Sessions court quashed JMFC order on private complaint by
woman employee
issue process ordered by the
Judicial Magistrate (First Class) against three officers of
Capgemini India Pvt Ltd, on a private complaint filed by a woman employee of the company accusing them of cheating and threatening her. The sessions court observed that the lower court had not followed the provisions of section 202 of Criminal Procedure Code (
CrPC), which allows the magistrate to postpone issue of process until s/he inquire into the case or directs for an investigation by a police officer. ....
