Indian American Couple Files Precedent-Setting Petition in Delhi High Court, Urging India to Recognize Same-Sex Marriages


An Indian American couple has filed a precedent-setting petition with the Delhi High Court, urging the Indian government and its Ministry of External Affairs to recognize same-sex marriages.
The case was scheduled to be heard by the court on May 24 morning. But as petitioners Parag Mehta and Vaibhav Jain watched the proceedings virtually from the U.S., attorneys for the Government of India asked for an extension of time to prepare their case. The motion was granted, representing the third time the case has been postponed for a hearing by the Court.
“It was really upsetting to have it delayed again. This feels like a stalling tactic,” Jain — who served as the senior advisor for outreach and engagement at the AAPI Victory Fund — told ....

Indian government argues same-sex couples don't deserve 'fundamental right' to marriage

The Indian government has told the Delhi High Court it believes same-sex couples “cannot claim a fundamental right for same-sex marriage”.
Despite decriminalising same-sex relationships in 2018, the Indian government believes that same-sex couples do not deserve the same rights as “traditional”, heterosexual couples.
“Living together as partners and having a sexual relationship by same-sex individuals is not comparable with Indian family unit concept of a husband, wife and children which necessarily presuppose a biological man as ‘husband’, a biological woman as ‘wife’ and children born out of the union,” the government said. ....
