Stephen okay, that makes logical sense, but its not an excuse for lying to the american public. You could have told us to wear a bandanna over our faces, or a scarf, or eat a whole giant container of cheese balls and then shove the empty plastic jar over our heads. I would have done that i have done that. Fauci also made it clear that we should not be rushing to reopen. When asked if he would attend trumps upcoming rally in tulsa, he replied, no, adding that, when it came to trumps rallies outside is better than inside, no crowd is better than crowd, and crowd is better than big crowd. Now, were learning more details about trumps lawsuit trying to block the publication of a new book by former National Security adviser and the scrubbing bubbles disapproving grandfather, john bolton. The Justice Department is suing bolton for breaching his non disclosure agreement. Experts are calling the lawsuit one of the most extreme attempts to stop a former trump adviser from recounting his experience. And it aint going to work. First of all, theyve already distributed too many copies of the room where it happened specifically, to my room, where its happening. Second, according to one expert, every time the government has tried to prevent someone from publishing what they believe to be classified, they have lost. For more, we turn to cbs legal analyst, walter sobchak. Walter . For your information, the Supreme Court has roundly rejected prior restraint. Stephen thank you for that analysis, walter. Any other message for the president . Forget it, donnie, youre out of your element. Stephen thank you, walter. Trumps lawsuit claims boltons book didnt finish the pre publication process. But after rounds of edits ending in late april, the National Security official who reviewed the book determined that the latest version of the manuscript no longer contained classified information. Stephen but less than a week later, the white house started another official review that came at the request of National Security adviser robert obrien. And the white house has now taken longer to review the book than bolton did to write it. Thats why boltons already working on the sequel the room where the room where it happened almost didnt happen. And you can see why trump is so desperate to kill this book. Because this afternoon, several newspapers published excerpts. And i cant believe im saying this its worse than even i imagined. Lets start small. Bolton writes that during trumps 2018 meeting with kim jongun, pompeo slipped bolton a note disparaging the president , saying, he is so full of bleep . Not a great sign when youre meeting with a murderous dictator and your team is passing mean notes about you. According to bolton, trumps ignorance is near bottomless. Apparently, trump didnt seem to know that britain was a Nuclear Power and asked if finland were part of russia. When he arrived at the white house, bolton said chief of staff john kelly gave him a warning. You cant imagine how desperate i am to get out of here. But maybe most damning of all is boltons description of trumps pattern of corruption. He described several episodes where the president expressed willingness to halt criminal investigations to, in effect, give personal favors to dictators he liked, citing cases involving major firms in china and turkey. Adding, the pattern looked like obstruction of justice as a way of life, which we couldnt accept. History. Please welcome back to a late show, senator Kamala Harris. Senator, thank you for being here. Its great to be with you again. Stephen its really good to see you again. Before we get started, we just learned right before the interview, the officer, officer rolfe, who shot Rayshard Brooks in atlanta, has been charged with homicide. Have you looked at any of the charges and what is the significance of this . Well, one significance of it is that the District Attorney there, clearly from the first moments of the incident and the tragedy, took it seriously. He started an investigation, and i think swiftly addressed the issue. And so, now its now they go to trial, and theyll proceed to trial, and these are difficult cases, but i have confidence in the ability of that prosecutor to seek justice and to achieve justice. Stephen it seems like a simple thing to have happen, especially since theres video evidence. But i think it shows its kind of a low bar that the Police Departments and District Attorneys have to get over in order to address some of the issues of the protesters in the streets. If if someone shoots an unarmed man, black or white, that person should face consequences. It it so, part of what im fighting for right here in d. C. Right now is that we have a package of bills that weve named the justice in policing act. My partner on this, on the senate side is senator cory booker from new jersey. We are members of the congressional black caucus, which is leading it on the house side, with congresswoman karen bass. One of the components of the justice in policing act is exactly your point, stephen. Its about the fact when these cases go to court on the issue of excessive force, in most jurisdictions right now the question that was asked is was that use of force reasonable . As you and i know you can reason away just about anything. What we are pushing for is instead there would be a more just and fair question which is to ask, was that use of force necessary . So, changing the standard to actually meet the point, which is that when we are looking at these cases around the country, there have been cases that have been charged and brought, but the bar is so high, its almost insurmountable, which means that the communities and the families of these victims do not see justice. And so that is part of what we need to do to really restructure the way we are handling these cases. Stephen i know that we had we had senator booker on, and i know that the two of you are working on this legislation. Yes. Stephen and introducing it into the senate. Mcconnell has announced tim scotts justice act, that will go to the floor. Will you vote to advance that to debate . And if not, whats it missing for you . Well, so, i i think that senator scott is well intentioned, but, frankly, the what what has been proposed just has no teeth. We need accountability and consequences. It is an interesting thing, stephen, when we talk about the criminal justice system, we will often use the phrase consequence and accountability, as it relates to someone who is arrested, but rarely as it relates to the system itself and those people working within the system. And what the people who are, by the thousands in 50 states of america marching for, is that there be equal justice under law as we promise as an ideal, a founding ideal of our country. Were not doing that right now. And part of the reason were not doing that is we are not Holding Police officers who break the rules and break the law, we are not holding them accountable. And theres not serious consequence. And so, our bill does that. What ive seen in terms of what was offered today on the republican side, it talks about training. Well, weve been training folks. It talks about a number of things that are not about serious consequence and accountability for bad behaviors. Stephen President Trump issued an executive order yesterday, i believe. Yeah. Stephen was there anything meaningful in there from what you saw . No, its window dressing. But then thats usually what we get out of President Trump. No. And, again, the point here is that people are demanding change. Listen, there is frankly, the sad reality of it is that when we look at what happened in the murder of george floyd, when we look at breonna taylor, when we look at these cases that have repeatedly happened in our country, just most recently, but in the c just only 30 years. Im not going to even require you to go back to emmett till. Go back to rodney king. These are not new grievances, but they have gone unaddressed because the system is flawed, in that it has not held bad actors accountable for bad acts. And thats what we are pushing for. We are say noknock warrants, that there should be no ability to have noknock warrant for drug cases. Breonna taylor would be alive today if there had been a ban on noknock warrant in drug cases. Thats part of what my bill offers. My bill together with, again, those that are partners with this, is saying we need to have independent investigations. I know as a former prosecutor, the d. A. , the states attorney, who works every day with that Police Department should not be the business of then investigating and prosecuting a Police Officer from the Police Department they work with every day. And im going to tell you why. No matter how well intentioned that d. A. May be, there will still be the appearance of conflict. And in our system of justice, we must achieve actual justice and also the appearance of justice. And that means lets have independent investigations. I talked about a National Standard for use of force. Lets also have practice pattern and practice investigations. When i was the attorney general of california, i investigated Law Enforcement agencies that were alleged to have a pattern and practice of discrimination. That should be happening in the United States department of justice, no thanks to bill barr and donald trump, theyve virtually ended under this administration. But we need to renew those investigations and also give them the subpoena power to investigate Police Departments even if they dont want to be investigated. Stephen because you were the attorney general of california for, i believe six years . Yes, thats right. Stephen sometimes called the states top cop. Yeah, yeah. Stephen you got some criticism from your democratic colleagues for some of the actions you took as attorney general, but does it also give y not understand what defund the police means. Some people may understand demilitarize the police, or reform the police or restructure. When you hear defund can you explain that in a way that doesnt scare some people . Well so first i just want to say, that i have seen in my career as a prosecutor that police and leaders in Law Enforcement come to the table and join with a movement that is about creating Greater Trust of the system and in the system and of Law Enforcement. When i was attorney general of california, we put in place the first in the nation for a state, implicit bias and procedural justice mandatory training for Police Officers. And that was because Law Enforcement leaders came together with Community Leaders and said, we need to acknowledge the fact that all of us carry implied bias, but when you have a badge and a gun and you carry that, it could lead to lethal consequences. So i have seen in my career how we can create an environment where people come together and acknowledge the truth, no matter how difficult that may be, and deal with it. To your point, on this issue of you know, theres a hashtag defundthepolice. Ive never really tried to put anything i think about in the context of a hashtag, but i will say this we need to reimagine how were doing public safety. For too long, the status quo thinking has been by putting more Police Officers on the streets you will have more safety. Thats just wrong. When you look at it, the reality is upper middleclass suburbs do not have that kind of police presence. But what they do have . Wellfunded schools . What they do have, high rates of home ownership. What they do have, families that have meaningful jobs with salaries that allow them to get through the end of the month without worrying about whether they can feed their children. What they do have is Small Businesses that access to capital. What they do have is access to healthcare and Mental Health care and it is affordable. So when we talk about how to achieve safety, which should be our collective goal lets understand Healthy Communities are safe communities. In the many cities in america, onethird of their entire city budget is dedicated to policing, we really have to have an honest conversation about whether that is the smartest use of the resources . And by no means does this mean buoes mean taking a does thimeai cr latther taxpay truly safety. Because if it is, invest in schools, invest in healthcare, invest in jobs and youll have safe communities. I did, but i will tell you, the first protest i ever attended in a stroller when my parents were marching in the so is kindsomethini laughter stephen i i know that your your mom was very politically active. What did you learn from her . I learned that that the greatest movements that have that we have seen in recent history in our country, but probably since the beginning, have been borne out of protest. Have been born out of understanding the power of the people to take to the streets and force their government to to become to address what is wrong, the inequities, the inequalities, the unfairness, but also the conscience of a government is its people to force the government to to be true to the ideals that we say we hold dear. And almost everyone one of those marches has been about one fundamental ideal in our country which is equal justify justice under law and fighting to make sure we have a government and a country that least every, you know, few steps gets closer to achieving that ideal. Weve not yet reached it. Weve never actually reached it. But these protests i think are the catalyst to getting there. Stephen what did you see in d. C. . What was it like to to march in those protests . Yeah, you know, it was ill tell you one of the things, stephen, that i saw that gives me such hope, people who seemingly have nothing in common, who know they have everything in common. It was really its a beautiful sight. People of every race, age, gender together, and seeing the commonality, and it was then the commonality of spirit. It was something that was so very powerful, and i think we all have to recognize it for what it is. There is we have arrived at a point in our country that we should recognize this is not just a moment, it is a movement. It is a movement that is fueled by the diversity, the beautiful diversity of who we are coming together as a unified body, demanding, in this case change and justice for everyone. Stephen as a as a senator, as a politician, someone who has to respond to the constituents, what do these protests mean to the ability to effect change. Yeah. Stephen legislatively. Because the reason i ask is because yeah. Stephen i woke up this morning we do, like, a news breakdown at night, a news breakdown in the morning, i looked down, and asked where is the news on the protests . Are they gone . Are we not talking about them anymore . Because it seems to me it has to be sustained in order to maintain the pressure and to maintain that commonality of purpose for people of all races in the United States to bring this kind of justice thats being called for. How important is it for these protests to continue . Its critically important. And im going to tell you something. I made a very conscious decision to become a prosecutor. I grew up in a community that was not always on the best end of Law Enforcement in terms of how the laws were applied. Theres not a black man i know, be he a relative or a friend, who has not been the subject of some sort of racial profiling or excessive force. So when i made a decision to become a prosecutor, it was a conscious decision, which was to go inside the system and have some leverage there to effectuate change. I say that to say this the only way were going to truly achieve change is when there are people in the system who are willing or pushing to do it, and when there are those folks who are outside of the system demanding it. I am very clear that some of the success that weve been able to achieve around criminal Justice Reform would not have happened in recent years were it not for black lives matter, and the intensity and the brilliance of that movement, that forced at least that there would be some counterforce to the status quo, which is so reluctant to change if not hostile to change. Thats what these movements do, that where these systems are so invested and ingrained in what they call tradition but is status quo, often which can be wrongheaded, these movements provide a counterforce to get us to where we need to be. Stephen so even what some might call weak tea proposals by the republicans right now wouldnt be happening if there werent these protests in the streets . Im sure of it. Im sure of it. Im sure of it. And its tragic because the reality is these these protests have been happening in maybe smaller form for generations, but lets just look at where we are right now. And and acknowledge, to your point, yeah, had these protests, had people by the hundreds of thousands not been out there marching, many who might be relatives of those very people who have been obstructionists until now, we probably wouldnt be where we are. But, again, back to where we are, what the republicans are proposing is by many accounts and certainly by my account absolutely insufficient to meet this moment and we need to go with the justice and policing bill. Stephen i want to make clear that i know there are protests still happening in major cities across the United States. Yes. Stephen im just not seeing the reporting on it that i had for the first few weeks. But thats. Theyre not going to stop. Theyre not going to stop. This is a movement. Im telling you, theyre not going to stop. And everyone beware, because theyre not going to stop. Theyre not going to stop before election day in november, and theyre not going to stop after election day. And that should be everyone should take note of that on both levels, that theyre not going to let up, and they should not, and we should not.
