NSW Independent Planning Commission accused of acting as 'rubber stamp' as coalmine approved


“Merits appeal rights for those who oppose these projects are unavailable so, without an independent umpire, people and industries that are affected by mining have effectively got no say and no protection.”
Under NSW laws, communities lose their right to a merits appeal of decisions if the IPC holds public hearings on a project.
Stokes as the planning minister is responsible for making the decision as to whether a hearing is held.
Woods said Stokes had “stripped the IPC of its independence”. “It is now little more than an extension of the NSW Government and Planning Department, that rubber stamps anything that comes its way,” she said. ....

Many experts and most people think it’s time for returning travellers to be redirected to unpopulated areas for quarantine (‘‘City on high alert’’, December 19-20). Leakage from quarantine in Victoria cost many lives and billions of dollars. And there’s little doubt that the current outbreak in Sydney will ruin Christmas for far more people than those who want to return to Australia for the holidays. Surely the Prime Minister and the premiers should call time on quarantining in major population centres. Any cost benefit analysis will prove that decision as being correct. ....

The NSW Land and Environment Court has upheld a decision by the state’s Independent Planning Commission to reject a controversial coal mine planned for rich farmland north-west of Sydney.
Korean energy giant KEPCO had been seeking to overturn the decision in September 2019 to reject a proposed coal mine for the Bylong Valley because of “long-lasting environmental, agricultural and heritage impacts”. ....

Activists hail 'historic win' as NSW environment court rejects Bylong Valley coalmine | New South Wales


Justice Nicola Pain dismissed the company’s appeal on Friday finding the IPC’s refusal of the mine was lawful.
Rana Koroglu, a managing lawyer at the Environmental Defenders Office, which represented the alliance, said it was “a historic win not just for Bylong but for everyone working to limit global carbon emissions and avoid the worst impacts of climate change”.
“We could not be more pleased for the Bylong Valley Protection Alliance, who have fought courageously for five years to protect their beautiful valley from this mine,” she said.
“The community provided robust scientific evidence to the IPC on the detrimental environmental, social and economic impacts of the proposal to build a new coalmine in a highly productive agricultural area. ....
