Kidnapping charge dismissed against Gainesville man; plea deal on others Russell Olin Layton A Gainesville man was given time on house arrest and probation after prosecutors dismissed a kidnapping charge and negotiated a plea on other charges, according to court documents. Russell Olin Layton, 54, was given a 12-year sentence with the first two years in confinement, according to court documents. There were two indictments filed in October 2018 in Hall County Superior Court. The first alleged kidnapping, false imprisonment and battery involving a woman in August 2016. The second indictment had charges including aggravated stalking, influencing a witness, terroristic threats and terroristic acts involving the same woman months later. ....
The Hall County Board of Elections is asking for an injunction against the county government to stop it from taking any personnel action against Election Director Lori Wurtz. Wurtz is serving a 90-day probation period after receiving a poor performance evaluation in February that cited problems during the 2020 election cycle. The 90-day probation period is expected to end in April. The request for the injunction came in a lawsuit filed Tuesday in Hall County Superior Court. In the suit, the elections board is claiming county officials violated the state constitution when they amended the election board s enabling legislation in 2018 to make the elections director report to the county administrator instead of the elections board. ....

Ricky McQueen, Theresa Webb and Chris Fetterman all were asking the board to find that probable cause existed in challenges that there may be people not eligible to vote in Hall because they have changes of address on file with the U.S. Postal Service. And a fourth person, Robert Michael Smith, challenged the votes of 40 residents who registered to vote between Nov. 4 and Dec. 7, “as well as some voters he’s challenging for residency requirements,” election director Lori Wurtz said. ....
