Howard received his Bachelor of Arts Degree from the University of Saskatchewan in Regina. While there he met the love of his life, Sharon Seghers. They married in Tribune, Saskatchewan on May 22, 1971. Howard worked in the banking industry in Calgary for 35 years, until retirement in 2004. His love of golf saw him retire to his Dutch Creek cabin in Fairmont Hot Springs, B.C. Howard disliked the snow, which led to many enjoyable winters in the Arizona sunshine; golfing and making new friends, sightseeing, and trying new restaurants. Howard like to say he never owned long pants, because he wore shorts 12 months of the year! ....

Because the PICK system AUTOMATICALLY chose accounts and passed phone numbers to be stored and dialed from Noble, without human intervention, the Court determined that an ATDS was used.
