Today, Supreme Court Justice Westmin James handed down a decision in the case brought against the Belize Police Department by Greg Nunez and myself. Legal recourse was sought after we felt that our rights had been violated because without any probable cause or intelligence to suggest that we were involved in any criminal activity, police officers took our picture during a stop and search on August fourth of 2020 that yielded nothing. The judge ruled that it is unconstitutional.

“They brought their claims on the grounds that this practice actually constitutes a violation of their right to protection against arbitrary searches, their right to privacy through the taking of the photographs as well as the right to human dignity. And today we got the decision from Justice Westmin James confirming that indeed the practice does constitute the violation of their rights under the constitution.” ....

But does the ruling now set precedence for stop and search? Attorney Leslie Mendez, who represented the complainants in the case, says that the decision should provide critical guidance to the police department in conducting legal searches.  While she says that by law the police are allowed to conduct stop and searches, the violation is when a person’s picture is taken when he has done nothing wrong.

WPCs Wade and Berry Found Guilty of Violating Police Regulations
Police constables Shantel Berry and Alleeya Wade have been fined by the police department after being found guilty earlier today by a disciplinary tribunal for appearing on our Open Your Eyes talk show.  The pair spoke candidly of the discrimination they faced as law enforcement officers for wearing their hair in braids and dreadlocks.  Notwithstanding a legal victory at the end of January, they were found to be in contravention of the department’s media policy which bars officers from speaking openly on professional issues.
