Court blocks Proud Boys leader appeal to return to Washington


A judge blocked a motion from Henry “Enrique” Tarrio, leader of the far-right Proud Boys, that challenged an order barring him from returning to Washington, DC, after his January 4 arrest on misdemeanour and felony charges.
Judge Robert Okun, an associate judge on the Superior Court of the District of Columbia, wrote in his February 4 ruling (PDF) the condition that Tarrio not return to DC was the “least restrictive condition consistent with public safety” given “his prior criminal history“.
Tarrio was arrested for allegedly burning a Black Lives Matter banner taken from a historically-Black church during December demonstrations. He was released ahead of his trial, which does not have a date, but ordered to stay outside the US capital. ....

“There are people being held in cages you know, in cells for 23 hours a day and I think they have a right to know when they’re going to have their day in court,” defense lawyer Carrie Weletz, who is representing Mr. Sharps in an appeal, told The Washington Times.
The 23-hour cell confinement is part of the D.C. Jail’s effort to curtail the spread of the coronavirus.
“With that hour [outside the cell], they can choose things, right?” Ms. Weletz said. “My clients frequently choose not to shower because that’s their time of the day to stand in line to get a phone call with their family, which is the absolute only communication that most of them have with their family.” ....

Proud Boys leader charged in burning of Black Lives Matter banner has failed to check in with court monitoring agency, officials contend

D.C. Superior Court officials tasked with monitoring Proud Boys leader Henry “Enrique” Tarrio following his arrest last month in the city told a judge Thursday that Tarrio has failed to check in by phone as required.
In a report filed with the court, the city’s Pretrial Services Agency deemed Tarrio to be “noncompliant, ” saying it had tried unsuccessfully to reach him via telephone and by a letter that was sent to his Miami address. ....

D.C. judge upholds ban on Proud Boys leader Enrique Tarrio, prompting appeal


Police later arrested Mr. Tarrio for destruction of property when he returned to D.C. on Jan. 4, and a magistrate ordered him the next day to stay out of the city except for case-related matters.
Lucas I. Danise, a lawyer for Mr. Tarrio, subsequently asked the court to reconsider letting his client return to D.C., citing factors including him wanting to protest the new Biden administration.
That request was rejected by Judge Okun with Thursday’s ruling, however. Mr. Danise filed a notice of appeal on behalf of Mr. Tarrio shortly afterward.
In a 10-page order explaining his decision, the judge said the ruling barring Mr. Tarrio from D.C. is warranted “in light of the nature of his crimes, his criminal history and his explicit and implicit warnings that he would commit more crimes if he returned to the District.” ....
