Why is that important in terms of the Electoral College and how does that change things . Its really important, maria, because that would build as safeguard and mechanism so that the peoples voice is not disenfranchised when theres corruption. So much of the fake news pushback has been if the legislators dont certify or they refuse to send the popular vote, the corrupted certification to congress in terms of their slate of delegates, that that somehow is disenfranchising the people. The state legislatures are the only entity that are vested with sending that slate of delegates and choosing delegates to make sure peoples voices are heard and outcomes happens through the Electoral College. When the popular vote is corrupted, President Trump is right that there was widespread fraud and six states that were corrupted and the state will take delegates and and move forward. Maria i want you to go through where we are, jenna. You are challenging six states. If you take out the electoral votes in those six states, youve got President Trump in the lead in terms of the Electoral College. So tell me where we are in terms of all of these states because is the idea here that you are challenging these states and the states will have to take votes away from joe biden and thats how you are looking at a path to victory . For example, where are you in pennsylvania . And then tell me where you have in georgia because i know that there was a back and forth and the deminion machines last night in georgia. Start with pennsylvania. The legal speak is hard for our audience where you are. The first is litigation strategy that we are challenging, the fraud and widespread fraud in court. Thats where we are currently in pennsylvania but we also have a parallel track with the state legislators and thats why the hearings are so important because the state legislators can take back that power at any time. So right now its important for your audience to understand that certifications dont actually mean anything projection, dont actually mean anything. Until the Electoral College votes on december 14th, we dont have a president elect. And so right now we are pursuing the two parallel tracking through litigation and state legislatures to make sure to cure Election Integrity and make sure that every legal vote is counted. In pennsylvania we currently have two cases that are pending primed for the Supreme Court. One is about the late ballots thats been pending for the Supreme Court and now we have a case out of Third Circuit thats ready to go to Supreme Court. Ten days for the ruling to appeal it. Maria jenna, during my interview with the president yesterday he talked about the Supreme Court. This was his first interview since the election and i asked him about the possibility of his cases getting in front of the Supreme Court and what he said was was really suggesting that its difficult to get in front of Supreme Court. Which cases specifically will reach the Supreme Court and when . Well, the problem is its hard to get into the Supreme Court. Ive got the best Supreme Court advocates, lawyers, that want to argue the case if it gets there. But they said its very hard to get a case up there. The big thing is can you get it. We could have a great case. We have the greatest case ever. We have many different forms of fraud. Its not just up with form, its ballot fraud, its we have it all documented and we have tremendous evidence so we will say we want to show you the evidence and then the judge will say they didnt show us the evidence. Thats what we want to do. We want to have hearings to show the evidence. Maria so what about that, jenna . Would you be able to be heard in front of the Supreme Court . I believe we will and President Trump is absolutely right that we have a lot of evidence. We have been denied hearings at the lawercourt level. We havent had an evidentiary hearing to bring forth our witnesses and evidence. Thats why we are trying to do that in front of state legislators. Its difficult to get to Supreme Court because its the last court of relief. You dont go to Supreme Court as original jurisdiction hes in campaign. You can do that in other ways but its difficult to get in Supreme Court in the short timeline we are operating on because you have to go through lowercourt stages. Like the president said, i believe that we will get there and we have multiple lawsuits that are headed there. We have a short time frame, december 14th is when they certify and thats our timeline and we definitely have enough time and enough opportunity and we have the evidence and witnesses and we will show that. Im confident that we will make sure to preserve and protect Election Integrity, all the people saying its over, you cant do it, they arent paying attention what legislators can do. Its going to be really important for america to understand that our constitution provides these safeguards. Maria so you believe that the president still has a path to victory . They are not trusting the election in general. Its important that we get to the bottom of the truth of what happened, that means we have to hold everybody accountable here to try and understand what we really, really what happened and its not just taking people at their word for it, we have to understand underneath what is going on because if we do not trust the institutions we are in a really bad state. Listen, its, he has the right to go to the courts. We have the right to look at everything and we will see where it ends up but it is very much an uphill battle at this point irrespective of the process. I think we got caught flatfooted at the end where the democrats were proactive with their legal approaches and challenging and setting up the rules so that they could win. After Online Shopping surged nearly 22 to a record 9 billion on black friday, according to adobe analytics, your reaction to the numbers and what this means for retail side of investing. Yeah, friday was the second biggest cyber Online Shopping ever. Today should blow through that number. We really believe the cause of the economy is getting better, its not a handful of tech stocks anymore that are making people feel better about the recovery. You just said, moderna is coming out with better numbers now. So the big question is, will there be enough online sales to offset the drop that will happen in person and thats who wins that battle. I was on your show last week, talking with dagen about this. Its the last mile, its the targets, the walmarts, the firms that are big boxes that people can get everything from, that they trust the logistics that things will be there. Few Companies Win big on this Holiday Season and a lot arent going to survive like the jc penneys of the world, this has to be the top nail on top of the last nail. How you do you see things and how are you allocating capital today . Sure. So the vaccine represents obviously removes the biggest risk facing a lot of investors when it comes to those cyclical companies. When this pandemic will be over. And so we have now seen that unleash the biggest month that weve seen since january 1987. Weve got greece, spain, italy, up 30 . Weve got Royal Caribbean cruise lines up 30 . Amazon even up 3 . So where were shifting now is into value, not necessarily low valuation stocks because we do want Balance Sheet quality. We want pricing power. But we do want those cyclical names that will benefit now as our economy gets back on track. Maria all right. So where do you consider value right now then, jack . Sure. So that would be in energy. That would be in industrials, basic materials, even some parts of healthcare, my concern still is the banks because the banks really bridge the divide between wall street and main street and main street is still having much a huge difficulty without any kind of fiscal stimulus program. We could see Small Business bankruptcies and individual loan problems. So thats an area that were Still Holding back on. But i do think that the consumer discretionary, these cruise lines are just going crazy right now. Maria yeah. I mean, actually its incredible, art, when you look at how much money has moved into stocks this year, even in the face of this pandemic. Look at the money going into etfs. Investors put 16. 3 billion even into riskier ones like leverage and inverse Exchange Traded products through the first 10 months of the year. On pace to top 2008s record haul of 16. 7 billion, according to the journal. Your thoughts on whats leading investors right now . Well, i can tell you this. Three things are leading investors. First and foremost, there is no other alternative. So Interest Rates still being low, to get any type of gain whatsoever youve been forced out on the risk scale which is stocks. The good news is, theyve done very well. Where you want to be careful though is using leverage. Thats always been a danger. The last time we saw this must attention being paid to inversed and levered etfs was 2008. That didnt end well for anyone. When you look at levered etf fs, knowing that our of firm wont let us sell them, i would tell investors to be careful. Its not for the faint of heart. Its for a short duration and professional traders, not for you and i to dabble with. Maria youre talking about leveraged etfs. What about pretty much plain vanilla etfs, art . Plain, vanilla etfs are great. Its democ allowed you to expren opinion in a sector easily. There are literally hundreds of valuable etfs that can set you up, such as lets say you want to have a basket of stocks that represents on one end technology, on the other of end, cyclical. He attacked our police officers, calling them gangsters, thugs, bullies and a threat to our children. He would defund the police. Thank you for being here. Good morning, maria, how are you . Maria i want to ask you about whats at stake in a moment. But first, congressman, tell me what is going on in terms of georgia and the situation around fraud. President trump continues to say that there was multiple issues of fraud, whether its the dominion systems which are used in georgia, or dead people voting or the fact that hundreds of thousands of people could not even watch the observers, the hundreds of thousands of ballots were put implemented without observers, gop watchers. So what is your take on georgia . The take on georgia is we found a lot of problems and i think thats one of the things that weve been fighting for is to make sure when we had the hand recount, if we had not asked for the hand recount woule would have found a bunch of voters that had not got counted. We found issues with observers and weakening the signature verifications that was done on a Consent Order down here that makes it harder to verify the signatures of the applicants. We saw a lot of increase in absentee ballots down here. Were finishing up a mandatory a statutory recount that the president s legal team asked for and is finishing up in the next day or so and well continue from there. Theres a couple lawsuits down here that are winding their way through the court. I hope and wish them success in that because we are exposing things down here that need to be fixed before the january 5th election. At the same time, as senator loeffler said, the january 5th election is on top of us and its a very important election not just for the state of georgia but for the country. Maria so tell us whats at stake, congressman. We heard a lot about ending the filibuster, packing the Supreme Court. Do you think these issues are on the ballot this election . They are on the ballot. Its been said. In fact, you go back down here to when president obama came for john lewis funeral last year when he said, in the funeral speech, he talked about ending the filibuster. Theyve been thinking about what they want to do. They defied what President Trump has done for the past four years, building the economy, fixing the military, making our world standing in trade so much stronger many this is what President Trump did. I think that needs to be emphasized. They dont like it. So theyre going to use every procedural trick in the book. More important, what you and i have talked about, if you put dick durbin in charge of the committees, youll never hear the results of the investigations that need to be done right now going on by senator johnson and senator graham into the previous election issues, over the russian collusion, with all the other of things we had going on. Those will all stop. We need to make sure were not looking at it from a policy standpoint of just domestic policy but also the investigations to get at the heart of what happened with our doj under comey, mccabe, strzok, brennan, clapper and all the rest. Maria were going to talk with carter page in a little bit. He dropped a lawsuit this weekend, friday, and hes suing comey as well as mccabe, peter strzok, for wir wiretapping himr no reason, an innocent citizen, no charges were lobbed against him. The battle for the white house is continuing. My exclusive interview you with President Trump yesterday on sunday morning futures was the first since the november election. We asked about the possibility of having his cases heard in front of the Supreme Court. Listen to this. Which cases specifically will reach the Supreme Court and when . Well, the problem is, its hard to get into the Supreme Court. Ive got the best Supreme Court advocates, lawyers, that want to argue the case if it gets there. But they said its very hard to get a case up there. The big thing is can you get it. We could have a great case. We do have a great case. We have the greatest case ever. We have many different forms of fraud. Its not just one form. Its ballot fraud. Its we have it all documented. And we have tremendous evidence. So well say we want to show you the evidence and then the judge will say they didnt show us the evidence. Thats what we want to do. We want to have hearings to show the evidence. Maria earlier, President Trumps attorney, jenna ellis, told me there are multiple paths to victory for the president. Congressman, whats your take on this . I think the case, especially the pennsylvania case, hopefully the Supreme Court will order it back to be heard and then the president can make his case. Big tech and the media have been censoring you and getting more aggressive at it. The president of the United States, and others, being censored literally during a constitutional crisis. They will only take if theres something that was slightly off, like you or i mispronounce a word or you or i that will be the story. It is and yet they wont talk about hunter biden. Never talk about hunter biden. Stole millions and millions of dollars and if you do talk about him they take you off their platforms. No, its massively corrupt. Maria meanwhile, i posted a promo on instagram and basically my friend, a girlfriend of mine, tried to forward this promo. All it was was a promo of me and the president , just a promo on instagram, and my friend tried to forward it and this is what she got. It blacked out the screen and it said you want to look at the Election Results and she was not able to forward a promo on instagram, Brian Brenberg. On instagram. I had not seen this kind of censorship on instagram, brian, but thats where that happened and it was just a promo. It wasnt even like, you know, oh, President Trump said this or that. It was literally a promotion, a promo of the president and myself saying that its going to be on at 10 00 a. M. Sunday and instagram would not allow her to forward it. These are the kinds of things that bring section 230 up, this is the section of the Communications Decency act that protects these companies and were expecting that to be repealed at some point. Whats your take . Brian well, the problem is these companies are acting like publishers. Theyre making decisions about what they want to censor. I think a lot of people see them doing it in a partisan way and so if theyre doing that, if theyre acting like a publisher, then they do not deserve section 23230230 protection. Thats for platforms that dont make censorship decisions. I agree with Justice Clarence thomas. I think this law has been applied way too broadly. At minimum, i think congress should tighten the language on it. If instagram is doing it thats news to me. If theyre doing that, theres no way that they deserve that kind of protection because theyre acting like publishers, which do not qualify tore the immunity that 230 provides. Maria facebook obviously owns instagram, lee. And the protection of this section 230 was given to these companies when they first came onboard and they first were created because they were telling everyone that they were bulletin boards, that everybody could just put their opinions up on the bulletin boards. But clearly, social media has taken a side. As you heard the president talk about hunter biden during the election, twitter refused to hear anything about hunter biden and the deals that he had done overseas, while his father was sitting Vice President. In fact, they blocked out the New York Posts twitter handle because the New York Post broke the story. Lee i mean, theres a reason why only one in 10 Americans Trust the media in this moment. It does feel like its completely biased. It does feel that we are being censored. It does feel to many people that you only get one side of the story and that one side of the story is increasingly onesided. Youre not hearing both sides. And i think facebook and instagram originally, and initially, had made some huge effort to not become arrest arbf information and Mark Zuckerberg took a lot of heat for that. Twitter behaved very different in that regard and they made decisions that have said theyre going to invest themselves in the content. So that does change the platform. It does change the Value Exchange that we feel with those companies. It used to feel it was your own way of publishing your information and sharing information that you felt was important, whether that was pictures of your family or your opinions on politics. And thats increasingly feeling like thats not allowed to be shared. You know, over the summer i myself had my experience where my twitter handle was shut down right in the middle of both the conventions and very, very close to the election and there was no explanation for it. And i know many people who had similar experiences. You cant help but wonder why. Maria its so wrong. Yeah. So thats the thing. These companies have incongress ill pow incredible power and dominance. Well see what happens with section 230. Thanks very much for joining us. And thank you for all of your work over the last year to mobilize the pharmaceutical industry. Give us the status check, sir. Where are we in terms of a vaccine right now and the covid threat . So we have made really significant progress. As you know, we Just Announced today moderna is the Second Company to be filing for an emergency use authorization approval of their mention rna vaccine messenger rna vaccine, one week after pfizer filed for the same kind of authorization. Both vaccines are 94, 95 effective, 100 effective against severe disease. We have two more vaccines in phase three trials, one for johnson johnson, whichs is a one shot vaccine, has already recruited about 25,000 subjects in the study. That study is likely to be reading of out somewhere early in january. Astrazeneca is the second vaccine thats in phase three trial. We have about 15,000 subjects recruited here in a phase three trial in the u. S. And you heard last week some news about efficacy of that vaccine in trials conducted in the u. K. And brazil and then theres two more vaccines that are in phase two trials and preparing to enter phase three in the next few weeks to come, thats a vaccine from novavax, a Biotech Company in the u. S. And Sanofi Glaxosmithkline collaboration. So all in all, six vaccines all in the clinic, two shortly to be available, two more to be available probably late january, february and then the last two to be available probably somewhere in april, may. Maria what was critical in terms of mobilizing this industry . I mean, look, you ho how imports it to mobilize the pharmaceutical industry . President trump told us back in march or april when we were really in the depths of the beginning of this that we would have a vaccine by yearend and his critics mocked him. In fact, here we are, talking about all of this success in terms of the vaccine, thanks to him and you and your team. What was it that enabled us to get a vaccine on the market so quickly . Well, its really first a vision, visionary approach to putting together the academic science, the industry, large and small, biotech and big pharma, the army, and the u. S. Government. And i think this coalition together has been integrated in their operation warp speed, hugely aligned all resources put together. The industry played its role as an ecosystem to provide the technology, to provide the facilities for manufacturing, to drive Clinical Trials where of course we have been extremely helpful too, and here we are, frankly great alignment, great focus, great capabilities. Its also a demonstration that the pharmaceutical industry and the ecosystem of science, biotech, academia and big pharma is able to save the world when we need it and its a very important thing that we continue to drive it. So great frankly, great job by all players. Maria absolutely. And really interesting to see the arnie there as army in there as a critical component as well. Where are we now . Are the coming months going to be grimed . We have confirmed u. S. Cases of the coronavirus hitting another grim record over the weekend, passing 4 million in november on saturday. Doubling the record set in october, millions of americans traveled this Holiday Season. Are you concerned that we are going to see a major spike in the number of covid19 cases and what does that mean in terms of the Vaccines Available now . Or the treatment . I am concerned. Im very concerned. Clearly, the spike and the surge is happening and as has been said, were probably going to experience another surge on top of the current surge. Unfortunately, there will be a lot of disease, a lot of deaths. There are treatments that have been approved, two monoclonal antibodies have been approved in the past month and are being made available. I think the size of the surge is such that we are not able to produce as quickly as much treatment as needed. The vaccines i hope will be approved next week and the week after and we are standing ready to immediately distribute them across all the jurisdictions and the states to make them available on the basis of a priority that the centers for Disease Control and its Advisory Committee will at least advise who should be vaccinated first. However, id like to say while weve done tremendous work to make these Vaccines Available, we only have enough vaccines to immuneize 20 Million People in the month of december so its going to take a while before we have enough vaccines for everybody. So resilience and patience are very important. Maria yeah. Its a reminder that we still have to be vigilant, right . When do we get back to normal, our lives back to normal once we know that the distribution of this vaccine is complete . What would your what does your gut tell you . The cia, the fbi, and other intelligence agencies, not just over the last several years, but going back decades. Ive had a longstanding relationship. And been a supporter of our National Security infrastructure, if you will, including the intelligence agencies.
