The last day of the state Legislature proved a rollercoaster day for Lewis and Clark County District Court Judge Chris Abbott.
Twice on Thursday lawmakers voted down his confirmation, first in committee and then again on the Senate floor. But after Democrats reversed course on another bill limiting the state s liability when someone falls ill with COVID-19, Republicans later gave way and confirmed Abbott on a 27-23 vote.

HELENA â In an unusual series of razor-close votes, the Montana Senate Thursday confirmed state District Judge Chris Abbott of Helena, a 2020 appointee of former Democratic Gov. Steve Bullock that conservatives had tried to unseat.
Republicans on the Senate Judiciary Committee began the day by voting not to confirm Abbott and sending that recommendation to the Senate floor. But the motion to adopt that recommendation failed on a 25-25 vote, and supporters of the judge later moved to bring a resolution to the floor to confirm him. ....

Montana Lawmakers Advance One Judge Nomination, Reject Another

The Montana Senate has rejected one of Former-Gov. Steve Bullock’s district court judge appointees and advanced another. A third appointee is still awaiting consideration.
Republicans on the Senate Judiciary Committee Friday voted to reject the appointment of Judge Michele Reinhart Levine, who’s been a judge in Cascade County since November, when Bullock, a Democrat, appointed her. Levine’s nomination was also rejected in the full Senate late Friday, meaning the appointment process for that bench will begin again.

Michele Levine is sworn in as the newest district judge on Tuesday afternoon by District Judge Elizabeth Best via Zoom video call at the Cascade County Courthouse. Michele is joined by her husband Bill who assisted in Tuesday s ceremony.
A Montana State Senate vote on Friday means Michele Levine will not continue as a Cascade County District Judge. It s the first time in 50 years the Senate has declined to confirm an interim judge.
At Levine s final hearing in Great Falls, a Youth in Need of Care matter, she said she told the parties that a new judge would have to get up to speed on their case. ....

A Montana State Senate vote on Friday means Michele Levine will not continue as a Cascade County District Judge. It s the first time in 50 years the Senate has declined to confirm an interim judge.
At Levine s final hearing in Great Falls, a Youth in Need of Care matter, she said she told the parties that a new judge would have to get up to speed on their case.
Until then, she said, those kids are “in limbo,” and they re not the only ones.
The Senate is playing with a lot of people s lives, said Levine. That breaks my heart.
Without a confirmation, Levine cannot continue working. Senate Judiciary Committee member Sen. Bryce Bennett, D-Missoula, said he s unsure of the timeline for her removal. ....
