DETROIT – Attorneys for Gov. Gretchen Whitmer’s administration defended coronavirus testing for school athletes, telling a judge Tuesday that state law gives the health director extraordinary power to respond to a pandemic.
A parent group called Let Them Play Michigan is seeking an injunction to stop weekly COVID-19 tests, which kicked in April 2 for athletes ages 13-19, related quarantines and mask requirements.
The group argues that the policy must go through a formal rule-making procedure, a process that would take weeks or months. Critics have been encouraged by recent court victories by wrestlers who convinced judges to let them compete in state tournaments. They had repeatedly tested negative but were benched because of infections among other students. ....

Convicted Hamburg Murderer To Get New Trial

The Arkansas Court of Appeals reversed the guilty verdict and ordered a new trial in the case of Erskine Flamer Jr., who had been convicted of the second degree murder of Deunte Stanley and tampering with physical evidence. An Ashley County Circuit Court jury set the penalty at 50 years in prison and a $2,500 fine for the murder as well as three years in prison and a $500 fine for tampering with evidence.
The charges came after a dispute in Pine Street Park in Hamburg on July 21, 2019. The court opinion notes that Flamer and Deunte Stanley were involved in an altercation in the park. Flamer’s girlfriend and his son’s mother, Laporsha Franklin, was present and testified that Stanley approached Flamer and started shoving and threatening him. Witnesses said after a pushing conflict Flamer “poked” Stanley, and that Stanley collapsed. Stanley died from a stab wound while being carried to the Ashley County Medical Center. ....

There are many problems facing America, some of them dealing with the institutions themselves — the courts, administration, process, procedure, tradition — but the one that I feel needs the most attention at this moment is the Supreme Court.
When it comes to how we view our system of government, there is no entity more important than the Supreme Court as they are the ones who literally interpret and adjudicate cases that arise from the Federal Constitution, state constitutions, federal laws, state laws, treaties, agreements, administrative rules, administrative rulings, lower court decisions and even their own decisions.
