But once he was transferred local prosecutors dropped that charge and the sheriff says his agency was following the city sanctuary law when sanchez was released on april 15. Mayor lee has said that was a mistake. Sheriff Ross Mirkarimi said he had no choice in the matter. We asked our devin fehely to take a closer look at San Francisco law and tell us who is right. The mayor is backing away from the very law that he supported. Do i need to educate somebody about how to pick up a phone . He is looking for a scapegoat. Reporter the war of words over the citys sanctuary policy has done little to answer the basic question is the law itself flawed or were mistakes made in how it was enforced . Its tragic anytime somebody dies in this manner. Its not clear to me, though, that these sorts of incidents should be the basis for rethinking things like sanctuary policy. Reporter Santa Clara University law professor [ non english language ] says the sheriffs departments request to move Juan Francisco Lopez Sanchez from federal custody to a San Francisco jail on a 20 yearold drug charge was like giving him a get out of jail free card. When prosecutors dropped the charges, sheriff mirkarimi said he had no choice but to set Lopez Sanchez free handing him over to the feds not an option, he says, because he wasnt a Violent Offender and spelled out in the citys ordinance. His other felonies are immigrationrelated felonies. That is the felony of reentering the country after having been removed. None of these indicates particularly violent or high risk sorts of behavior. Reporter the professor says he understands the hang wringing and fingerpointing in the wake of the terrible tragedy. But he says a sanctuary or noncooperation policy will almost always mean someone who immigration officials either want deported or at the very least to stay behind bars will be set free instead. The Public Policy choice that california has made as a state and that San Francisco has made as a county and city is that local resources are better spent on the whole not focusing on federal immigration. Reporter devin fehely, kpix 5. A big move today in washington to block sanctuary cities from receiving federal funding. Republican senator tom cotton proposed the amendment. He said if santa anas sanctuary cities dont follow federal policy they shouldnt have federal money. If they frustrate federal immigration law, the city shouldnt expect u. S. Taxpayers to underwrite that effort. Under the amendment a city would become eligible for grants after repealing any sanctuary policies. And the attorney general would then have to certify the areas no longer a sanctuary city. A husband and wife survived a Home Invasion robbery overnight. A group of suspects burst into their san leandro home while they were asleep. Kpix 5s da lin on what happened just before the gunfire rang out. Reporter Police Say Two to three people broke into this house to try to rob the people inside. It happened around 1 a. M. On lakeview drive. Police say they kicked down the homeowners bedroom door. The homeowner pulled out his shotgun to try to shoot the robbers. But it was unloaded. Police say the robber shot the homeowner once in the upper body before running away. The elderly home other than lost a lot of blood. The white papers on the ground mark a trail of blood the homeowner left on the way to the hospital. He can barely walk. He has bad feet. Reporter what do you make of the fact that he is still packing and shooting at an intruder . Knowing robert, he will. If somebody is breaking in, he will shoot first and talk later. Reporter the homeowner is in his late 60s listed in stable condition and is expected to survive. His wife came home from the hospital this afternoon and didnt want to talk on camera. In san leandro, im da lin, kpix 5. An expert panel just handed caltrans a long to do list to address corrosion concerns at the base of the new bay bridge. Elizabeth cook is here with the recommendations. Reporter allen, the Bridge Oversight Committee approved new funding today to immediately begin drying and ceiling the anchor rods meant to stabilize the new eastern tower in an earthquake. More than 100 of them have been sitting in bay water because a contractor failed to grout them properly. An expert panel convened to examine the issue, gave its initial recommendations today. They include installing special jacks to allow for cleaning out the rods and designing a dehumidification system to dry them. A special coating would then be applied to prevent further corrosion. The panel is also recommending a custom steel assessment to determine the longterm effects of the saltwater exposure. But the projects chief engineer reiterated today the bridge is safe and the rods are currently performing as designed. The experts have agreed that this is not a safety issue, this is certainly a performance issue. And we appreciate, you know, their perspective, their expertise, thats why we have them. It will take about three months to get all the repair work done at a cost of at least 4. 3 million. The final tally will depend on further recommendations from that panel. Today a bart Spokesman Says the 1,000 volt current that was supposed to go from the third rail to the train went through the air instead. Its an inconvenience and we do pride ourselves on providing reliable train service. Reporter bart is investigating whether the malfunction had anything to do with the massive railroad and Equipment Repair job on this stretch of tracks in the last several weeks. The old doyle drive will be shut down all weekend until monday morning at 5 a. M. It is the main approach to and from the Golden Gate Bridge. These work crews are getting ready, they are all lined up and starting at 10 p. M. Tonight. This stretch that goes from the end of lombard to the Golden Gate Bridge will be closed. Thats so crews can put the final touches on the new bridge approach of the Park Presidio project and starting monday at 5 a. M. After an all weekend closure, youre going to be able to do something you havent been able to do since 2009 drive from the marina to the avenues and back without having to take those pesky detours and hitting stop signs and go all the way this time to the bridge. This comes after city leaders and the police union approved a Pilot Program back in may. San jose mayor sam liccardo says he hopes the cameras will strengthen bonds between police and the community. The drought takes such a drastic toll on one Central Valley town that activists are banning together to bring them water. A group called the Family Water Alliance trucked in 1800 gallons today to east porterville. Wells have been running dry all over the tiny town in tulare county. The trucks made a stop at the state capital to bring attention to the problems. East side porterville we have over 7,000 residents who do not have water. They cant even flush their toilets. The water will be dropped off at a Church Parking lot so people in need can come pick it up. Several north bay cities got hit with a light rain today. On the heels of the rain today, perhaps a bigger bit of good news. It is now near certain that we will have an el nino winter heading into the year 2016 and this is the big headline. They say the likelihood of a strong el nino, the one that historically have given us a lot of rain in the winter, that is increasing. The chances of an el nino a strong el nino are increasing.
