A 15yearold boy who lives here arrested on suspicion of the murder. We blurred his face because of his age. You could see Police Officers rushing over to the area of dumpster just before 8 00 last night. This is where middleton was last seen riding her scooting sunday afternoon. This her image captured on a surveillance camera on this this building. She had been playing with friends. Witnesses put that 15yearold in the area and time of maddys disappearance. You have people in the complex who saw the individual. As far as what they actually saw him to, i dont know. But we do have people that we will be interviewing. Reporter the fbi and specialized search and rescue dogs helped in this search. Its unclear why it took more than 24 hours for investigators to make the it discovery of this body found on the property. If the body had been there the entire time or put there later. We are expecting it will be loaded into the coroners van shortly and taken away here. Juan francisco lopezsanchez allegedly shot kate steinle earlier this month. Sanchez is an undocumented immigrant with a criminal past who had been deported several times. He had just been released from San Francisco county jail this in april. A judge is expected to set a date for a preliminary hearing today. Another unexpected twist in the case against the man convicted of killing a Bay Area Police officer. Jim capoot. Problems with the jury could force a judge to declare a mistrial. The family of Vallejo Police officer jim capoot has been waiting for closure ever since the officer was shot while chasing ago suspect through backyards in vallejo, that was bery four years ago. Henry smith was convicted and now faces life in prison without parole or the death penalty. But today a judge may have to declare a miss trial if he cannot find a way to get those two jurors to see the process through. The jury was on this case for the month long trial, the penalty phase expected to take maybe as long as that, but important as that jury duty is, one juror reminded a journal of a move out of state planned for next week, another told the judge of a planned trip out of town. Now, order thaerl that would heap bringing in an alternate juror, someone whos has sat through the whole trial, but there are no at fat jurors left. Last week the judge dismissed a juror for alleged bias against police, the week before that another juror was dismissed because of a Health Emergency. Earlier in the trial a jury was excused over misinformation on the jury questionnaire. No alternates remain. So the judge can seat an entirely new jury for the penalty phase but legal experts say that is really unheard of. So this could be grounds for an appeal and back to the drawing board, sam. Cal train is joining the city of palo alto to replace four miles of fencing on those tracks with taller fences and are testing out heat seeking cameras which would alert officials when someone is on the tracks. So i wanted to also address the fact that saving one life is actually saving potentially hundreds of lives and at least hundreds of people from suffering further. This morning officers in San Francisco checking to see if a dog they shot last night has a violent history. It happened last night near city hall. It this morning we saw about eight to ten investigators and crime scene technicians head to that dumpster and open the lid, taking many pictures, taking out cardboard. About 10 to 12 minutes later we saw them pull the body out of the dumpster and load it on to a fwurny before taking it away. It is it is double the heart break, police arresting a 15yearold boy on suspicion of murder. Neighbors say he has lived with his mother at these apartments iryears. I have known him for a long time. Into the next couple of days we will have the sizzling temperatures and then this High Pressure moves through the east it draws in monsoonal moisture. We will replace this hot and dry weather for some milder humidity and this weekend may still not be all that comfortable, especially with the highs dropping back in the 80s and the high humidity to go along with that. So today the threeday outlook shows those highs reaching into the 80s and 90s across missouri of the bay, even 100 degrees in spots like the north bay and the trivalley and the east shore expect highs in the upper 80s and then dropping back to 78 degrees by thursday. Specialized search dogs now part of a greater search for a missing San Francisco teacher. Ed cavanaugh was last seen friday july 17th when he left on a dirt bike ride west of tahoe. A judge is expected to set a date for a preliminary hearing today. Another unexpected twist in the case against the man convicted of killing Bay Area Police officer jim capoot four years ago. Reporter in fact, the judge may have to scrap the whole trial including the conviction part if he cannot convince two jurors to put their lives on hold just a little longer. The family of vallejo Police Officers jim capoot has been waiting for closure ever since he was shot following a bank robbery four years ago. Henry smith was convicted on friday and now faces life in prison without parole or the death penalty. Today the judge made it clear a mistrial if he cannot find a way to get those two jurors to see the process through. The jury was on the case for the month long trial, the penalty phase expected to take about that long as well. But as important as that jury duty is, one swroor remind td the judge of a move out of state next week, another told the judge of a planned trip out of town. Now, ordinarily that would mean bringing in an alternate juror who sat through the trial in its entirety, but there are no alternate jurors left. Last week a juror dismissed for alleged bias against police, the week before another juror was dismissed because of a Health Emergency and earlier in the trial a jury was excused over misinformation on the jury questionnaire. Now, without alternatives to complete a jury the judge can seat an entirely new jury for just the penalty tase, but legal experts tell nbc bay area that it is nearly unheard of for a judge to do that and a it could be grounds for an appeal. Firefighters in vallejo paying a special tribute to a fallen comrade more than 30 years after his death. The vallejo fire depth will launch the robin mackbee program today. He spent time tutoring kids at the local boys and girls club. He was killed in the line of duty in 1980. The program will serve Vallejo High School students through mentoring and career development. So many families have had to watch a devastating string of teen suicides on cal train tracks. Cal train is now joining the city of palo alto to try to stop this by replacing four miles of fencing on the tracks with new taller fences. That was video of a recent community meeting. They are also testing heat seeking cameras which would alert officials when someone is on the tracks. An Early Warning would give responders time to stop a train or get someone out of harms way. A murder suspect turned himself into police after a shooting on 880 in san leandro. Shooting happened early saturday morning. Chp officers heard the gunshots and rushed to the scene. They found a man inside a car on the freeway shoulder shot several times. He died at the scene. Chp says the suspect shooter was transferred to san leandro after turning himself in yesterday. New this morning it started out as a typical test drive but it ended with an arrest and between those two points are accusations of kidnapping, attempted robbery, a police chase and a crash. Around 3 00 yesterday afternoon a man asked to test drive a van at a dealership in concord. He and a salesman trove around for a bit and then the suspect asked if they could drive to his house in pittsburg to show his family the car. While driving back to the dealership the suspect claimed it was a robbery and began driving erratically. When he slowed the salesman managed to jump out and call police. The suspect eventually crashed and was taken into custody. Even if he had gotten away, he reportedly left a copy of his drivers license at the deal dealership before that test drive. So much for that plan. Officers in San Francisco are checking to see if a dog they shot last night has a violent history. It happened last night near is it city hall. Police say they pulled over someone for a drug bust. That person this this a dog who reportedly charged at the officers. They then shot the dog in the ear. It survived the hoogt. The good thing was that after he charged and our officers discharged the firearm the owner was able to regain possession of this his dog and calm the situation. The dog did not bite the officers. Its now being treated by animal control. San Francisco Police are going to be talking about shaping their policy for the use of body cameras today. The department is holding a meeting to discuss how it is going to use those cameras and under what circumstances.
