Oklahoma, tribal leaders seek help from Congress on criminal jurisdiction

As eastern Oklahoma’s transformation to Indian reservations took a leap forward last week, some state and tribal leaders renewed their call for Congress to allow them to forge agreements for prosecuting criminal cases.
Oklahoma Attorney General Mike Hunter said recent discussions with members of Oklahoma’s congressional delegation “give me optimism and confidence that they’re going to move as quickly as this situation requires” to introduce legislation.
“The Cherokee and Chickasaw (leaders) are asking and supporting authority from Congress to compact with the state to share criminal jurisdiction,” Hunter said in an interview. “I’m hopeful that happens in the next few months and we look forward to working with the federal government and the tribes.” ....

Tribal, Federal Prosecutors Ready To Handle Influx Of Criminal Cases
Tribal and federal prosecutors said they are ready to handle the thousands of criminal cases that will be coming their way, after a decision from the Oklahoma Court of Appeals that declared the Cherokee and Chickasaw nations are sovereign.
They now join the Muscogee (Creek) Nation in last summer’s Supreme Court decision on tribal jurisdiction.
Tulsa s acting U.S. Attorney Clinton Johnson said this week s decision by the appeals court will send thousands of cases to his office, but he said they re prepared.
All that means is that my office is going to get a lot larger and we re going to be much more cases we normally do not handle right now, Johnson said. So, what we ve been doing for the last five to six months in anticipation, is working hand-in-hand with a Cherokee Nation with the local DAs and with the main justice to prepare for this new influx of cases. ....

McGirt ruling bringing some criminal cases back to 'square one'


Prosecutors are anticipating the McGirt ruling is close to applying to the Cherokee Nation soon.
The Supreme Court ruled the Muscogee (Creek) Nation had never relinquished its reservation, and that Jimcy McGirt, a convicted child molester, should have been tried in federal rather than state court. Since then, other tribes have read the ruling as applicable to their jurisdictions.
District Attorney Jack Thorp said the McGirt ruling is bringing many criminal cases back to square one. Cases wherein a Native American was convicted of one of the major crimes – murder, manslaughter, rape, assault with intent to kill, arson, burglary, and larceny – could be retried in federal court. ....

Cacy opts to stay in city council race

Ward 2 Tahlequah City Council candidate Gary Cacy has announced that he will remain in the race, after all.
On Dec. 16, Cacy said he would be withdrawing from the February election after word began circulating about some trouble he d had.
“My character and my reputation were immediately being questioned from day one of the campaign, and I didn’t want to go through that,” said Cacy. “I didn’t think I deserved it, and if I wasn t going to be appreciated for my willingness to come forward to serve the city, I didn’t want to proceed.”
City Clerk DeAnna Hammons spoke with the election board and was told Cacy’s name was still going be on the ballot for the nonpartisan election. ....
