North Texas School Districts Facing Possible Lawsuits Over Mask Policies

FORT WORTH (CBSDFW.COM) – Parents in at least three North Texas school districts filed court petitions this week connected to mask policies that remain in place for students, even as mandates have been removed from the rest of the state.
The petitions from parents in the Fort Worth, Highland Park and Keller school districts are asking for pre-suit depositions of district staff, in an attempt to discover if mask policies were developed or enforced in a way that violated any laws including the Open Meetings Act. ....

The Texas Supreme Court voided a restraining order against a salon owner who was jailed and fined last year for keeping her store open despite executive actions requiring the business to be closed.
Shelley Luther, owner of Salon À la Mode, spent two days in jail last May after Dallas Judge Eric Moyé ruled that she was to be held in civil and criminal contempt for violating orders that required her salon to be closed due to the coronavirus pandemic.
The Texas Supreme Court intervened last year, letting her out on a personal bond while they reviewed her case. On Friday, the court formally overturned Moyé’s restraining order, which would have required Luther to spend 7 more days in jail and pay a $7,000 fine. ....

There s been an update in the case of Shelley Luther, the Dallas salon owner who was briefly jailed last May for refusing to close her business in compliance with stay-at-home orders. On Friday, the Texas Supreme Court unanimously tossed out a civil and criminal contempt of court action against her, because the temporary restraining order the judge based it on was not clear on what conduct was prohibited, according to Chuck Lindell with Austin American-Statesman.

Texas court tosses salon owner Shelley Luther's contempt finding

The Texas Supreme Court on Friday tossed out a contempt of court judgment against Shelley Luther, the Dallas hair salon owner who rose to national prominence when she was jailed last year for refusing an order to close under pandemic safety rules.
In a unanimous ruling, the court said the contempt finding was improper because it was based on a judge s temporary restraining order that was unclear on what conduct was prohibited.
This is a victory for any Texan concerned about civil liberties, said state Rep. Briscoe Cain, R-Deer Park and one of Luther s lawyers. When the government seeks to restrain your liberty, you should be fully informed of what the consequences are. ....
