And i really do think joe biden may have financially benefited from all of this. There are emails showing that joe biden received payments as a result of what the money flow to his son. And then his son shared it with joe biden or paid his expenses at his homes. This is exceedingly worrisome. A Vice President who appears to have been on the take to help his son make more money. And i have another question what about joe bidens Brother Frank . Is there any evidence, was joe biden on any phone calls with his Brother Franks potential Business Partners to help frank get Business Deals . And, you know, these democratic lawmakers had better be careful they dont get pulled into this case because, as you were talking, i made this note. Because you talked with President Biden and he assured you that thats what they were talking about. Get them on the record about how they claim to know this even more what theyre doing is theyre reading between the lines of a document that came out of an interview. It does matter because it pulls them into the case and they might be quiet if they thought, well maybe i dont know the truth. Maybe i should, you know, pipe down until i do or ask the president. Yeah, but theres another issue here, too and it doesnt matter if he only talked about the weather. He was on the line. The point is that he was showing that hes that his son has influence and can reach him. Thats why. It was perfectly right if he just talked about the weather for hunters appearances. It showed i can get my father. I have influence. I can use that influence for you. That is the corruption. And that is what joe biden exposed himself to by putting himself on the line even if he only talked about the weather. He never should have been on the line. Shocking as it was, trumps behavior on january 6th did not violate any laws in obvious ways. Phil, great to see you. So when i read that in the New York Times, i started to think if all that is the case, why are we even where we are . Why dont these charges just get dropped . Listen, whether someone loves donald trump or hates donald trump, i think all americans should be, frankly, very alarmed by this latest indictment because, in my view, the entire thing violates the First Amendment. Not only was trumps political speech constitutionally protected as free speech, his efforts that he made to challenge the election such as reaching out to the Secretary Of State here in georgia and even talking to mike pence, those were efforts by citizen taking their grievance to a government official. And that is specifically covered under the First Amendment. Americans have the right to petition the government for address of grievances. All of this, i think, is covered by the First Amendment. Listen, the entire premise of this indictment is trump knew in his mind subjectively that he had lost the election and that there was not any kind of Election Meddling or interference or frauds that would have changed the results. Its going to be very hard, if not impossible, to get inside his head and prove beyond a reasonable doubt that trump actually knew what he was saying was false. Theyre going through a lot, harris, on people like bill barr or maybe even mike pence who shortly after the election said to trump, look, you lost and it was fair and square. But thats just their opinion. Trump is being criminally charged for failing to accept the opinions of certain of his advisors. Harris if we know all of this, again, i come back to it. How does jack smith even have ground to stand on . What is perching him to the point where he can so captivate an entire american electorate basically inserting all of this into the middle of a political season . How does he have the power to do that if the charges can be easily refuted as you just did . Well, somehow, donald trump has to get not only that issue but the First Amendment issue i think before an appeals court, if he can, before any trials and before the election. The problem is that normally, these things are litigated with the trial judge and if you get an adverse ruling, you have the trial and if youre convicted, then the whole thing goes up on appeal. But that could take too long. Donald trumps legal team has to figure some way to get this to the d. C. Court of appeals and then potentially to the u. S. Supreme court if they can find a Legal Mechanism to do it because i think theres a novel legal argument here that all of this, when you put it all together, you know, somehow rises to the level of a constitutional violation with respect to the election and the president ial election. This is something that is brand new. Weve never been through this before. This is all fresh, legal ground. And donald trump has some smart lawyers working on his team. Hopefully, they can figure out a way to get this to the Court Of Appeals before he has to be tried on any of these charges. Harris thats so brilliant. What youre talking about is preemptive offense. Kind of like what my husband and i do with our teenagers. We meet in the kitchen as cojudges first. And then we try to, you know, push against whatever the case is. Im making light of that a little bit. But in all, what youre saying is there are things that they could be and should be doing right now that could really make august 28th the next time we potentially see everybody in court very interesting. Your last quick thought. Well, theyre going to make these legal arguments to the trial judge. And the trial judge is probably going to say no, youre wrong. Were going to proceed to trial. They have to figure out some way to get this that ruling that i expect, they have to figure out a way to get it up before the trial because after a trial, it could be too late. Speaking of trials, by the way, jack smith apparently wants the entire American Public to live through all of the things that we went through following the 2020 election because donald trump gets to present evidence in court if he has it that there was Election Fraud going on. So hes giving donald trump the stage to make this case, again, two or three years later. Harris yeah, i think hes also doing it to be able to show that video outside of the capitol over and over and over and over as people go to vote. Very well could be.
