I would like to thank Senator McDowell and the other proposing Senators for bringing this Bill before the Seanad.
 
This Bill is in response to issues from the recent decision of the courts in DPP and E.C V. Irish Times and others.
 
Section 252 of the Children Act 2001 contains mandatory reporting restrictions where the trial relates to “an offence against a child or where a child is a witness in any such proceedings.
 
Mr Justice Birmingham in the Court of Appeal on 29 October 2020 upheld the High Court’s interpretation of section 252 to mean that the reporting restrictions in relation to offences against children also apply in circumstances where the child is deceased or has turned 18 years of age. A man found with almost €1 million in a bag of onions inside his campervan - crime cash that was destined for the Kinahan Cartel - will be returned to jail after the Court of Appeal this Thursday increased his sentence by a year.
The court heard that after Bernard Joyce was cautioned by gardaí, he made no comment other than indicating that he liked onions .
The increase in sentence came after the three judges agreed with the Director of Public Prosecutions (DPP) that Joyce s three-year sentence was unduly lenient. ....

South East drug mule who became caught up with criminal gang sent to jail

A drug mule who became caught up with a criminal gang and took the opportunity to make easy money has been sent to jail after the Court of Appeal this Thursday found his wholly suspended sentence too lenient.
Ciaran Long (37) of Barntown, Co Wexford, pleaded guilty at Wexford Circuit Criminal Court to possessing €201,000, which were the proceeds of criminal conduct, at the same address, on March 27, 2017, under the Money Laundering and Terrorist Financing Act 2010. 
The Director of Public Prosecution s successfully sought a review of the man’s sentence on grounds that it was “unduly lenient” and Long must hand himself in to gardaí in two weeks time.  ....
