In a March 2021 decision in the jointly administered bankruptcy
cases of Fencepost Productions, Inc. and certain of its affiliates,
Judge Dale L. Somers of the Bankruptcy Court for the District of
Kansas declined to enforce a voting restriction in subordination
agreements between two of the debtors creditors, but
nonetheless found that the deeply subordinated creditors were
barred from voting on the debtors plan because they lacked
prudential standing.

It s taken over a decade, but the Supreme Court has finally said that Google s copying of the Sun Java API for Android was clearly fair use in a 6-2 ruling (Barrett did not take part since she was not on the Court when the case was heard). The background of this case is actually kind of important to understanding what just happened, so here s a quick(ish) recap.
As you ll probably know, this case began in
2010 when Oracle, which had just taken over Sun, sued Google for patent infringement. The patent parts were quickly tossed out and what remained was what referred to as a sideshow to the main event: a question about whether APIs could be covered by copyright. Pretty much all historical evidence, including an important Supreme Court ruling from the 1990s, said no, interfaces are not covered by copyright. ....

Hafen v. Adams (In re Hafen), 616 B.R. 570 (B.A.P. 10
th Cir. 2020), a bankruptcy appellate panel from the Tenth Circuit ( BAP ) held that the bankruptcy court is the only court with subject-matter jurisdiction to decide whether a claim or cause of action is property of a debtors bankruptcy estate. As a consequence, the BAP held that the bankruptcy court abused its discretion by permitting a state court to determine whether creditors had standing to sue third-party recipients of allegedly fraudulent transfers. The decision illustrates the distinction between bankruptcy standing and constitutional standing to sue in federal courts.
