New Mexico Supreme Court upholds Couy Griffin recall decision

This ruling said the process of recalling Griffin from his elected office, a decision first asserted April 8 by Third Judicial District Court Judge Manuel Arrieta, may proceed.

Griffin said he planned to fight the recall, though he no longer has the option to do that via the courts. LAS CRUCES – William Beerman, a former newspaperman and certified internal auditor who hails from Pittsburgh and served the Las Cruces Capital Improvements Advisory Committee for several years, is seeking Yvonne Flores District 6 seat on the Las Cruces City Council.
The district includes Sonoma Ranch and much of Las Cruces south of U.S. Highway 70 and east of Interstate 25.

On April 19, Otero County Commission Vice Chairman Couy Griffin filed a stay in the New Mexico District Court recall case against him.
The district court stay was denied by Third Judicial District Court Judge Manuel Arrieta who had found probable cause to recall Griffin in the April 8 recall hearing.
Given the timetable for a recall process and the accelerated nature of the appeal, there is no need to stay the recall proceedings as the appeal will likely be heard before the recall can be scheduled, assuming the requisite signatures are verified, Arrieta stated in his order denying the stay. ....
