The Northeast experienced significant drought in 2020, particularly in New England where some areas saw severe or extreme drought, according to USDA.
While most vegetable growers have adequate irrigation resources, the drought still caused stress to crops and additional work for producers. Dry weather continued across the region over the winter, and right now much of New York and New England is abnormally dry or in moderate drought. ....

Editorial — Take another look: State legislators should revise law on farmworker overtime


While farmers throughout the state recently got a breather when it comes to having to pay more overtime to their workers, this issue will hang over them unless authorities come to their senses.
Last year, the state Department of Labor created a Farm Wage Board to determine if the threshold for overtime should be adjusted. Initiating this board was part of a law passed in 2019 to address farmworker concerns about various working conditions.
The Farm Laborers Fair Labor Practices Act created a Farm Wage Board, consisting of one representative each from the Farm Bureau, state AFL-CIO and member of the public. Board members are authorized to hold hearings to determine if they wish to recommend a lower cap on overtime hours. It established the threshold for overtime at 60 hours, but the wage board could decide to lower it to 40 hours. ....

Farmers glad for delay, but still leery of decreasing OT requirements


WATERTOWN — Last week, a panel charged by the state Legislature with presenting recommendations on potentially lowering the overtime threshold for farm workers below 60 hours decided to postpone making any policy decision until later in 2021, giving beleaguered farmers a reprieve, at least for now.
Farmers, labor groups and justice advocates had been watching the proceedings of the three-member Farm Wage Board since it was formed and began hearings in the beginning of 2021 as charged by the 2019 Farm Laborers Fair Practices Act passed by the Legislature. Despite being temporarily derailed by the pandemic, the panel proceeded with multiple hearings to gather public input on whether the state should lower the threshold after which farm workers are required to be paid overtime from its current point of 60 hours per week as set by the 2019 law. ....

Farm Labor Wage Board Pauses Action On Overtime Threshold

The New York Department of Labor’s Farm Wage Board held three meetings in late December to determine if the overtime threshold for farm workers should be lowered. Their decision to wait at least a year was issued on New Year’s Eve.
New York’s Farm Workers Labor Law of 2019, which became effective January 1st, 2020, includes requirements to provide at least one day off per week; unemployment insurance coverage, paid family leave and the right to organize.  The agriculture industry was also allowed to keep an exemption allowing 60 hours of work before overtime is paid.  The new law required a wage board to determine if and when that overtime threshold could be lowered to 40 hours per week. ....

Relief for farmers for now, but long-term threat remains

It was a relief last week when New York’s newly created Farm Labor Wage Board chose not to immediately lower the state’s current 60-hour overtime threshold for farm workers.
The relief is only temporary, however. The three-member Board made it clear that it will revisit the potential change next November with an eye toward moving ahead on a lower, likely 40-hour threshold.
A lot can happen between now and next November, but make no mistake this is where we stand: farmers and their advocates, including me and many other Upstate legislators, must continue making the case that now is no time to risk the future of any of our farmers. ....
