Sandstone, MN (KROC-AM News) - A State Trooper was among the two people hurt in a traffic crash Friday morning in northeastern Minnesota.
The State Patrol says Trooper Michael Hagen of Duluth was attempting to make a left turn onto an entrance ramp to northbound I-35 when his State Patrol SUV collided with a pickup traveling in the opposite direction. The 53-year-old Trooper and the driver of the pickup, 25-year-old Ambur Cady of Hinckley, were transported to a nearby hospital with non-life-threatening injuries.

The crash was reported shortly after 10:30 AM on Highway 23 in Sandstone, which is roughly halfway between Duluth and the Twin Cities. ....

Dallas, Texas - A federal jury convicted Dallas area owners and operators of two durable medical equipment companies Thursday of one count of conspiracy to defraud the United States and to pay and receive health care kickbacks and one count of conspiracy to commit money laundering.
According to the evidence presented at trial, Leah Hagen, 49, and Michael Hagen, 54, of Arlington, Texas, were owners and operators of two durable medical equipment (DME) companies: Metro DME Supply LLC (Metro) and Ortho Pain Solutions LLC (Ortho Pain), both operated out of the same location in Arlington. The defendants paid a fixed rate per DME item in exchange for prescriptions and paperwork completed by telemedicine doctors that were used to submit false claims to Medicare. The defendants paid illegal bribes and kickbacks and wired money to their co-conspirator’s call center in the Philippines that provided signed doctor’s orders for orthotic brace ....

TX Court Allows Counsel Derivative Advice Supporting Good Faith Defense

On June 3, 2021, the Northern District of Texas ruled on a novel issue in 
U.S. v. Hagen (Case No. 3:19-CR-0146-B (N.D. Tex.)). In a health care fraud conspiracy case against DME suppliers, the court held that a good faith defense premised on legal advice received by 
another, 
uncharged co-conspirator and passed along to the defendants may be introduced at trial. This ruling allows a defendant to introduce derivative advice of counsel to establish his own good faith, i.e., lacking knowledge of wrongdoing and an absence of intent to participate in the offense.
In 
Hagen, the government alleged that defendants Leah and Michael Hagen (the Hagens), who owned durable medical equipment businesses, conspired with a third, uncharged individual (Kimble) to defraud Medicare.
