And on conspiracy on them so the tension remains high here in pennsylvania a state that donald trump know he needs if he has any chance of a victory here in the United States but that is looking less and less likely in pennsylvania clearly the President Trumper is king to use that occasion in the course of this election was going to recourse does he have in pennsylvania if he doesnt like the results. So i think there are 2 parts to that question 1st yes it was a strategic misstep and in hindsight im sure republicans will rethink their efforts to besmirch mail and voting processes but there was the larger issue of trying to claim that mail in voting was fraudulent thankfully voter fraud while not completely not existed in the United States is so small that it usually doesnt affect the outcome of elections and for President Trump to without evidence make these claims continually to misinterpret data to you know blow up and hyperbola isolated incidences of voter fraud was something that was definitely damaging and troubling to him and you know and also just in terms of sort of thinking about this in terms of the pandemic the idea of arguing to take an option away from people where they could safely vote is also something that you know its problematic. Are you therefore surprised given the amount of response of the has been to mail in voting allowing of course for the fact that corona virus is still present in the United States but given the fact that it had been undermined or attempts have been made to undermine the by the us president and yet there were huge swathes of mail in votes that came in. You know im not surprised at all and ironically theres a study thats being done at Stanford University right now that suggests that before the pandemic republicans were more likely to use mail in buildings that keep in mind that historically thought of older voters as being more likely to be republican and this is be the group that would more likely want to take advantage of mail and voting for Health Reasons you know just you know perhaps not being as mobile as younger people are so i think the big lesson in this cycle is figuring out how to expand options for voting that make it convenient and safe for people to vote so that you dont have this mass volume of voters on election day having to stand in line for long hours i think by stretching out the early Voting Period to allow people to vote at a day or time that is convenient for them and having a mail in option maybe election process on election day pretty smooth and i think that there are states that may have been reluctant to adopt some of these measures that will actually embrace them more d in future elections cycles we of course cant lose sight of the fact that a very large number of people have been supporting donald trump what do you make of the Political Landscape if you like of the United States now compared to with the way it was about 4 years ago. So even if donald trump isnt president of the United States there is a will outlast him and so there is you know theyre still a very divided country so what we see republicans gaining in the house of representatives we see that at best the senate is probably going to be evenly divided between democrats and republicans a man if not republicans will reign will retain a slim majority so there is still plenty of opportunity for division and for discord so its really going to be incumbent on our legislative leadership and by the Harris Administration should that happen to come together and actually figure out how to Work Together and how to promote reconciliation otherwise we could continue could be at the same stalemate where we are now its really good to get your thoughts on this undergo less be we appreciate your joining us in algeria thank you very much indeed. Well you know its interesting because their supporters have been really you know in turmoil over the last few days as these counts a very slowly come in and and many thought on Election Night back way back on tuesday that this was over that the election was over and that it was 2016 all over again and theyve been theyve been doing seated but really from the campaigns perspective when they were looking at their data when they were looking at their their own calculations really you know from you know fairly late on Election Night but on Election Night they really saw that they still had there are several past a victory that were that were alive and they felt very confident about still being able to win and since then theyve really sketched out exactly whats happened theyve had calls every day saying exactly what they thought was going to happen where biden would be successful where they thought he wasnt going to be successful but that they thought he would win overall and pretty much everything they predicted has been has come true so far and he is on the cusp of victory its one thing to have the victory is another thing to sit in the white house and actually run a country what is your impression of the way that the Biden Campaign is intending to do just that do you get a sense that there is actually a structure a plan in place. Well you know biden himself admitted that there is very little scope for him to actually get done what hes promised if he didnt take control of the senate as well and the senate still hangs in the balance right democrats had a very rough day down ballot in terms of senate races house races and so its going to be very hard for them to govern on the platform that joe biden ran on to the press of. President trump has promised a quote tremendous amount of litigation contesting the vote counting process in several states lets take a look again at those legal efforts with his campaign has filed suits in georgia michigan pennsylvania and nevada states where hes either lost or faces an extremely close race various suits in those states include allegations of late and invalid votes being tabulated and campaign observers being denied adequate access to the counting trump has failed to score any significant legal victory so far 2 cases in michigan and georgia have been dismissed for lack of evidence none of the complaints provide examples of trumps massive voter fraud claims but hes promised to take his case all the way to the Supreme Court ok lets bring in lawyer amy pope in london she served in the u. S. Department of justice as deputy Homeland Security adviser to president obama and counsel to former u. S. Senate majority leader harry reid its good to have you with us ok these case is going to go to the Supreme Court its highly unlikely to get to the Supreme Court there have to be some material case issues of law or a fact and were really not seeing either its not against the law to vote against donald trump despite what he might allege and so thats why were seeing so many of these cases being thrown out as quickly as they are what is the routes that they that these cases are taking because all were hearing is that the Trump Campaign is putting these cases forward but im not entirely clear who hes presenting these cases to. Hes filing them both in federal court as well as in state courts it looks that some of them are not actually being filed always in the right place there have been some cases where the judges actually questioned why its being heard for example in federal court when there was a state court issue that was disputed but that just demonstrates that these are not carefully crafted legally and evidentiary based lawsuits theyre really nuisance lawsuits that are meant more it appears to gin up Public Opinion than really make credible arguments within the law as we mentioned he is determined that some of these cases are going to go to the Supreme Court but given what you were saying before one would imagine that the Supreme Court of the United States is also very conscious of its standing and its reputation how much of that do you think is going to play into the way that it does decides whether or not to take any of these cases on given that it is essentially staking its reputation on what is a politically motivated legal case. Well we do know that the chief Justice John Roberts takes very seriously the independence of the to sherry hes made comments to that effect in the past hes made clear that he does not see the Supreme Court as an arm of the president it is a coequal branch of government and is meant to be a check on the power of the president i think he takes that so seriously that hell be very very careful in terms of what cases the court would consider and how the court would rule now his vote doesnt carry the day obviously there are 9 justices and there could be other justices that disagree with his position but i suspect that hes going to wield a very heavy hand to make sure that the integrity of the court is well preserved well if the Term Campaign continues to for want of a better phrase throw legal cases at the wall and see which ones stick nevertheless this is going to slow down the whole process of electing the next president whoever it is. How much does this really sort of become great in the the gears if you like of the political process or is this something that local local courts and federal courts can essentially bought away if the evidence isnt there. It all comes down to the quality of the evidence if there really continues to be no evidence or fraud or abuse of the system and the courts will continue to just toss these out that the way as you say and i dont think it will have much Significant Impact the other issue thats at play here is how much difference does it make even if the trumpet ministration were accurate in its claims so when were talking about a handful of votes in a state where the president has lost by tens of thousands of votes then it makes no material difference and the consequences of that lawsuit really dont matter that much so were looking at a couple of things here how many electoral votes would a President Biden if were talking about a biden win here how many does he have whats the impact of any particular lawsuit on the votes that are in question and could it have a material difference that right now we dont know the answer to that because the votes are quite close in places like georgia and arizona but increasingly it looks like they will not have a material difference we have to stay tuned what do you think the likelihood is that there might this might open up to come to suits from either individual states or even from the biden count pain itself. So there could be and and its not to say that the Biting Campaign is not also pursuing litigation particularly around claims of voter intimidation. But again it all comes down to whether or not its material were really looking at how many electoral votes are in play and then were in the Electoral College itself how many individual votes are at play and again if were just talking about a couple 100 votes here or there that doesnt really make a difference now if we do uncover some evidence that thousands of votes are player there theyre real serious questions this all goes out the window but right now that we just havent seen any addict evidence of that kind amy pope thank you very much indeed for joining us and all of his you know im going to take you to some live pictures a press conference happening in georgia lets listen and possibly 5000000 votes cast will have a margin of a few 1000 the focus for our office and for the county Election Officials for now remains on making sure that every legal vote is counted and recorded accurately as we are closing in on a final count we can begin to look toward our next steps. Interest in our election obviously goes far beyond georgias borders the final tally in georgia at this point has huge implications for the entire country the stakes are high and emotions are high on all sides we will not let those debates distract us from. Is and will remain open and transparent to monitors if any member of the public raises legitimate concerns will investigate us we are committed to doing anything everything to maintaining trust in our elections process for every georgian regardless of partisan preference thank you very much. And thats was a press conference so bring a brief briefing being handed out by a member of the Voting Committee on in georgia he was saying that every legal vote in georgia was going to be counted accurately this gentleman that what were seeing now is that these take control of all of the voting process in georgia and lets listen in briefly to what hes been saying hes going to be leaving this down over the last few days already here so our new total that we are aware of right now is 4169. 00 and they are in a handful of counties like over those now. In Cherokee County there are 150 ballots that they did not upload said to rescan uploading those today. There are 75 now in cobb theres 444 in floyd theres approximately 3500 in gwinnett as we went through the reconciliation process of what they had already reported 1st what they had left to me scan. And i think thats it couple of things Lawrence County the 1769 votes we had. Yesterday were basing those on the absentee ballot differences and when they looked and did their reconciliation process on it they discovered that they had accidentally uploaded those into their election day totals to their totals will not change but the vote will change when they make that change today so outside of that we dont have any other numbers that we are aware of but again i want to remind everybody we have ballot curing process is through today for absentee ballots verification process for provisional ballots and we can still get any military or you a cava ballots in by close of Business Today if they were postmarked on tuesday election day so there are still an unknowable amount of ballots that will be available to be counted at some point they are in the hands of the Elections Officials now other than maybe the military knew of cava ones and i can assure you that there are teams of 20 somethings around the state who are republicans and democrats finding those people with those absentee ballots secure and theyre going through that process and county by county and ones in twos and just to preempt a question is going to come up do you see any widespread fraud are we seeing anything that makes us question the outcome of the election were not seeing widespread irregularities were not seeing widespread we are we are investigating any credible accusation with any real evidence behind it let me tell you one thing when you have a narrow margin. Little small things can make a difference so everything had to be investigated to protect the integrity of the vote our office intends to do that and like i said you know wide margin doesnt matter as much narrow margin it does we are literally looking at a margin of less than you know a Large High School so we understand that misstates county officials are aware of that our investigators are aware of that so its an important thing to protect the integrity of this election from all sides without any questions off us on the margin we have. To reach out and were going to know one of the residents who were there but you can remember. With the timeline we have laid out essentially we can look at the timeline again so we should be able to know by the end of number because remember we have a mid december deadline received letters so the one thing that is always going to be an unknowable unknown is lawsuits that in effect what we have to do we are rules a country in a nation of laws so what if a judge tells us to do something a certain way were going to have to do that let the Legal Process work its way out but given the laws we have now in the situation and posture that we are in today today is the last day to cure all those absentee ballots get the military overseas in and then im a verify the provisionals so that gets your outer bound of these then you have the situation where the counties need to certify their election so they take that they give us much paperwork to do the reconciliations they make sure they have everything right and trust me these people are very hard at it again they are all very tired and were going to work with them very diligently to get that in as fast as we can because state certification can come only after we do our risk limiting audit and that is going to be the 1st time the states doing it was part of h. B. 316. 00 secretary rafas burgers election reform law so that happens and then were going to have the states from occasion now the Outward Bound of that is november 20th our hope and intent work with the counties is to move that earlier and at that point whom ever comes in 2nd whether the President Trump or vice President Biden either one of them whoever in 2nd place can request that recount if its within half a percent or do we do a recount after audio or with the most interpretations of the law right now you cannot do it in a recount cannot be requested until the election is certified now now we have no way of knowing right now weve never done a statewide recount with a brand new system so we are hoping to be a week but we have no actually no not at this point for a model for problem. We have a 109 election directors thousands of poll workers election workers hundreds of volunteers on education panels they are all in there as secretary noted this is a public process you can watch everything thats happening they have paperwork their certification is theres reconciliations theres paperwork on top of paperwork in many cases so we know how many ballots there are one of the things we know from the big some from one is that all we knew the basic amount of ballots that were there with the slight moving target of the of the military coming in the absentee ballots being cured and a potential visuals because those are all essentially unknowable at the end the night on tuesday that people asked the question why cant you know exactly how many you have because its impossible because theres the law allows for these things to be done to protect the ballots of those who really want to make sure get the vote so in general and specifically this office has worked very hard through the forms initially 316 which also allow for notifications to be immediately sent out for ballots that are received towards the end of the process that need to be cured people talk about the 3 days to approach of process on this and if thats not the case what it is if you send you about early you can get a monthlong to a process if it comes in that way thats why i would always encourage people to do that as early as they possibly could but our office and the counties have many many safeguards many many gargoyles built up over many years to ensure the integrity of the vote yes maam for. Every heard of world all over the world blue problem that there are holes all. Right. Well im not going to talk about an Ongoing Investigation at this time but harvesting votes for a recount be difficult because you only have the outer edge of what free card shows are there. Yes or. Like you know. Theyre watching what im not going for im not going to get try to get into the president s actual mind set on that because there are there are republicans who are involved there democrats involved a Different Levels of sort of a shared Service Delivery model there are republican election directors there are democratic election directors obviously secretary wrap as far as a republican im a republican i dont make any bones about anybody who knows me and suddenly i love the people of my twitter feed and i linked in its pretty obvious so in general we have people who have hardison beliefs but the job of elections directors in this office is to count every legal vote follow the law and assure that every legal vote is counted and the will and intent of the voters is met yes. We have no way of knowing if it possibly could the one things we will be asking with these 8900 potential military ballots coming in thats how many i said i dont know until you want think theyll be more than 0 will be less than 100. 00. Heres the situation the risk let me on it has to be done before there is a recount anyway so no that should really have an effect on that and to clear up one thing i want to make sure sure every understands the law in georgia is that the candidates must be within a half a percent of each other in order to have a recount so i am hearing speculation potentially about a break of recount in the United States senate race involving a lot of its mr asaf and senator purdue up that margin is so lot of the amount of available is out right now theres no way the 2 of them could probably get to the half 20 me potentially they could but its very unlikely so but probably only for president. This is the way its going to work as i mentioned to you all yesterday the secretary directed that we procure in the original procurement the high speed i c c s which are the high capacity high speed scanners that will be used at the Central Offices for this recount now how were going to do that is going to take a deck of ballots were going to have this hand counted going by what is written on that the human readable portion of that or the readable portion of that well tally those and well get a count write it down we will then run those through the scanners and the automatic and once we ballot date that scanner scanning properly we will then be scanning every single ballot again on the central scanners i guess that would make estimates of time we dont know. Like i said i hope im hoping theres some time when our elections workers will get some sleep because you know its going to be a high stress think again the way the world are upon them and thats the essential outline of how it works theres other details of how you how you handle it thats the basics. We are aware that there is a couple of places weve heard about potentially happening we dont know exactly why yet it could be a simple thing its on the pulp out of searches 1st name last name and date of birth so they could have been looking at the wrong person not realizing it immediately because like i said the whole workers are human. And humans are involved level so there can be errors and those that we are obviously looking into with the vendor to see if theres anything that can be discovered about what might have happened in body else yes sir you again. I do not right now were trying to get that but again were trying to leave the Elections Official officials and directors to their actual counts yes or no. There really. Could be done my bit. Where we want to go lighter now but here is the reality i think that once the battle fuck me here today will probably be done today tonight but remember close of business means theres stuff coming in a close business so we dont know the volume of those we dont know where theyre going to be there somebody could left you know they can be exhausted and have to get the mail you know after that so theres no way of knowing exactly i anticipate we should get closer to final final on saturday people going through what they call their damaged house make sure they get caught and reconcile properly copy and duplicate it properly and scan so it will be probably as we can be and normally it wouldnt matter if the if the difference was a 1000. 00 votes yes or. Election so complicated is that each state has different process these different deadlines different ways of doing things so its been challenging especially in these states where things are really going down to the wire but as we saw there are 3 professional teams in each of the states going through these ballots we have not seen any evidence of fraud or malice and right now its just a matter of being patient while these final votes get counted. Given the image that we saw some george or do you think that that is an image thats receptors across the country or d is it perhaps naive to think that there are parts of some states somewhere where people are attempting to manipulate the votes in some way what we have not heard any evidence that there has been an attempt to steal the election there has been no reports of fraudulent votes even though weve heard this frederick from trump in the last few days this is something that we expected with the president s messaging before the election as go he had cast doubt on the mail and Ballot System from the start hes been saying for months that he saw them as potentially fraudulent so we really just see this as rhetoric and posturing from trump not based on any evidence and this comes from local election observers as well as iowa c. E. Observers at the National Level how much damage do you think this is done to the democratic process in the United States where there have been so many attempts to try to undermine it. Well there certainly had been attempts from trump but again this is something that we came to expect from the president s and its certainly unfortunate its very inflammatory at this time where the u. S. Is already in a very tense situation but i think whats more telling about american democracy is the fact that the unprecedented number of americans came out to vote in the selection showing that they did still believe in the electoral process sees we see americans staying relatively calm over this week of counting participating yes and protests and demonstrations but not devolving into violence and really still showing that they have trust in the courts and in the institutions that they believe will bring this election to a reasonable and do you think that this is something that is just happening because of the personalities involved in this election or do you think this is actually setting a benchmark for political involvement in the United States in the future. Well this is a very different kind of year for the very different kind of candidates and i think weve seen sense 2016 that politics as usual is just a typical with a candidate like trump with that said he has obviously tapped into something that resonates with a lot of americans his populist messaging in particular is something that resonates a lot with americans and that we also see resonating outside of the u. S. And other countries as well so i dont see that populist element going away but the kind of inflammatory rhetoric that we do see from trump is rather specific to him as an individual we really appreciate your expertise in this judy norman thank you very much indeed for joining us tonight is here thank you. Has been giving us overviews of the whole campaigns now we were just hearing the situation in georgia theyre not partly legally the secretary of state in georgia cannot order a recount its got to come from the campaign is there any reaction from Trumps Campaign or not. Not at the moment i mean thats exactly right as far as the secretary of state is concerned you as a republican he can suggest that there may be the need for a recount but partly according to what ive been reading over the last 10 minutes or so under georgia law its up to one of the parties to request at the ricoh even when it is this close now will that automatically happen you would think so yes but if georgia doesnt become significant if pennsylvania becomes the focus for the Trump Campaign georgia may not need to go through a recount. Because of course of joe biden wends pennsylvania and hes certainly ahead there at the moment then georgia becomes less relevant to the Biden Campaign and stopping by a becoming president so theres a lot of ifs and buts here but we know the donald trump has said repeatedly that he would be looking at some sort of legal action if he didnt win the election because he felt that that would suggest that the election was being stolen for him from him therefore he would have no option but to go to court alan do you think that this this recourse to too demanding recounts is something that the tom campaign is going to bring in alongside its litigation that its also launching. Well certainly we know the looking at that in wisconsin but since the county is still going on in wisconsin that the lead the joe biden has actually stretched so there may not be much point in doing that in wisconsin theyve got 13 days to file the. Request to do so even though they said that they would be looking at that immediately so the as far as i understand they still havent done that officially although they say that theyre keen to do it this is part of the Trump Campaign after election game client that they would involve several members of the Legal Community in arguing in courts around the country that there had been issues and certainly since we got this statement in the last hour or so we got an indication of where those legal battles would be for example they believe that in nevada people were voting in the election by mail in ballots that were entitled to do so they believe that there was ballot harvesting in georgia this century democrats were going on a local areas taking names casting the votes for them and then handing them over again all these allegations have not been proven at the moment is just hearsay so that gives you an idea of the subtle battle grounds where the Trump Campaign is going to fight back and tell you that the Biden Campaign hides in putting your tweets just in the last few hours saying that a number of people are trying to steal the election theres a phrase that were going to hear a lot over the next few days and their fundraising on the back of it they say that they want to make sure they get the strongest possible legal team and so theyre asking people for their contributions certainly we know that money has been set aside for both campaigns for doing exactly this it always is they always have paul observers they all have or always lawyers ready to go you remember back in 2000 a swarm of lawyers hit the Florida State house in tallahassee because there was a concern over hanging chads and that dragged on for more than 30 days before the Supreme Court eventually stepped in and said youve got to stop counting votes at this point so this could drag on for some considerable time up until november up until.
