SC sets aside PST order, restores penalty of compulsory retirement from service

The Supreme Court had voided the order of the Punjab Service Tribunal (PST) and allowed the appeal filed by the Punjab government against Khadim Hussain Abbasi an employee of Specialized Healthcare and Medical Education Department, Lahore and restored the penalty of compulsory retirement from service imposed upon the Respondent (Khadim) by the departmental authorities on March 09, 2017.
A two-member SC bench comprising Chief Justice Gulzar Ahmed and Justice Ijaz Ul Ahsan had reserved the decision on an appeal filed by the Special Secretary, Specialized Healthcare and Medical Education Department, Lahore against the judgment of Punjab Service Tribunal at Bahawalpur passed on September 18, 2020. Khadim was serving as Chief Technician, District Blood Unit, Sheikh Zayed Hospital, Rahim Yar Khan. Contractual employees have no vested right of regularisation: SC

Setting a precedent in service matter on Monday the Supreme Court ruled that regularisation of a contract employee means a fresh appointment into the stream of regular appointment which does not apply retrospectively under the Punjab Regularization Policy 2010.
A three-member bench of the Justice Manzoor Ahmad Malik has adjudicated over a question of law whether the date of regularisation of contract employees is the date of their initial appointment on contract basis or the date of their regularisation under the Regularization Policy 2010.
Authorising a six-page verdict being part of the bench in the matter, Justice Syed Mansoor Ali Shah ruled, “Regularization of a contract employee is … a fresh appointment into the stream of regular appointments. A contractual employee for the first time becomes a civil servant,” ....

Supreme Court upholds PST decision on teachers allowances

LAHORE:The Supreme Court on Monday dismissed an appeal of the Punjab government and upheld a decision of the Punjab Service Tribunal about provision of allowances to the Secondary School Teachers (SSTs) from the date of their initial appointment as contract employees.
Representing the government’s appeal, Additional Advocate General Rana Shamshad Khan argued that the order of the tribunal had multiple legal flaws. He said the tribunal’s order, if implemented, would cause a huge burden on the national exchequer as there were over hundred thousand in the province. Headed by Justice Manzoor Ahmad Malik, a two-judge bench observed that apparently the government wanted to pay a salary to the teachers what they were getting 10 years ago. ....
