Apple loses copyright suit against cyber-security startup Corellium in US

A federal judge in Florida on Tuesday dismissed Apple Inc s copyright infringement claims against a Florida startup whose software helps security researchers find vulnerabilities in Apple products including the iPhone.
U.S. District Judge Rodney Smith ruled in favor of Corellium LLC, saying its software emulating the iOS operating system that runs on the iPhone and iPad amounted to fair use because it was transformative and helped developers find security flaws.
Apple accused Corellium of essentially replicating iOS to create virtual iOS-operated devices, whose sole function was to run unauthorized copies of the system on non-Apple hardware.
But the Fort Lauderdale-based judge said Corellium adds something new to iOS by letting users see and halt running processes, take live snapshots, and conduct other operations. ....

Apple Inc. has lost a lawsuit against a company called Corellium LLC, which has built a virtualized version of the iOS operating system for security testing purposes
Corellium was co-founded in 2017 by husband and wife Chris Wade and Amanda Gorton. Its software quickly became popular because it enables security researchers to run a virtual iPhone environment on a desktop computer. That made it possible for people to test iOS security and find flaws and bugs without buying an iPhone or iPad.
But Apple wasn’t impressed. It sued Corellium last year alleging that the company had infringed on its copyright by replicating iOS. ....

Apple Inc. lost its copyright claims against a Florida company that makes “virtual iPhones” used by security researchers to test for vulnerabilities to its system.
Apple contended Corellium LLC’s copied the operating system, graphical user interface and other aspects of the devices without permission. It accused Corellium of acting under the guise of helping discover bugs in the iPhone’s operating system but then selling the information “on the open market to the highest bidder.”
Corellium’s actions fell under an exception to copyright law because it “creates a new, virtual platform for iOS and adds capabilities not available on Apple’s iOS devices,” District Court Judge Rodney Smith in West Palm Beach ruled Tuesday. ....
