Now were going to see the partly cloudy skies in the forecast for us this morning. But heading into this afternoon, thats going to continue to sweep to the south and were left with clear skies starting around 3 00. Lasting into the evening hours tonight. Early Morning Hours tomorrow. And thats setting us up for a very dry break right around the corner and now our friend up in the sierra, theyre under a high wind warning and you can see that in the red right there. But back here in the bay, and all throughout the Sacramento Valley, the rest of us are under a wind advisory like i mentioned gusts anywhere up to around 50 Miles Per Hour expected. Scott peterson convicted in 2004 for murdering his wife and unborn child. Fast fore ward 20 years and he has a new defense team and a new defense. What is it . Dna. And a claim about a burglary near the peterson home around the time his wife went missing. So this is the first time many of us have seen peterson in years. He appeared you see that right there in a blue prison jump suit on zoom hair pulled back in a ponytail. Peterson originally sentenced to death, but four years ago, that was overturned to serve a life sentence without parole. Max darrow is about to show you now theres a group called thel. A. Innocence project, they are on the case saying that some evidence including dna may have been overlooked. Do we have your consent to proceed via zoom this morning . Absolutely. Thank you, your honor. Reporter Scott Peterson appearing before a judge Via Video Conference on tuesday from mule creek state prison as he seeks to fight his murder fiction with the help of attorneys from the l. A. Innocence project. Thats Paula Mitchell representing peterson. Back in 2004, peterson was sentenced to death after he was convicted of murdering his pregnant wife laci and unborn son connor. In 2020, the California Supreme Court overturned that sentence, citing errors with the jury selection process. In 2021, a judge resentenced peterson to life in prison without the possibility of parole. In 2022, his defense team pushed for a new trial based upon an allegation of juror misconduct but after a series of hearings, a judge didnt grant him a new trial. At the beginning of 2024, the l. A Innocence Project filed three motions including a request for post conviction dna testing and a request for reasonable discovery. We were very, very specific and we spent a lot of time trying to suss out what frankly are very alarming deficiencies in the discovery that was provided to the defense at the time of trial. Those are the items were requesting. The nature of the request is not a fishing expedition. Theyre very precise and very specific. Reporter the dna testing is another part of the claim. Theyd like to access evidence connected to a burglary near the petersons home that was right around the time of lacis disappearance. Legal analyst paula canny has followed the case closely. If that testing shows what they think its going to show, its a whole new ball game so to speak. Reporter she says the fact that the l. A. Innocence project even took on petersons case is significant. That organization, which only represents people who the project believes is innocent and can be exonerated by dna evidence, has taken this up. The hearing date on the motion to seal can be earlier. Reporter superior court judge Elizabeth Hill set three hearings regarding the motions. One of the few times we heard peterson speak, when he opted to appear virtually for the hearings. Petersons sisterinlaw and fierce advocate jamie was present but didnt address the media after the proceedings wrapped up. His attorneys provided a statement that read in part we have not commented on our motions and we will continue to present our case in court where it should be adjudicated. Innocence project operates independently of what you have likely heard about called the national Innocence Project which in this case, that Second Organization we just mentioned is not involved. The latest Consumer Price index shows prices rose higher than expected up 3. 2 over the year. Well, now forecasters say theres little to no chance the fed cuts Interest Rates at its meeting next week. Some good news though. Inflation did slow in some key areas including food. But not everyone is noticing the difference. Customers at a restaurant in San Franciscos Mission District are questioning the high price of their burritos. It was recently named the best in the mission. But one customer asked why the price has doubled in just a few years. So there is a reason why this Business Owner has had to do this. And Shawn Chitnis has the response from the Restaurant Owner that really informs a larger conversation about our economy. Watch. Restauranteur ricardo lopez, says its a constant challenge to maintain his vision of mexican food at a price the public will pay for. I struggle with it, right . While he started that concept out as a food truck, for three years now hes been serving it at this restaurant in the mission. This is the food i want to make. If i want to continue to make the food i want to make, if i want to continue to keep, you know, testing new items and new menus, it all costs time and money. Reporter ricardo says at each step, he has to make a choice and for him, spending more money to get the best ingredients using additional time and labor is a must. An approach that earned some validation last fall when the San Francisco chronicle named his burrito the best in the mission. But a few days ago, one customer wrote online they remember having it for half the price two years ago. They still love the burrito, but said for 22 plus tax, they would consider other options around the city. So ricardo decided he wanted to write back. I thought all right, this is a great time to respond on that. And you know, it was in the middle of just starting our service and i sat down and everything just came out. Like this is what it kind of costs and looks like to us. Reporter in his lengthy explanation, he went over all the changes and costs in the last two years and he pointed out the price of beef has gone up more than 2 a pound for him and thats an additional 6,000 a month. Labor has also increased a couple dollars in that time, which is at 3,000 a month. Literally everything has gone up in price. Theres not one thing i can think of thats not gone up since covid thats come right back down. Reporter the customer also questioned if the article influenced him to raise the price. And he says yes. Its just a vehicle to the larger conversation and when you break down his expenses what it costs these days, to run a family owned and operated business in San Francisco, theres a problem there. So what do you prefer . The shrinkflation where their portions are smaller so they can recoup the funds or just coming out like he did and saying look, i have got to pay the bills. Its going to be the same burrito just going to cost more. I prefer a business friendly economy. Because in that case, businesses dont look at shrinkflation as an opportunity. Eight months ago, an older woman died what police thought was an accident. She was found bleeding on the ground in the bay view neighborhood but now new evidence might suggest that it could have been foul play. Law enforcement says they have video of the moments before 63yearold yanfang wu ended up on the ground. They even talked to a person of interest. But decided that whatever happened to her was just an accident. Community activist group the Asian Justice Movement says theres more to the story. They insist that the woman was attacked and pushed to the ground and they want officers to release the video. Releasing the video is a good step. Ill say that the step feels particularly necessary now. This is approximately nine months after the death of miss wu. The investigation was closed or at least inactive for a majority of that time. It seems like its seems like theres no good reason to continue to keep that video secret. Sfpd wouldnt say what new evidence they have. And that releasing the video would jeopardize the investigation. We know the das office is looking into the different case in the bay view neighborhood this one about four blocks away where she was found. They say last week an elderly asian woman was attacked by a suspect who grabbed her chair punched her and threw her to the ground. The Justice Movement wants both of these cases investigated as hate crimes. We dont know yet if the two crimes are related. Police are not even identifying a suspect right now. The government released its monthly report on inflation yesterday. Cbs News Business analyst Jill Schlesinger is here to help us understand the results and while the numbers may not be telling the whole story. Jill, good morning to you. So tell us what did the february data show . Reporter well, unfortunately, prices did accelerate a bit in the month of february from the previous month. The Consumer Price index that headline rate up 3. 2 from a year ago. Thats up a tenth of a percent from the previous month. Now what powered that move . Well, we can blame two big categories. Shelter and gas which accounted for 60 of the increase. Now we have another number we call the core rate. That pulls out food and energy. The core rate did show some improvement that was down a tenth of percent from the previous month. You know what . At the end of the day, the numbers are moving in sort of infinitesimal tenths of a point and inflation is generally starting to come down. Just taking longer than any of us would like. Well, theres one item that was not included in the Inflation Report that may also be weighing on consumers. What is that . Reporter well, i think the fact that Interest Rates have risen so much over the last two years is something we dont actually account for in either the Consumer Price index or other Federal Reserve measures of inflation. And i think this is important. Think of it. We have millions of americans who owe about 1. 13 trillion in outstanding credit card debt. Their payments have zoomed higher in the last couple of years.
