WITH just three more months to serve in prison for shooting a man, twice, at point-blank range for disrespecting his sister a little over 17 years ago, Dwayne Nigel Lynch was told on Tuesday by the judge who sentenced him to walk away if he is provoked again.
“You have to be the big man…You have to show you have the wisdom and maturity. You have been in prison for 17 years, and have seen now lives can be destroyed… It is not everything you have to respond to.”
Lynch was before Justice Kathy Ann Waterman Latchoo, who sentenced him to three months in prison. ....

AFTER more than a little over 17 years in prison, and one inconclusive trial later, Dwayne Nigel Lynch is possibly one step closer to freedom after he pleaded guilty to an unlawful killing in 2003.
Dwayne Nigel Lynch on Wednesday pleaded guilty to manslaughter when he appeared before High Court judge Justice Kathy Ann Waterman-Latchoo at a virtual hearing.
Lynch, also known as Pagan and Pags, was charged with the murder of Richard Mark on November 22, 2003, in San Fernando.
Waterman-Latchoo said for some time, Lynch had written to the Director of Public Prosecutions asking him to consider allowing him to plead guilty to manslaughter, and “later, rather than sooner,” it was accepted. ....

ON FEBRUARY 1, a High Court judge will rule on an application by one of two men accused of the brutal killing of six-year-old Sean Luke in a cane field near his home at Orange Valley, Couva.
If the matter goes to trial, Justice Lisa Ramsumair-Hinds will also decide whether the two men, now 30 and 28, are to remain at the Youth Training and Rehabilitation Centre (YTRC), where they have been remanded since their arrest.
They have expressed concern for their safety if moved to the maximum security prison. ....

Judge finds Oropouche man not guilty of wounding neighbour

ROGER Ragoopath, who was accused of wounding a neighbor in an alleged robbery, over a decade ago, has been found not guilty by the judge at his virtual judge-alone trial.
Justice Lisa Ramsumair-Hinds said on Tuesday there were glaring inconsistencies in the prosecution’s case against Ragoopath, particularly in the evidence of the victim, Ramesh Mungroo.
She said the evidence presented by the State could not meet the threshold to convince her of the facts, and there was reasonable doubt as to whether he committed the offence.
“No matter the charge or trial, the principle that the prosecution must prove guilt is part of the common law, and there can be no attempt to whittle it down,” she said as she told Ragoopath he was not guilty and discharged him. ....
