Five COVID-19 infections close Western Commerce Bank downtown location


Five COVID-19 infections at a Carlsbad bank prompted its closure in early March by the New Mexico Department of Health (DOH).
In a letter to Western Commerce Bank from DOH, closure was ordered at the downtown location at 127 South Canyon Street on March 5 as part of a Public Heath Order issued on February 24.
The letter, written by DOH Deputy Cabinet Secretary Billy Jimenez, said four or more rapid responses within a rolling 14-day period for certain businesses means automatic closure.
Jimenez in the letter noted five COVID-19 infections during four rapid responses from Feb. 22 to March 2.
Single COVID-19 infections were cited on February 22, February 23 and March 1. Two COVID-19 infections were recorded on March 2, the letter read. ....

SANTA FE – It’s been 331 days since Gov. Michelle Lujan Grisham first declared a New Mexico public health emergency in response to the COVID-19 pandemic.
Some lawmakers have since chafed at their lack of involvement in the state’s pandemic response effort – which has featured more than 20 public health orders – and several bills pending at the Roundhouse would give the legislative branch a greater role in emergency decision-making. ....

Lawsuit: COVID-19 is no emergency’

Mule Creek attorney Jonathan Diener has joined forces with Santa Fe lawyer Ana Garner to file a pro bono federal lawsuit in U.S. District Court that argues New Mexico’s public health orders are unconstitutional, and are based on what a 125-page complaint describes as the “invalid” results of polymerase chain reaction, or “PCR,” tests that are commonly used to diagnose individuals with COVID-19, the disease caused by the novel coronavirus.  The lawsuit was filed in Albuquerque on Dec. 21, and is assigned to federal Magistrate Judge Jerry H. Ritter. “The bottom line is this: there is no emergency,” the attorneys allege in their complaint, which asks the courts to declare unconstitutional the restrictions in place under state public health orders. Diener represents the owners of the Jalisco Cafe ....
