Pulliam v. HNL Automotive Inc., a case with significant implications for the amount of money a plaintiff can recover when proceeding against a dealer/seller under the FTC Holder Rule.   
Officially titled the “Trade Regulation Rule Concerning Preservation of Consumers’ Claims and Defenses,” the Holder Rule requires sellers that arrange for or offer credit to finance the purchase of consumer goods or services to include a specified “holder notice” in the credit contract.  The notice must state that any holder of the contract is subject to all claims and defenses the consumer could assert against the seller of the financed goods or services, with the consumer’s recovery limited to the amount paid by the consumer under the contract.   ....

In our February 16, 2021, Client Alert (“Holders Beware”), we noted recent California caselaw expanding consumer plaintiffs’ rights to seek attorneys’ fees and court costs from creditors pursuant to the Federal Trade Commission’s “Holder Rule,” 16 C.F.R. § 433.2.  Since then, the California Supreme Court has agreed to consider the fee and cost issue.  Additionally, the FTC recently issued new guidance rejecting transaction-size exemptions from the Holder Rule.  Both developments may increase creditors’ liability risk associated with financing consumer purchases.
The “Holder Rule” requires creditors that finance the purchase of consumer goods, by taking an assignment of the purchase contract, to include within the contract a clause preserving the right of the debtor-purchaser, in the event the goods are defective, to sue the creditor-assignee (or a subsequent assignee).  The contract also ....

Almost 45 years after the FTC’s Holder Rule and corresponding FTC staff guidance were issued, the FTC

Washington, DC - The staff of the Federal Trade Commission has issued a note correcting previous staff guidelines on the FTC’s Trade Regulation Rule Concerning Preservation of Consumers’ Claims and Defenses commonly known as the Holder Rule.
The Holder Rule protects consumers who enter into credit contracts by preserving their right to assert claims and defenses against any holder of certain loans and credit sales contracts, even if the loans or contracts are assigned to a third party.
The new staff note corrects an erroneous statement in a 1976 pamphlet by FTC staff that the Holder Rule did not apply to transactions larger than $25,000. Those staff guidelines stated that the Rule incorporates the transaction cap that was present in the Truth in Lending Act (TILA). Calif. court approves attorneys fees 8x more than client recovered

LOS ANGELES (Legal Newsline) – A Lemon Law defendant will have to pay almost $170,000 to plaintiffs attorney despite the client only recovering $22,000.
The California Second Appellate District on Jan. 29 approved the windfall for attorneys at Rosner, Barry & Babbit in a lawsuit against HNL Automotive, which is accused of selling a defective “Certified Pre-Owned” 2015 Nissan Altima, and TD Auto Finance.
Though it was advertised as having cruise control and power-adjustable seats, plaintiff Tania Pulliam, who is disabled and relies on those features, said it did not. She sued the company in 2016, two months after buying it.
A jury in 2018 returned a verdict in favor of Pulliam on only one of her four causes of action – violation of the implied warranty of merchantability under the Song-Beverly Consumer Warranty Act. ....
