Ireland will nominate a person to the position of Advocate General of the Court of Justice of the European Union to serve, on the resignation of Advocate General Hogan, for the remainder of the term of six years which commenced in October 2018.
The Government has agreed to establish an expert panel to assist in identifying candidates who are qualified and suitable for the post. The panel will recommend suitable candidates for nomination by the Government in accordance with Article 253 of the Treaty on the Functioning of the EU (TFEU). Mr Justice Nial Fennelly, a former judge of the Supreme Court and a former Advocate General of the Court of Justice, will chair the expert panel which shall also comprise of Ms. Marie Cross, formerly of the Department of Foreign Affairs, and A ....

ECJ upholds legality of Malta judicial appointment process - JURIST - News

Advocate General Gerard Hogan of the European Court of Justice (ECJ) concluded in an opinion delivered Thursday that Malta’s judicial appointment process does not contravene EU law.
The preliminary ruling was part of ongoing proceedings before the Maltese courts, brought by pro-democracy and human rights group Repubblika. The group alleged that Malta’s current judicial appointment process, governed by Article 96 of its constitution, grants the prime minister “arbitrary discretion” and threatens judicial independence. The case was referred to the ECJ on the question of whether this process is consistent with Article 19(1) of the Treaty on European Union (TEU), read in light of Article 47 of the EU Charter of Fundamental Rights. ....
