Town Counsel: Selectmen Cannot Serve As Board, Committee Designees

Bourne Town Counsel Robert S. Troy has advised town officials that recently elected selectwoman Mary Jane Mastrangelo cannot serve on the Bourne Wastewater Facility Design and Building Committee as the designee of the Bourne Capital Outlay Committee. She can, however, serve as the designee of the Bourne Board of Sewer Commissioners, despite a provision in the Bourne Town Charter prohibiting selectmen/sewer commissioners from serving on other town boards and committees. Mr. Troy offered his opinion on the matter in an email response to several questions posed by the Bourne Board of Selectmen. Board members asked if the capital committee has the authority to designate someone who has resigned from the committee as the group’s representative to the wastewater building committee.

Bourne Charter Review Committee Ponders Televised Health Board Meetings

A section of the Bourne Town Charter calls for meetings of several town boards and committees to be televised. The one board mentioned in that section that currently does not have its meetings televised is the Bourne Board of Health. That could soon change. Section 8.6 (d) of the charter stipulates that “Meetings of the board of selectmen, the school committee, the board of health and the planning board shall, if possible, be televised on the local cable channel or streamed on the town’s website.” The board of health is the only one in that group whose meetings are not televised live and made available for rebroadcast and later viewing at the Bourne Cable TV website.

Bourne Selectman Accuses FinCom Chairwoman Of Multiple Violations

The 2021 campaign for election to two seats on the Bourne Board of Selectmen began with a bang. Incumbent Selectman James L. Potter has accused one of his challengers, Bourne Finance Committee chairwoman Mary Jane Mastrangelo, of a variety of peccadilloes, from Open Meeting Law and ethics violations to disrespecting town officials and bullying town staff. Mr. Potter’s diatribe came at the start of the selectmen’s remote meeting Tuesday night, March 30. He made his statement during the public comment period of the meeting’s agenda, which meant that Ms. Mastrangelo, who was in attendance, could not respond to the accusations.
