texas. One minute bandits to new york, the next and vice versa. Something like this can be bought online for just a couple 100 bucks and here in the bay area, authorities believe they have lost out because of these kind of devices here. Theyve lost out on more than 33 million dollars. Maybe not every one of ups truck shuns plate be facing steep basements. Maybe they were all deliberate. But they do add up. Currently costs 9 to cross the Golden Gate Bridge to cost 7 bucks to cross all the other bay area. Bridges. Lets see whats happening outside right now. As were taking a live look here. C. , where it is already 73 degrees today. All of that warmth is going to be meeting up with all of this cold thats going to be tracking across the country. And that is going to bring the risk for some severe weather, particularly as we get into tomorrow, meaning the chance for tornadoes. But right now you can see the action really is on the west coast. That is that cold push thats going to bring brought a little snow to the sierra and its going to be a lot of snow to colorado. It looks like. But as we take a look at the system, you can see its pretty much run itself out. And we really dont have a whole lot more coming. Its just a matter of getting some of the clouds to move out of the way. And today tomorrow we will see some of that cloud cover continue will also see a little bit more of that snow flurry activity thats happening in the sierra snow levels are about 4500 to 5,000 feet. It is going to taper off as we get to the end of our Winter Weather advisory, which is until 5 oclock today. And then they should be calling it a day. Today lawmakers are grilling a former federal prosecutor described joe biden having a poor memory in a report about the president s alleged mishandling of classified documents. Washington correspondent Trevor Shirley in dc with the latest. Special counsel her is facing criticism from both sides of the political aisle but says he stands by the conclusions he outlined in his report. Her appeared on capitol hill after the release of his report into the president s alleged mishlndling of classified materials as vice president. Those documents were found at several properties connected to president biden. Her who was appointed to the Justice Department by former President Donald Trump did not find sufficient evidence to charge mister biden. His report described mister biden is a quote wellmeaning elderly man with a poor memory, even alleging the president couldnt remember the day his son beau died. The president angry lee and forcefully pushed back on that description following the reports release. But her says he needed to justify its decision not to prosecute mister biden and his observations. Give context to that decision right now. Republicans are angry. Her didnt charge the president and democrats are upset that his description fuels the idea that mister biden isnt mentally fit to run again. Already hes told lawmakers he stands by his report. No matter the role. No matter the administration, i have applied the same standards and the same in partially out. My respect for the Justice Department. Dunn says when shelters are full, the probability of dogs having to be euthanized increases. Our reality with this situation is that we are contemplating esthanizing for space. Thats why oakland Animal Services is extending their hours this week, wednesday through sunday, a spring into action.
