Replacing the wet conditions we have the past couple of days with windy conditions as we head into the next couple of days. Starting this evening around 5 00 p. M. Were actually under a wind advisory as we can see wind gusts anywhere up to around 50 Miles Per Hour at times up impacting our northern bay areas or northern bay area residents and of course all throughout the east bay too. Now were going to see the partly cloudy skies in the forecast for us this morning. But heading into this afternoon, thats going to continue to sweep to the south and were left with clear skies starting around 3 00. Lasting into the evening hours tonight. Early Morning Hours tomorrow. And thats setting us up for a very dry break right around the corner and now our friend up in the sierra, theyre under a high wind warning and you can see that in the red right there. But back here in the bay, and all throughout the Sacramento Valley, the rest of us are under a wind advisory like i mentioned gusts anywhere up to around 50 Miles Per Hour expected. So downed tree and Power Outages are possible but i want to show you Something Else thats going on too. As that system moves its way in. Drying us up and giving us some windier conditions, were also going to be seeing warmer temperatures daybyday. I mean yesterday we were talking about upper 50s and lower 60s throughout the bay area. Now were seeing the return of the upper 60s off into the east bay and its only going to get warmer daybyday heading into the rest to have week and into our weekend forecast too. Which is perfect. Theres wings over solano happening and theres the st. Patricks day festival happening in San Francisco and lots going on all throughout the bay area especially in the Santa Clara Valley. But more on that in a bit. Metering lights are officially on. Game on ready rite heading into San Francisco this morning. But its the really only trouble spot we have is that ride through the bay bridge. And the other head lean is a slow commute into the Altamont Pass. Other than that, ill say this. Dry roadways and thats a big difference what we saw yesterday. That will certainly help for the morning drive. And so far, so good with the exception of the two hotspots that we would usually see around the time on a wednesday morning. All right, g. Developing news for the viewers on the infamous case. Scott peterson convicted in 2004 for murdering his wife and unborn child. Fast fore ward 20 years and he has a new defense team and a new defense. What is it . Dna. And a claim about a burglary near the peterson home around the time his wife went missing. So this is the first time many of us have seen peterson in years. He appeared you see that right there in a blue prison jump suit on zoom hair pulled back in a ponytail. Peterson originally sentenced to death, but four years ago, that was overturned to serve a life sentence without parole. Max darrow is about to show you now theres a group called thel. A. Innocence project, they are on the case saying that some evidence including dna may have been overlooked. Do we have your consent to proceed via zoom this morning . Absolutely. Thank you, your honor. Reporter Scott Peterson appearing before a judge Via Video Conference on tuesday from mule creek state prison as he seeks to fight his murder fiction with the help of attorneys from the l. A. Innocence project. Thats Paula Mitchell representing peterson. Back in 2004, peterson was sentenced to death after he was convicted of murdering his pregnant wife laci and unborn son connor. In 2020, the California Supreme Court overturned that sentence, citing errors with the jury selection process. In 2021, a judge resentenced peterson to life in prison without the possibility of parole. In 2022, his defense team pushed for a new trial based upon an allegation of juror misconduct but after a series of hearings, a judge didnt grant him a new trial. At the beginning of 2024, the l. A Innocence Project filed three motions including a request for post conviction dna testing and a request for reasonable discovery. We were very, very specific and we spent a lot of time trying to suss out what frankly are very alarming deficiencies in the discovery that was provided to the defense at the time of trial. Those are the items were requesting. The nature of the request is not a fishing expedition. Theyre very precise and very specific. Reporter the dna testing is another part of the claim. Theyd like to access evidence connected to a burglary near the petersons home that was right around the time of lacis disappearance. Legal analyst paula canny has followed the case closely. If that testing shows what they think its going to show, its a whole new ball game so to speak. Reporter she says the fact that the l. A. Innocence project even took on petersons case is significant. That organization, which only represents people who the project believes is innocent and can be exonerated by dna evidence, has taken this up. The hearing date on the motion to seal can be earlier. Reporter superior court judge Elizabeth Hill set three hearings regarding the motions. One of the few times we heard peterson speak, when he opted to appear virtually for the hearings. Petersons sisterinlaw and fierce advocate jamie was present but didnt address the media after the proceedings wrapped up. His attorneys provided a statement that read in part we have not commented on our motions and we will continue to present our case in court where it should be adjudicated. So we should note and this is important. The l. A. Innocence project operates independently of what you have likely heard about called the national Innocence Project which in this case, that Second Organization we just mentioned is not involved. Good morning to those of you who are waking up in wine country. Theyre mustard flowers and theyre in bloom and Brian Hackney reports theyre more than just a stunning backdrop. Reporter its the annual gold rush in the napa valley. Fields of gold as winter turns to spring. Its wild mustard. Although recent research has shown that it was domesticated as long as 6,000 years ago in central asia. And only recently has evolved into an indispensable ingredient at, where else . Mustards grill. Thats going to start clearing up a lot more as we head into the afternoon hours down in the south bay. Now for our friends up along the peninsula, along the east bay and up into wine country too. Some gusty conditions starting around 5 00 p. M. Tonight and a wind advisory goes into effect widespread throughout the bay area. Notice how the Santa Clara Valley is actually excluded from this. Thats not to say that it wont be breezy at times just means were not going to hit the max wind gust potentially up to around 50 Miles Per Hour. Now for the highlighted zones and regions on the map, we could see downed trees and Power Outages. Taking a look at tomorrow afternoon, advancing the clock just 24 hours past when that wind advisory starts notice up in the north bay areas like angwin stretching over into the napa and sonoma, could see wind gusts anywhere up to around 50 Miles Per Hour at times. All the way down into the south bay it will be lot lighter but i mean were talking about danville seeing gusty conditions too. So take it slow out there the next couple of days. And if you are sensitive to allergies you are probably already noticing it. Today, tomorrow, lasting into this weekend, were going to be sitting in the medium to high category for our pollen count so take it extra slow out there and make sure you have your benadryl and your claritin ready to go because there is lots to do this weekend and its going to be sunny and warm for us too. So napa sitting in the upper 60s today. Were going to hit the 70s right around the corner. A similar trend all the way off into the east bay and areas like concord and antioch. And down into the Santa Clara Valley, certain pockets still staying a little bit cooler like los gatos for example but right around the corner take a look at the next seven days. Each of these tubes shows what you the weather is going to be like for that day. Cannot only are we going to see sunny sky this is weekend but a nice warmup too with upper 70s and mid 70s in the forecast throughout most our inland areas and thats going to last into next week too. So lots of changes in the forecast for us starting this afternoon. This is the first dry break that weve seen this long in quite some time. But for now g over to you. I think we are so ready for a break from that wet weather jess, especially when it comes to your commute right . Cleared out of lanes but its busy down to 9 Miles Per Hour coming out of tracy. Near that Mountain House exit working over into the area of the Altamont Pass. So a few brake lights there to slow you down and once you are past that looks a lot better but hey look at all this. If you are just getting ready to head out the door to work this morning, you should be good to go for the most part. Everything looks pretty clear on 80 and highway 4 and even 101. Nicole . Time now 6 19. Duh 22 for a burrito sound like too much . How higher gas and housing prices pushed up inflation in february. The latest Consumer Price index shows prices rose higher than expected up 3. 2 over the year. Well, now forecasters say theres little to no chance the fed cuts Interest Rates at its meeting next week. Some good news though. Inflation did slow in some key areas including food. But not everyone is noticing the difference. Customers at a restaurant in San Franciscos Mission District are questioning the high price of their burritos. It was recently named the best in the mission. But one customer asked why the price has doubled in just a few years. So there is a reason why this Business Owner has had to do this. And Shawn Chitnis has the response from the Restaurant Owner that really informs a larger conversation about our economy. Watch. Reporter even before la vaca birria opens its doors, the team inside is busy at work keeping up the quality of their ingredients. Restauranteur ricardo lopez, says its a constant challenge to maintain his vision of mexican food at a price the public will pay for. I struggle with it, right . As a cook to really find who our Customer Base was. Reporter his cuisine centers around a recipe he developed from his grandfathers technique for making birria. A mexican meat stew. While he started that concept out as a food truck, for three years now hes been serving it at this restaurant in the mission. This is the food i want to make. If i want to continue to make the food i want to make, if i want to continue to keep, you know, testing new items and new menus, it all costs time and money. Reporter ricardo says at each step, he has to make a choice and for him, spending more money to get the best ingredients using additional time and labor is a must. An approach that earned some validation last fall when the San Francisco chronicle named his burrito the best in the mission. But a few days ago, one customer wrote online they remember having it for half the price two years ago. They still love the burrito, but said for 22 plus tax, they would consider other options around the city. So ricardo decided he wanted to write back. I thought all right, this is a great time to respond on that. And you know, it was in the middle of just starting our service and i sat down and everything just came out. Like this is what it kind of costs and looks like to us. Reporter in his lengthy explanation, he went over all the changes and costs in the last two years and he pointed out the price of beef has gone up more than 2 a pound for him and thats an additional 6,000 a month. Labor has also increased a couple dollars in that time, which is at 3,000 a month. Literally everything has gone up in price. Theres not one thing i can think of thats not gone up since covid thats come right back down. Reporter the customer also questioned if the article influenced him to raise the price. And he says yes. Not to make an extra buck, but to help him manage his expenses. If we literally want to stay in business, its not, im trying to pay for my ferrari or anything. Trying to keep, you know, the rent paid. Reporter that review of his burrito in the mission helped him realize he could charge more, which he hoped more people will now see as elevating the experience of a city classic. So we asked you this question this morning. Would you pay 22 for this burrito . Lot of people saying no thanks. But you know to me, this story its not about the burrito. Its just a vehicle to the larger conversation and when you break down his expenses what it costs these days, to run a family owned and operated business in San Francisco, theres a problem there. Yeah. Theres a problem. We need to talk about. I feel like im going to put my money and pay that 22, rather do it for someone i know who is working hard and feed their families. So what do you prefer . The shrinkflation where their portions are smaller so they can recoup the funds or just coming out like he did and saying look, i have got to pay the bills. Its going to be the same burrito just going to cost more. I prefer a business friendly economy. Because in that case, businesses dont look at shrinkflation as an opportunity. And also Business Owner look, he said im not doing this to buy a ferrari. Doing this to keep the lights on and to keep my employees in jobs. So thats what i prefer. Thats the larger conversation. Get to the temperatures in just a moment but what i want to really dry into right now is whats happening besides a gradual warm up. Also replacing the wet conditions we had the past couple of days with some windy conditions in the next couple of days. Winds are going to get stronger as we move into the thursday and friday forecast. Wind advisory actually in effect starting this afternoon. As High Pressure moves its way in from offshore. Now High Pressure does a couple of things for us and clears us up so into the afternoon hours we go get rid of the clouds we see right here all the way into the evening hours tonight. Stay clear and thats the trend through the next couple of days but yes we see a warmup and windier conditions right around the corner too. Wind speeds are expected to hit anywhere up to around 50 Miles Per Hour for the highlighted zones and counties on this map. Which includes all the Sacramento Valley and it doesnt include our Santa Clara Valley here in the bay area. But it does include the higher elevated areas close to santa cruz and especially up into the north bay. Keeping a close eye on wine country and heres the reason why. Lets advance even more than the hours all the way into the afternoon hours tomorrow and take a look at areas like angwin into sonoma. Napa too. We can see wind gusts close to around 50 Miles Per Hour as we head into friday morning. So outdoor objects that you dont want blown into the neighbors yard. South 880 a little slow out of hayward. And of course those brake lights in the Altamont Pass. Nicole . Taking you now to a developing story out of San Francisco. Eight months ago, an older woman died what police thought was an accident. She was found bleeding on the ground in the bay view neighborhood but now new evidence might suggest that it could have been foul play. Law enforcement says they have video of the moments before 63yearold yanfang wu ended up on the ground. They even talked to a person of interest. But decided that whatever happened to her was just an accident. Community activist group the Asian Justice Movement says theres more to the story. They insist that the woman was attacked and pushed to the ground and they want officers to release the video. Releasing the video is a good step. Ill say that the step feels particularly necessary now. This is approximately nine months after the death of miss wu. The investigation was closed or at least inactive for a majority of that time. It seems like its seems like theres no good reason to continue to keep that video secret. Sfpd wouldnt say what new evidence they have. And that releasing the video would jeopardize the investigation. We know the das office is looking into the different case in the bay view neighborhood this one about four blocks away where she was found. They say last week an elderly asian woman was attacked by a suspect who grabbed her chair punched her and threw her to the ground. The Justice Movement wants both of these cases investigated as hate crimes. We dont know yet if the two crimes are related. Police are not even identifying a suspect right now. Well, good morning to those of you who are waking up in the east bay. And we have an update for you on that hours long hazmat experience you saw yesterday that made the news. Turns out an abandoned tanker carrying vegetable based cooking imwas to blame. So in response, crews closed roads and ran tests while many of you were asked to shelter in place and in fact that applied to businesses as well. This morning, we can tell you pacheco road is open. To oakland now. An update on a response to business killing crime in the response in the form of a crackdown from the chp. In fact, governor Gavin Newsoms office releasing this report card of sorts after sending chp in to clean up crime. 168 arrests in the past few weeks including accused carjackers and suspected gang members. The chp also recovered 360 stolen cars during that sting operation. You might remember last month, the governor deployed 72 chp officers to oaklands high risk areas after the closures of several businesses. The government released its monthly report on inflation yesterday. Cbs News Business analyst Jill Schlesinger is here to help us understand the results and while the numbers may not be telling the whole story. Jill, good morning to you. So tell us what did the february data show . Reporter well, unfortunately, prices did accelerate a bit in the month of february from the previous month. The Consumer Price index that headline rate up 3. 2 from a year ago. Thats up a tenth of a percent from the previous month. Now what powered that move . Well, we can blame two big categories. Shelter and gas which accounted for 60 of the increase. Now we have another number we call the core rate. That pulls out food and energy. The core rate did show some improvement that was down a tenth of percent from the previous month. You know what . At the end of the day, the numbers are moving in sort of infinitesimal tenths of a point and inflation is generally starting to come down. Just taking longer than any of us would like. Well, theres one item that was not included in the Inflation Report that may also be weighing on consumers. What is that . Reporter well, i think the fact that Interest Rates have risen so much over the last two years is something we dont actually account for in either the Consumer Price index or other Federal Reserve measures of inflation. And i think this is important. Think of it. We have millions of americans who owe about 1. 13 trillion in outstanding credit card debt. Their payments have zoomed higher in the last couple of years.
