have seven colleges under investigation by the department of education's office for civil rights regarding reports of discrimination. alleging anti-semitism and anti-muslim harassment. the depa department of educatios the investigations are part of the joe biden and kamala harris to nude interest in taking action of these rising reports going on across college campuses since the war started. israel since we got here, you saw this over the last couple of days c, the warnings about the rockets from gaza being fired into central israel, hearing all the booms of the outgoing artillery that the israeli forces were sending come of it they have really tightened grip in and around northern gaza, forces continued search of the hospital where they say a tunnel was found within the complex in addition to guns and other military equipment that soldiers say they discovered inside. forces are also moving deeper where they discovered a training center for islamic jihad, and this is also the general area where israel has urged civilians to move to an effort to get away from the war, so the u.n. is worried about what that could look like as the humanitarian crisis only deepens. >> we are obviously very concerned about further operations and the impact that it will have on civilians, but there is really no place in gaza that is safe at this time. >> life inside for civilians continues to get only more difficult, food and clean water is becoming scarce, so is medical aid, hospitals are performing surgeries without anesthesia i'm of the sick cannot be moved because her so much fighting going on. we are also learning elsewhere in the region that the number of attacks on the u.s. troops is going up. there have been three new attacks in the last 24 hours bringing the total to 61 attacks on u.s. troops since october 17. >> kevin: be safe out there, as always. let's bring in the global situation room president and derek anderson come of the green beret that trained with them. let me begin with you, i would love to share with you what the president has been saying about what israel is doing on the ground, he's trying to say that they are not going and foolishly, they are trying to be strategic. i want to get your reaction on the other side. >> not like the russian hospital knocking down doors, shooting people indiscriminately. but they say they plan on attacking israel again, and this is a terrible dilemma. i have made it clear to the israelis, but i think the only answer here is a two state solution. >> it's difficult, people say two state solution, it's difficult to talk about that, given what happened. you are saying that we were attacked, i don't want to hear about that right now come i want answers and i want to make sure that it doesn't happen again. >> yes, that is what is right. if you look at the joe biden administration, it is a daily and a dollar short. if you look at the hospitals, what has happened to them, over the course of the three hospitals, we have seen them specifically where it shows hamas shooting from windows hiding behind civilians as they come out the door and then come out shooting again. we just saw pictures of it, they have all of this and recently we have seen the bodies of the hostages. but the biden administration any time they've been asked by the media, public or anyone, they say we don't have the intelligence but we don't know what's going on. only when they go in with live video stream and then a few hours later sure as heck they come outside guess what, we did have intelligence. we see that every single day. >> building in on that, it is interesting when you see the images, we are seeing tunnels, hospitals, weapons, sometimes religious circumstances, it seems to bolster the argument that they are talking about doing whatever it takes to target civilians and use civilians as shields as they continue to prosecute the war. am i off-base on that? >> no, without question. this is something that is not a new discovery. we have known a long time that they build bunkers, other schools and civilian targets, precisely with the goal of trying to create that international outrage. the u.s. leaders particularly are somewhat careful in how they navigate this minefield, because ultimately hamas is exploiting some of this condemnation, i think quite frankly it comes down to what the leader of hamas said in an interview a couple weeks ago, that they have done nothing to protect civilians on the gaza strip and instead they have dug deep tunnels for fighters so they can continue to prosecute attacks against the israeli people. >> it is a challenge when i asked the question because i want to be fair. what i mean by that is there are real consequences, we are talking about desperation, we heard jeff mentioned that in his report, what can be done for the people in the short time that we have left. >> first and foremost, israel needs to take every step reasonably possible to target welcome a protect civilians, show restraint, as you saw with additional fuel and medical supplies authorized that israel is taking considerable steps to ensure that civilians are protected and cared for, i think it is important that in the coming days we see more of those steps that are taking place. >> in about 15 seconds i want to share this graphic. they mentioned 61 attacks on military forces just since october 17, building on what we have been talking about, what, if anything, can be done? >> when you look back in december 2022 come of the secretary of defense said deterrence goes through strength, we have 61 attacks since october 17, almost two to three per day. we are not doing that right now. the first service member that gets injured seriously or gets killed come of the blood is going to be on their hands for the joe biden administration. >> gentlemen come i think you as always. meanwhile, breaking tonight, a victory for donald trump as a colorado judge ruled yes committee can remain on the 2024 ballot in the centennial state, we have more on that including more on the ruling. >> this was largely viewed as a wider effort to disqualify president donald trump from the ballot, feeling in colorado, becoming the second state to rule in favor of former president trump. >> this whole series of cases relies upon some unusual theories from this situation. >> nearly three dozen lawsuits seeking to remove him from ballots, under the 14 amendment insurrection because, arguing that the alleged role should disqualify him. but sarah wallace said part of the decision and its reluctance to embrace an interpretation which would disqualify a presidential candidate without an indication that such is the intent of section three. this comes after a judge recently ruled that the question is best settled by congress but did not rule out general election challenge, if donald trump becomes the gop nominee. it is a ruling appealed probably to the supreme court, which has never ruled on the insurrection. >> it could be very interesting indeed. thank you so much. let's bring in our former federal prosecutor. and you know, gentlemen, i would like to share this headline. serene says efforts to disqualify donald trump, section three states that no one should hold office in the united states if they have engaged in insurrection or rebellion or given aid or comfort to enemies thereof. and the u.s. constitution doesn't lay out how to enforce the clause to disqualify a candidate. so joe, what is behind all this effort? should the people decide? >> yes, exactly. this was a stretch to begin with some of this argument come of the ruling is the actual right one. i don't think anything's going to change that, but the voters should decide. the legal system is not a mechanism to vet candidates, not want to manipulate elections, people have seen this along with a civil case, criminal cases, efforts to disqualify donald trump from the ballots, and it's like wait a minute, that should be for the voters to decide and not legal system to block his candidacy. >> this seems unprecedented, yet it continues. almost every month there's another challenge, another judge that's maybe going to hear something like this. what is behind all of this? >> this is based upon the reading of the 14 amendment taken out of context. so what i'm talking about, the aid and comfort thereof, specifically it was intended to stop former confederates, waiting for congress or others, and again, given that interpretation come of this level of what the 14th amendment believed income i do believe given this current interpretation come at this same jurisprudence can overturn other disenfranchisement laws, which was also intended to stop former confederates from being able to vote in elections as a result of their participation. so i think with this ruling, it could expand the right to vote to individuals that were incarcerated because of this, that some are not able to vote. >> that is a very interesting take. wanting to get you both to weigh in on this, she was on mornings with maria, she's talking about the way that the law seems to be. it handled differently for donald trump versus joe biden, i will get your reaction on the other side. >> here we have joe biden, are we going to forget about the fact that he is violating classified documents, we didn't read his house or hillary clinton cells, and what did he say in 2016? no reasonable prosecutor will bring this case. why are we bringing cases against president trump? >> you know, i read what i read, probably not going to go anywhere, and yet if this were anyone else this may not go that way. >> oh, yes, no surprise there. the justice department will not take action against him for violating the laws, but at this point i would respective more if the president would get on the camera and talk to the american people, explain why he thinks the justice department should give him a pass for mishandling classified documents, and yet throw the book at his opponent just in time for next year's election, to have maximum impact on the elections. i think people are understandably aggravated and again saying hey, why is the legal system being used as a political tool? it should not become a but it seems like it's being completely missed used for the purpose. >> has been joe biden, mike pence, you know, president trump had differences. it is differences in how things are handled. >> i don't know if he followed protocol, he did have documents he for second. but as long as he doesn't start wrapping, since he wants to be one, he probably has a good chance to be heard, but it's going to be interesting to see who will continue to follow the lead of those that say abortion should be left to the states or a federal ban or to see if people are going to fall in line with what former president trump has had to say. i think many of us think okay, who is really going to have to go toe to toe with donald trump, iowa is the place see where that starts. i'm looking forward to seeing how it works out. we will have an opportunity to see how wetlands. >> he does like to do that apparently. i saw that early in the season. i saw the billboard, probably not true, yet it is an effective tactic. how much will it stick with those in iowa? >> at the primary stage come of age seem to be boosting donald trump, i don't know if that is going to be there tactic. iowa does have a more evangelical voter base, people that voted for ted cruz in 2016. so i do not think that they are wasting their money come of the democrats want to run, but an extremist that evangelicals might like, so it's a double whammy for them. yes, obviously trump has distanced himself from abortion more than any candidate. he sounds pro-choice these days, so it's misleading. >> yes, i think it will be that way with the party standard there as well for good reason, following up and then getting you to weigh in on this tweet from elon musk, to call it disturbing might be the understatement of the week, certainly offputting for many, including many corporations, what do you make of it? and i guess what was he thinking and how much does this hurt his brand? >> i guess i was not as scandalized because i have a recent memory of the anti-defamation league the describing it not based on race but an hierarchy where whites are above to marginalize people of color, and so i think that what elon musk was saying with that and sort of promoting that tweet, to the community, if you're trying to push a racial hierarchy, which they are trying to push that racial hierarchy, don't be surprised when people believe you and find a racial hierarchy and act accordingly. i don't think pointing out the anti-defamation league's definition is harmful to everyone and also to the community. >> it's interesting because i have not thought about that from the perspective of the last 20 seconds or so, your reaction? >> i mean, who has elon musk not offended. as far as my community is concerned, racism tripled under his watch. so i am not confused about any comments that is made or that he has supported, i don't really take twitter seriously anymore, it has been a dumpster fire since the date he's taken over from every way possible and again, folks said they wanted free speech, the ability for people to get on a platform and say whatever come at this as a result of that, this is free speech and it doesn't always land well in particular communities. >> i would be remiss if i did not share this letter to america that's getting a lot of talk here today. why the letter went viral on tiktok, for some, a big part of his justification and what they have talked about, it resonating with what is going on in the middle east, leading for calls for cease-fire, also accusing for hypocrisy for allowing them to occupy palestinian territory and violating their own law by impersonating people in guantánamo bay without charges. i wanted to get your thoughts on that and then wrap this up. >> welcome i'm a veteran, so honestly i'm not interested in taking advice from him. i don't even know why that is a thing. some folks agree with this position, but the simple fact that it was pushed out on tiktok, the larger question is what do we allow it to go on social media sites, what is misinformation, what is not, what kind of hate does this view, because we are talking about a man that was okay with killing american citizens, whether people agreement that are not, he is certainly not the messenger. >> your final thought? >> i think that everybody is pointing fingers at tiktok, but it's a little bit of a scapegoat. and obviously that filled the void come of the void is a lack of patriotism, patriot education, teaching us western values, we should think about filling the void in addition to banning tiktok and asking for their algorithm. >> thank you. started to see the violence. we have seen a death in ventura county, cops get attacked, the escalation, and it feels a lot like it did in 2 2020 post geore floyd with radicals and others extending their activism into what is clearly, clearly illegal behavior. so unless the police are allowed to pursue, we are hoping to the prosecutor's in these communities actually prosecute, because if they don't we are going to see this happen more and more, violence begetting violence and it could get out of control. >> yes, it certainly could. can i ask about san francisco. you know come a much was made of the past couple days about gavin newsom trying to clean things up, make things pretty and clean for the chinese president visit, what does it say about san francisco and the visit? >> welcome i will say that anyone who thought this was truly clean, by san francisco standards, i suppose, but it was cleaner. what it tells you is they care more about dignitaries than taxpayers because it shows you that they could actually get the crisis partially under control if they wanted to. these are policy decisions they wanted to make, including not to sweep up the encampments, not to enforce the law, that is nothing more than a political decision to make asking you about seattle as well as housing costs, what is the leadership trying to pull? >> welcome you have about 38 mayors in total writing a letter to congress across the country. for the most part these are city leaders who come from areas that are democrat ron that have had a drug crisis, they are asking for 1.5 billion from the supplemental budget that the president has already put forward, they would like to use that to go after the drug crisis that they created. >> every time there's a piece that you have written, most
