The Centre Tuesday informed the Delhi High Court that pricing authority NPPA has initiated the process to fix a formula to determine the MRP of oxygen concentrators, needed for COVID-19 treatment, as people were being charged exorbitantly. The process for fixing the formula for MRP is likely to be concluded and the court will be informed about the development on May 31, the Centre said. A bench of Justices Vipin Sanghi and Jasmeet Singh asked the Centre s counsel to take instructions and file a report before May 31. Justice Sanghi observed that the pricing formula was important as most of the manufacturers were not putting MRP or maximum retail price on oxygen concentrators and are not readily available in shops.

New Delhi [India], May 25 (ANI): Centre on Tuesday apprised the Delhi High Court that it is in process of coming up with the formula for fixing the Maximum Retail Price (MRP) of oxygen concentrators.
Advocate Kirtiman Singh, appearing for Central Government told the Delhi High Court that National Pharmaceutical Pricing Authority (NPPA) has initiated the process of fixing of formula for the pricing of oxygen concentrators.
A Division Bench of Justices Vipin Sanghi and Jasmeet Singh, thereafter, posted the matter for further hearing next Monday.

New Delhi [India], May 20 (ANI): Central Government told the Delhi High Court on Thursday that National Pharmaceutical Pricing Authority (NPPA) has asked all the manufacturers/ importers of Pulse Oximeter and Oxygen Concentrators to submit the Maximum Retail Price (MRP) details within seven days. All the manufacturers/importers of (i) Pulse Oximeter and (ii) Oxygen Concentrators are hereby directed under Para 29 of the DPCO, 2013 to submit the MRP details in the prescribed format (Annexure-I & II) within 7 days i.e. latest by May 22, 2021 of issue of this order. A soft copy of the same may be sent to the following e-mail id, read the office memorandum issued by NPPA.

The high court said it was not asking the government to fix a price in rupee or paisa, but to fix a principle on which oxygen concentrators will be charged and it should understand if this is not an extra ordinary circumstance where it should intervene, then what will be. Asserting that there has to be a cap on the price of the product, it said, there has to be some limit to it. It cannot be limitless. Tomorrow some Chinese manufacturer will say he will sell it at 5X rate, it cannot be allowed.
