found at gaza's largest hospital. and what is next for skonk m congressman george santos after an ethics report accuses him of using donor money on his rent and skin care routine 3. and the show will go on, the drag show, that is. good morning to our viewers in the united states and around the world. i'm kasie hunt. it is friday. we made it, november 17th. it is 5:00 a.m. in the east. it is noon in gaza where the israeli military says that they found a hamas tunnel shaft inside the al-shifa hospital complex. you are looking at video shot and handed out by the israel defense forces. three sources tell cnn that the u.s. has intercepted conversations that indicate hamas has been using the hospital as a command center. cnn cannot verify idf claims of finding an operational tunnel shaft. hamas calls the claims, quote, baseless lies. meanwhile the idf says that it has found the bodies of two israeli hostages near the hospital. a 65-year-old and also a 19-year-old. the idf did not explain how or when the women were killed or if their bodies were found together. a few days ago a hamas video claimed they were killed in an israeli airstrike. scott mclean is joining us live with this. since we last spoke, let's go to israel's claims about the hamas tunnel, united nations human rights chief is calling on israel to grant their team access to gaza to investigate this. is that something that is likely to happen and would it settle any of this back and forth in the information war? >> reporter: it might. whether either side would ultimately accept the findings of that type of an investigation, that is another discussion. the israeli relationship with the united nations is perhaps strained at best. any kind of investigation also would not happen very quickly. u.n. human rights chief says it won't go on while bombs still on the ground. and he has asked for access and he has guarantees from both sides but still wanting for a response. on top of that, israelis also say that it could take days maybe even weeks for them to carry out their full operation on the site of the al-shifa hospital. they are under immense pressure to prove the allegations that they have made that there is this complicated network of tunnels underneath al-shifa hospital. so that process won't be quick either. he says there is too competing narratives here. international law is very clear that you cannot use a hospital for military purposes. you also cannot go into a hospital unless you have clear evidence. and it seems likes israeli and palestinian narratives don't really line up on very much, even humanitarian situation in the hospital is very different. you have the medical directory of the hospital giving an interview on al jazeera arabic where he said that there are children who are starving because they don't have enough water to make milk or baby formula. on the other hand the idf saying that they are providing food and water and the necessities for all of the people who are there on site. and they are also providing corridors for people to leave the hospital site and get to safer spots somewhere else. >> all right. scott mclean, thank you very much for that report. to more, let's bring in the senior columnist and editor at the jerusalem post and also the paper former's editor-in-chief. and it is always great to have you. we just heard from scott's reporting about the claims that the idf found an operational tunnel shaft inside shifa hospital complex. and we have not been able to independently verify this claim, but it is clear that it is very important to israel to illustrate what is actually going on to show the world more evidence. what do you see in these pictures and do you feel like that they are convincing people that their side of the story is the correct one? >> well, kasie, israel issued early on the 3d video that shows that extensive tunnel network. have we found that yet? no. but i think that what we've seen, ak 47s, piles of grenades next to mris and intensive care units, trucks parked in the hospital compound with enough weaponry and machine guns and bullets and magazines and iced roadside bombs to village and n tunnel shaft all together shows that this is not just another hospital. we've all been to hospitals. this is not the hospital for special surgery in manhattan. this is something else. and also a hamas compound. i think that we have to have patience and wait and see exactly what is found. this is a massive compound. and it takes time if you want to do it right. >> and so i read with interest your column about idf reservists and how they are likely to really oppose benjamin netanyahu. there is also increasing pressure from the families of the hostages on the israeli government. can you sort of take us inside this? what are the families of the hostages asking for and how does it relate to netanyahu's precarious political position? >> as we're speaking the families of the hostages are blocking the main artery in this country, highway 1, that connects jerusalem where i am with tel aviv. my daughter who is on her way back home from for the weekend got stuck in traffic there about two hours because the buses weren't moving. they are upset and they want to see the prime minister make a deal that will bring back their loved ones. that is taking time. tlp there were reports that maybe 100 would be released, then 80, and now down to 50 in exchange for a pause. but so far no real progress and they point their firngngers at netanyahu. and when we look at the leaders, only one who has yet to officially take responsibility who keeps saying i'll answer those questions when the war is over, that is netanyahu. everyone else, chief staff of the military, head of the security services, head of the intelligence, defense minister, have all said we carry personal responsibility, we should be held accountable. he won't do that. and i think that that hurts and erodes public trust because for the public to believe in its leadership in a time of war like now, they have to understand that the leadership is not doing this for self interests, it is doing it for national interests. and sadly there is a bit of suspicion when it comes to the prime minister still. >> indeed. leaflets were dropped yesterday in gaza warning that the idf might soon go in there after securing much of northern gaza. what is the sense on the ground in israel of why that is happening, the wisdom of that approach, and the kind of long term plan netanyahu has been out there saying that we'll basically occupy gaza indefinitely and u.s. and others are saying that is not tenable. >> yeah, long term plan is difficult especially when you are in the middle of a conflict. easy to go into a are with a, but much more difficult to know how you are getting out of that war. that takes time and planning. maybe the fal aupalestinian aut would need to come to an end for israel to allow them to redeploy in gaza and even the palestinians in gaza to want them. but when it comes to the south of gaza, israel has been operating only in northern gaza. it has pretty much taken control of that area. shifa complex is the last really area. and in the south you have a lot of complicated realities. number one, still three hamas brigades there, thousands of fighters, likely the top hamas leadership is somewhere in some tunnel network in the south. probably the hostages are likely in the south. and you also have 2 million people almost in the south. how do you operate in the south while minimizing civilian casualties. this is going to be the next big challenge for the idf. >> very tough. all right. thanks very much for getting us started today. mounting legal trouble for new york republican congressman george santos. the house ethics committee referring its findings to the justice department after a months' long investigation found substantial evidence that santos violated federal law. the committee's scathing 56 page report claims santos repeatedly used donor money to fund his lavish lifestyle. what did he spend it on? he's already announced a press conference for when he comes back and refusing to resign on his own. >> yeah, good morning, caykasie. we've seen george santos be defiant throughout the time in congress. and i think he was doing his own media more and more. he has been very active on social media. but also doing sitdowns with big media networks and telling his side of the story. so he has been trying to get his side out there, so it is really no surprise that he announced a press conference to defend himself as he has done. so expect nothing less than him being very combative and defensive about the report. and he has already done that so far on his online presence. >> and let's talk about the possibility of an expulsion. the reality is expulsions are incredibly rare and they almost always involve an actual conviction, right? and he has not been convicted at this point. the reason we're here though, normally these things can be dealt with by leaders who sit down and have a tough conversation and you will see a resignation, et cetera. do you think there is an appetite to expel him before his case goes forward? what is the sense around this especially among house republicans? >> absolutely, we saw a number of house republicans who initially voted no to expel santos in the times it has been attempted to bring that to the floor earlier flip their vote and say that they waited for this ethics report to come out and now they are ready and prepared to expel him based on its findings. so i think a lot of lawmakers were already uncomfortable with him being in congress, but now that the report has corroborated their concerns, they are ready to make that move on him. so i think that we saw a dozen or so, perhaps more lawmakers say that, yeah, they are ready to expel him. and i spoke with one congressman don bacon of nebraska who expects the or course to come very quickly after the thanksgiving break. >> and let's talk about his district. this is asis a pretty swingy dit and his fellow new yorkers were mounting the most aggressive push to get him out. what does it mean for party control of his district? >> reporter: let's remember the accusation that the israelis have made is not that there are tunnels in the vicinity of the hospital. the accusation is that there is a sophisticated multi-level underground command and control center underneath the al-shifa hospital. what they have shown so far, what they have claimed to have shown so far, is videos showing that there are weapons inside of the hospital, another released yesterday shows that there is what appears to be a tunnel shaft about 30 meters away from the main building of the hospital. cnn by the way is not in a position to be able to verify what these videos purport to actually show. and while the u.s. says that it is confident in its intelligence that there is in fact hamas controlled headquarters under the hospital, the publicly available evidence thus far does not support that claim. it is possible that it is there and israelis say that look, it could be days, it could be weeks before we actually are able to fully prove the accusations that they have made. the israelis say that they have already justified -- or the evidence that they found has already justified their decision to go in, but there is plenty of critics from the international community who would disagree with that. and that is why israel is under so much pressure internationally to actually prove these allegations. especially in this region, in the middle east. you have the turkish president erdogan saying just recently that israel in his mind is a terrorist state. you have the jordanian foreign minister saying that this conflict has set the region on fire in his words. he also described the backward progress -- or the progress that has been made over the last few years in strengthening ties with middle eastern countries and israel, and now they have just simply gone up in smoke. he said that at least in his country there is no -- people just don't see value in actually doing business or trying to strengthen ties with israel right now. >> all right. scott mclean, thanks very much for that report. appreciate it. up next, special counsel david weiss issuing new subpoenas in the hunter biden tax probe. who is the latest on his list. and plus donald trump leads in the granite state, new hampshire. and there is a candidate in spot number two. the latest poll numbers up next. you want to be able to provide your child with the tools or resources they need. with reliable internet at home, through the internet essentials program, the world opened up. fellas, fellas. that's how my son was able to find the hidden genius project. we wanted to give y'all the necessary skills to compete with the future. kevin's now part of this next generation of young people who feel they can thrive. ♪ ♪ now to a cnn exclusive. the special counsel overseeing the federal criminal investigation into hunter biden is using a california grand jury to try to obtain more documents and issuing subpoenas to several people including james biden, the president's brother, who was once a business associate of hunter's. the probe is focused on hunter biden's alleged failure to pay taxes but his legal team says he's fully paid his debts. joining me now is a criminal defense attorney and former federal katie, always great to see you. use of a grand jury indicates that the special counsel might be preparing new charges against hunter biden. what do you make of this latest twist? >> well, the news that there is this grand jury in california indicates that there is certainly a possibility hunter biden will be charged in that district. essentially what happened is that the charges that were at issue in the deal were on the table, but also potentially other charges. so we don't really know the extent of the exposure that hunter biden has at this point. the other thing that we need to keep in mind is that he still has the possibility of entering into some sort of plea deal. so we don't know for sure what the outcome will be, but as of right now, the investigation remains open and charges look like they could be coming in another district. >> so new york appeals court judge also has temporarily lifted a gag order in donald trump's civil fraud trial after an emergency hearing on thursday. can you help us understand why and how this happened? >> well, the gag order was lifted by an appellate court judge in new york essentially based upon significant constitutional considerations like first amendment rights. when you have defendants in trial, civil or criminal trials, the extent to which a judge can control their speech has to be really strongly balanced against their constitutional rights of free speech on their own. and here the appellate court judge was concerned that the gag order prevents trump from really as a candidate but also just as a citizen being unable to express his first amendment rights here. and that is particularly important when he is the leading republican candidate for the presidency. and in conjunction with the fact that there is no cameras in the courtroom, trump needs to be able to characterize, at least according to the appellate court judge, his perceptions of the proceedings. this is not a final order. the government, the a.g., has until december 8 to submit a response to that. and then there will be a final decision from the court in terms of whether they will reimposes gag order, but at this point the appellate court there was significant concern about its enforcement that they temporarily lifted its enforcement at this point. >> so this is slightly a political question, so forgive me if you are not 100% comfortable with it, but i think -- i guess i can turn it into a legal question by asking, hunter biden is taking on some of his challenges in a much more aggressive way lately trying to subpoena donald trump among other things. it is almost like he is taking a page out of donald trump's playbook and how trump is really, really aggressive with the courts. do you they should and how do strategies typically like that work out for people? >> i think anybody that is in a position to defend themselves against criminal charges has to make very specific strategic decisions. and certainly different cases call for different decisions in that respect. you know, it really depends on each individual case. i know that is a very legal answer, a lawyer answer to give, but it really is the case that you have to make those decisions about where strategically you see things going. especially when you have potential plea deals that could be on the table, you really want to put the pressure on the government to show them that this is not going to be an easy kill, that there won't be some sort of guaranteed conviction of some sort to put yourself in a better negotiating position. so certainly i don't think that it is a bad idea and i think that it can be very favorable for a defendant. >> very interesting. katie, thank you very much for being up early with us. happy friday. and new cnn poll, same leader, donald trump continues to dominate the gop rivals in new hampshire. trump is polling at 42%. but look at this, he is trailed by a new number one runner up, nikki haley at 20%. the former u.n. ambassador/south carolina governor has surpassed ron desantis in that race for second place. so how real is this? let's bring in cnn national political reporter daniel strauss. always great to have you. look, the time for this for haley if you are haley couldn't be better. we're two months shy of the caucuses in iowa. nikki haley is seeing new gains in all these polls. and we're also seeing some consolidation of donors too especially after tim scott dropped out of the race and some of the big money people like spencers wick have gotten behind her. honestly, one of the more interesting things is that chris christie is there right behind her running in new hampshire. what do you make of these numbers? >> it depends on the candidate here. for christie, remember that the last time he ran for president, there was a strong focus of that campaign on new hampshire. but he in the end fell woefully behind, not just donald trump, not just ted cruz, but also john kasich. but let's move over to ninikki haley. haley has taken a slow and steady approach to this race. she has not come in with a huge amount of fanfare compared to her rivals. she did not spend a huge amount of money. she did not come with the biggest war chest. and that has been to her benefit. she's run a lean and mean operation and benefitted the most probably from all of the debate performances where she's shown a fighting spirit. and this is what the result is. republican voters want to see some kind of candidates who have that fighting spirit in them. and i think that that is what we're seeing in this polling. she is focused on new hampshire too, a state where there is a strong independent streak and strong curiosity for alternatives to frontrunners. and haley is fitting that bill right now. >> makes sense. daniel, the one thing when i look at these numbers is, you know, iowa, trump is a little more dominant in iowa. new hampshire, there is clear -- clear that there is -- trump is below 50, he is at 42%. so much lower than he is in most national surveys. and christie, if he were to get out, you know, 14%, right, that is a significant chunk of the vote. likely a cchunk that will never vote for trump and will go to a haley or desantis. if he were to drop out, there is potential consolidation that could allow haley to break out and beat donald trump. but i asked him directly, is there any world in which you drop out before new hampshire and he told me absolute sli not, no way that he does that. does that just ensure that we end up with trump? >> you have to be very -- you have to pay close attention to the kind of campaign that christie is running and the voters he is attracting. from the beginning of this cycle, christie has run notably and outspoken race as an anti trumper, someone willing to take trump head-on. so the republican support he has in new hampshire is going to be highly skeptical of trump or any trumpi ian candidate. so if he were to drop out, it would likely go to someone like haley. i'm still skeptical at the end of the day that any consolidation of support is going to be enough to like dramatically surpass trump simply because trump has been this dominating force in almost every poll within this republican party for years now. and even if you consolidate a lot of those numbers, it still leaves trump with some kind of lead. >> and i will just say anything can happen in new hampshire. >> sure. >> you never know. it is like -- ask bill clinton. everyone thinks he won he actually came in second. but before i let you go -- i won't joke about your age. sorry. but look, before i let you go, one of the reasons that i love having you is because you are a fellow michigan 2357b and we h fan and we have a big rivalry game coming up next saturday, always the saturday after the thanksgiving. there is a competition going on between the two student nups p news parps. >> despite the fact that phil mattingly is a fan of ohio state university, that -- >> really is a knock against him. i know. >> and he himself has given a shout out to his school's alma mater and the college news paper. so i want to give a shout out to the michigan daily where i worked as a student in college and has a robust alumni network. and i want to say that the daily has helped train with hands-on experience some of the best journalists in the country. alumni include daniel strauss, jonathan chase, and i could go on and on. >> yeah, some people. >> and look, i would not be here without michigan and michigan's alumni network and the resources that the school offers to aspiring journalists. it is a great school and a great program. and it is a great student newspaper. and we've seen student journalists break big stories that have national impaction including stamford. right now michigan strangely despite the fact that michigan football usually has beaten ohio state in the past few years is behind in this fundraising effort. so if you are a michigan fan, please donate. this is for a good cause. and go blue. >> all right, go blue. daniel strauss, thanks very much. fox sports host under fire after address midding that she used fake quotes when she was a siside line reporterer, whwhy ss she did d it, ahead.d. the power goes out and we still have wifi to do our homework. and that's a good thing?
