Some Cleveland council members mull local eviction moratorium; Housing Court and mayor’s office question where authority exists

CLEVELAND, Ohio Some Cleveland City Council members are considering a local eviction moratorium to provide a safety net for tenants amid concerns that a federal ban on evictions for nonpayment during the coronavirus pandemic could soon come to an end.
The prospect of extending the moratorium, which the Centers for Disease Control and Prevention first enacted in September, within the city limits has support from housing advocates and Cleveland Housing Court Judge W. Moná Scott.
To them, the moratorium has been a key tool in preventing mass evictions during the pandemic-induced recession that began in early 2020 and would give an outside agency running a city-funded rental assistance program time to catch up on applications. ....

Harrisburg man who raped woman at gunpoint denied break on decades-long prison sentence

A Harrisburg rapist saw his hope for freedom dwindle Friday when a state appeals court refused to overturn his convictions.
The Superior Court panel also rejected Jose Figueroa Jr.’s claim that his 19- to 40-year prison sentence is “excessive and unreasonable.”
In an opinion by Judge Mary Murray, the state court backed a Dauphin County jury’s decision to convict Figueroa last year on counts of rape, sexual assault, unlawful restraint, robbery and conspiracy.

Figueroa, 21, was charged with raping the woman at gunpoint in March 2017 after she gave Figueroa and a male friend a ride in her car. The woman said she also was pistol-whipped and had escaped by fleeing from her car while naked. ....

LISBON – With concerns about the competency of one of the children of Destiny Moody, also known as Destiny Penny, to testify in the trial of her alleged murderer, Terrance Haywood, the Common Pleas Court trial has been postponed for now.
Haywood, 28, Chester Avenue, Wellsville, is accused in the shooting death of his 26-year-old girlfriend, while three of her four children were upstairs in her home in Wellsville in October of 2019. He is charged with murder, aggravated burglary, tampering with evidence and having weapons while under a disability.
Defense attorney Dennis McNamara filed the motion to push Haywood’s trial date back from the May 17 on the court’s docket, because he said he has concerns about whether the child, who was 3 or 4 years old at the time of his mother’s death, to be able to recall what happened and testify.
