COA flags COVID-19 response expenditures of OSG

The Commission on Audit has red flagged transactions made by the Office of Solicitor General in its 2019 coronavirus disease (COVID-19) response.
COA disclosed in its 2020 annual audit report for the OSG that the government’s legal counsel has procured P1.49 million worth of medical supplies during the year. It raised two issues on the COVID-19 transactions.
“The required publication of documents relative to procurement of medical supplies totaling P1,492,988.01 in the Government Procurement Policy Board (GPPB) online portal, website of the procuring entity or at any conspicuous place pursuant to Section 4 of Republic Act No. 11494 or the Bayanihan to Heal as One Act was not complied with,” COA Director Michael Bacani wrote in the report sent to Solicitor General Jose Calida. ....

SC justice applicants weigh in on quo warranto, same-sex marriage

Candidates vying for the Supreme Court (SC) associate justice post expressed their views on legal issues brought to the high tribunal in recent years such as the quo warranto as a remedy to remove a sitting magistrate and same-sex marriage.
During the public interview organized by the Judicial and Bar Council (JBC), Court of Appeals magistrate Ronaldo Roberto Martin said justices of the SC could only be removed by impeachment, not through a quo warranto petition, which challenges the eligibility of a person to occupy a certain post.
In May 2018, Maria Lourdes Sereno was removed from her post as Chief Justice when the SC voted 8-6 to grant the quo warranto petition filed by Solicitor General Jose Calida. ....

The implementation of the Anti-Terrorism Act (ATA) will not result in violations of human rights enshrined in the Constitution, government lawyers told the Supreme Court (SC) on Tuesday afternoon, May 11.
On the seventh session of oral arguments on 37 petitions challenging the constitutionality of ATA, lawyers from the Office of the Solicitor General (OSG) said that the government has adopted measures for an efficient enforcement of the law.
Fears of the petitioners and the public on human rights violations were aired by Associate Justices Henri Jean Paul B. Inting and Amy C. Lazaro Javier during their interpellations of OSG lawyers. ....
