LITTLE ROCK, Ark. (AP) An Arkansas judge and former Republican lawmaker on Thursday announced he s running for a seat on the state Supreme Court, which has been drawn the attention and spending by outside conservative groups in recent years.
Sebastian County Circuit Judge Gunner DeLay said he s running for the seat currently held by Justice Karen Baker, who hasn t said whether she s running for reelection next year. State Supreme Court justices are elected to eight-year terms.
“The Supreme Court is the last line of defense for protecting the rights of the people; rights that include free speech, the right to bear arms, and due process of law, DeLay said in a statement. “The stakes in the race are high because what courts decide today determines the kind of world our kids and grandkids live in tomorrow.” ....

Arkansas Supreme Court today delivered two opinions that said the old law governing appointments to the
state Plant Board was unconstitutional because it allowed trade groups to pick nine of 18 seats.
The recent legislative session corrected that by passing Act 361 to give appointment power to all seats to the governor, with advice from trade groups in some cases and subject to Senate confirmation. The won’t take effect until 90 days after the close of the session.

One suit was by a group of individuals challenging a rule on the use of dicamba to control pigweed. But the decision turned on the constitutionality of the board’s membership and the Supreme Court held it unconstitutional, with Justice Karen Baker dissenting. The Arkansas Supreme Court’s 4-3 decision to deny post-conviction relief to a man convicted of first-degree murder has interesting aspects.
Emmitt Riley, convicted in Drew County, was 59 when he shot Josh Martin, 26, during a fight. Riley shot Martin after Martin had already broken his ankle. He shot him once, despite having plenty of ammo, and called the police. Riley contended he acted in self-defense. He contended the court had failed to instruct the jury on a lesser charge of second-degree murder. A lower court rejected that claim.

In an opinion written by Justice Barbara Webb, Justices Rhonda Wood and Shawn Womack and Chief Justice Dan Kemp also rebuffed Riley. They ruled in favor of the attorney general’s defense of the outcome, putting down a lawyer’s failure to seek a second-degree conviction as a trial strategy favoring self-defense.
