COVID-19 Hazard Pay for Grocery/Drug Store Workers in San Mateo, Calif.

On March 1, 2021, the City Council of San Mateo, California, adopted “An Emergency Ordinance Requiring Large Grocery Stores and Large Drugstores to Provide Hazard Pay to their Employees” to ease the burdens caused by the COVID-19 pandemic. San Mateo is an incorporated city located in the San Francisco Bay Area. The ordinance requires large grocery stores and drug stores in San Mateo to provide their workers with hazard pay of $5.00 per hour in addition to their hourly “base wages” or “holiday premium wages.” The ordinance took effect on March 1, 2021, and will expire on May 30, 2021, unless reenacted.

On March 11, 2021, President Biden signed the American Rescue Plan Act of 2021 (the “Plan”). The Plan is the most recent stimulus bill enacted to address the COVID-19 pandemic and it comes almost one year to the date the first COVID relief bill containing the Families First Coronavirus Response Act (FFCRA) was passed.
The employer leave obligations contained in the FFCRA ended on December 31, 2020.  The Consolidated Appropriations Act of 2021, which was passed on December 27, 2020, did not extend the FFCRA obligations; rather, it gave employers who were covered under the FFCRA the option to 
voluntarily decide to provide “qualified” paid sick leave or paid family leave wages to their employees and continue to receive a tax credit for such wages until March 31, 2021. ....

Although most everyone on planet Earth was jumping for joy as 2020 came to an end, many employers had another reason to celebrate. With the passage of the Consolidated Appropriations Act, 2021 (the “CAA”) on December 27, 2020, employers with 500 or fewer employees (“Covered Employers”) are no longer required by the Families First Coronavirus Response Act (the “FFCRA”) to provide paid leave to employees for certain COVID-19 related reasons. As initially passed, the FFCRA was slated to expire on December 31, 2020, but with the passage of the CAA certain provisions were extended through March 31, 2021. While on its face this might not sound like a reason for employers to celebrate, the CAA ....
