DOL Rescinds Independent Contractor Rule. On May 6, 2021, the U.S. Department of Labor (DOL) issued a regulation rescinding its independent contractor rule, which was finalized on January 7, 2021, but never went into effect. The withdrawal comes less than three weeks after the close of a public comment docket that generated over 1,000 responses. The DOL stated that it “believes that the Rule is inconsistent with the [Fair Labor Standards Act’s] text and purpose, and would have a confusing and disruptive effect on workers and businesses alike due to its departure from longstanding judicial precedent.” The new regulation does not set forth a new regulatory standard for evaluating independent contractor status, but the  ....

The acting head of the National Labor Relations Board (NLRB) said Google “arguably violated” US labor law by illegally firing three workers in 2019 amid their organizing activities,
Bloomberg reports. On Wednesday, the NLRB reversed an earlier decision which had dismissed claims from Sophie Waldman, Rebecca Rivers, and Paul Duke that Google had retaliated against them for labor activism.

The NLRB’s general counsel’s office has already accused Google of unlawfully terminating former Google workers Laurence Berland and Kathryn Spiers. Now, acting general counsel Peter Sung Ohr has asked that the complaint be amended to include Waldman, Rivers, and Duke. ....

Status of Former NLRB General Counsel

The National Labor Relations Board issued an order on April 20, 2021, in which it declined to rule on whether the agency’s acting general counsel, Peter Sung Ohr, was legally appointed. Shortly after President Biden took office, he terminated the Board’s prior General Counsel Peter Robb after Robb refused to resign. Robb was serving the last year of a statutory four-year term when he was fired. Biden replaced Robb with Peter Sung Ohr, who is currently serving as the acting general counsel while Biden’s permanent appointment, Jennifer Abruzzo, awaits Senate confirmation.
Robb’s abrupt departure sparked a series of legal challenges before the Board, as challengers argued that President Biden fired Robb illegally and thus his appointment of a successor is invalid. The National Labor Relations Act defines the conditions in which the President can remove board members, but is silent on whether the President can remove the general couns ....
