PUTRAJAYA (March 1): The Federal Court here today upheld the conviction and death sentence of a former tow truck driver for the murder of AmBank founder Hussain Ahmad Najadi in 2013. A three-member bench led by Court of Appeal President Tan Sri Rohana Yusuf also affirmed the 18-year jail term for Koong Swee Kwan for attempting to murder Najadi s wife Cheong Mei Kuen. The bench, which also comprised Federal Court Judges Datuk Abdul Rahman Sebli and Datuk Seri Hasnah Mohammed Hashim, dismissed Koong s final appeal against his conviction and sentence. Justice Rohana said the evidence against Koong was overwhelming. Koong s lawyer Hisyam Teh Poh Teik said his client s last recourse is to appeal for clemency to the Pardons Board. ....

A nine-member bench led by Chief Justice Tun Tengku Maimun Tuan Mat held that Section 28 of the Syariah Criminal Offences (Selangor) Enactment 1995 relates to matters that fall under the Federal Constitution’s Ninth Schedule Federal list, under Parliament’s power to enact laws. She said Section 28 contravened the State List in the Ninth Schedule of the Federal Constitution, which stipulated that state legislatures have no power to make law on matters that were included in the Federal List. She said the primary power to enact criminal law lies with Parliament. ....

PUTRAJAYA, Feb 25: The Federal Court here today declared as void and unconstitutional a provision in the Selangor syariah law criminalising unnatural sexual intercourse. A nine-member bench led by Chief Justice Tun Tengku Maimun Tuan Mat held that Section 28 of the Syariah Criminal Offences (Selangor) Enactment 1995 related to a matter that falls under the Federal list in the Federal Constitution, under the Parliament’s power to enact laws. She said Section 28 was enacted in contravention of item 1 of the State List which stipulated that state legislatures have no power to make law on matters that were included in the Federal List. ....

PUTRAJAYA: Mkini Dotcom Sdn Bhd which runs news portal, Malaysiakini paid the RM500,000 fine imposed by the Federal Court which found the company guilty of contempt of court over the publication of readers’ comments. Mkini Dotcom’s lawyer, A. Surendra Ananth, when contacted, confirmed that the fine has been paid at the court counter today. He said the company’s chief executive officer, Premesh Chandran personally went to the Palace of Justice to pay the fine. On Friday, the Federal Court gave Mkini Dotcom three days from Monday (Feb 22) to settle the fine. Mkini Dotcom was fined RM500,000 by a seven-member panel led by Court of Appeal president, Tan Sri Rohana Yusuf for contempt of court for facilitating the publication of five readers’ comments. ....
