Lakeland vs. North American Towers: city wins case over proposed cell tower


North American Towers sued the city, claiming the request to rezone 10.9 acres from multi-family to limited development, which would have paved the way to construct a 150-foot monopole tower, was improper. In its filing, the plaintiff alleged that the denial was not supported by competent, substantial evidence.
The citizen testimony, in its entirety, lacks sufficient factual content to support a finding that the Proposed Tower will have an undue adverse effect upon any nearby property and cannot support a denial, the plaintiff said, according to filed court documents. What is clear from the record is that the Commission denied the rezoning and conditional use application, based on the generalized statements of objections from a handful of residents. However sincere the objections of the neighbors may have been, the Board must base its decision on substantial evidence, not public sentiment. ....

Car line paralyzes things at student dismissal
Lakeland residents William and Kelly Roll have a child who attends Lakeland Christian School. They regularly carpool, dropping off and picking up three students daily. 
Kelly Roll said it can be difficult to safely navigate student dismissal. She said it doesn t feel safe heading west on Forest Park Street to Harden Boulevard, where after drivers make a right turn they must quickly cross two lanes of traffic and make a U-turn in order to travel south. 
The other option is to turn left onto Forest Park Street, heading toward the local neighborhood, only to get entangled in the pick-up queue. It can take up 45 minutes to break free, according to the couple, who use South Webster Avenue as an out.  ....
