Judge Thomas Lilley of New Mexico’s Fifth Judicial District Court, at a hearing Thursday, granted a motion filed by the District Attorney’s Office to hold Austin York, 22, without bond until trial or unless otherwise ordered by the court. Lilley said evidence presented by the prosecution that York would be a danger to the safety of both the shooting victim and a witness to the incident is clear and convincing. “I find the state has met their burden of proof, proving by clear and convincing evidence that the defendant is a danger to at least those two people if not the community as a whole,” he said.

Jack Salcido (Submitted Photo) Jack Salcido, 31, of Roswell, who is charged with involuntary manslaughter; receipt, transportation or possession of a firearm by a certain person, felon; and two counts of child abuse, will be detained without bond while he awaits trial. “The court believes the danger to the community and the danger, actually to the people the defendant is around, is extremely significant,” Judge James Hudson of New Mexico’s Fifth Judicial District Court said during Thursday’s pretrial detention and concurrent preliminary examination.

Trials in criminal and civil cases involving juries were put on hold by the New Mexico Supreme Court in November due to a surge in COVID-19 cases and deaths. However, other administrative court functions were allowed to proceed.

Former municipal judge candidate pleads not guilty to embezzlement

Timothy Davidson (Submitted Photo) A former candidate for Roswell municipal judge accused of diverting tens of thousands of dollars from New Mexico Mounted Patrol Troop 13 into his own personal bank accounts has pleaded not guilty to an embezzlement charge. Timothy Davidson, 52, of Roswell, according to court documents, waived a reading of formal charges and entered a plea of not guilty to one count of embezzlement over $20,000 Monday during his arraignment in New Mexico’s Fifth Judicial District Court in Chaves County. Davidson, who in 2020 lost a three-way race for municipal judge, is suspected of using the internet to transfer $43,788.52 from Troop 13’s account into three of his personal accounts. Of that total amount, $24,750 was deposited from Davidson’s accounts back into Troop 13’s account.

Man pleads not guilty to sexual assault of three children

Copyright © 2021 Roswell Daily Record A 49-year-old man suspected of sexually assaulting three children and showing them pornography has pleaded not guilty to 10 criminal counts. Court documents state that when Shawn Carter of Hagerman appeared via Google Meet at his arraignment in New Mexico’s Fifth Judicial District Court in Chaves County Monday, he pleaded not guilty to one count each of criminal sexual penetration in the first degree, child under 13, and criminal sexual contact with a minor in the second degree, child under 13; two counts of criminal sexual contact with a minor in the third degree, child under 13; as well as three counts each of enticement of a child and contributing to the delinquency of a minor.
