Judge blocks legislative request of SupCo justiceâs documents GOP leaders seeking judicial emails By: Mike Dennison and last updated 2021-05-18 20:45:23-04 HELENA â A state judge Tuesday blocked legislative Republicansâ request for internal communications of a Supreme Court justice, saying the Legislature lacks legal authority to acquire the documents. District Judge Mike McMahon said if lawmakers believe the documents could shed light on judicial misconduct, they should file a complaint with the state Judicial Standards Commission, which has constitutional authority to investigate. The Helena-based judge also noted that while the commission investigates such matters, any pertinent documents remain confidential â unless the panel takes official action. ....

A District Court judge Monday grilled a state attorney representing the Legislature on Republican lawmakers chosen methods of pursuing their concerns with the judicial branch. Montana Supreme Court Justice Jim Rice was the only justice last month to file a court challenge against a legislative subpoena seeking his communications regarding any polling conducted on pending legislation. The other six justices put a halt to the subpoenas for their own communications, telling the legislative committee formed by Republican lawmakers that they did not participate in any such polling conducted by the Montana Judges Association. Republican lawmakers remained skeptical after the Supreme Court administrator conceded she deleted the results of one of the email polls. ....
