KUALA LUMPUR: Chief Judge of Malaya (CJM) Justice Azahar Mohamed, who was warded due to Covid-19, has been discharged from the hospital. A text message circulated on Sunday (May 2), said to be from Justice Azahar, informed fellow judges that he had been released from critical care that day and was currently recuperating at home. What an 18 days, being woken up all hours, poked, prodded, needles, alarms, high-flow oxygen, the message said. A source close to the judiciary confirmed that the text message was from Justice Azahar. On April 26, it was reported that Federal Court judge Justice Mohd Zawawi Salleh was appointed as acting CJM following Justice Azahar s hospitalisation at Hospital Sungai Buloh. ....

PUTRAJAYA: The Federal Court today dismissed former deputy prime minister Datuk Seri Dr Ahmad Zahid Hamidi’s ( pix) appeal to consolidate his 12 criminal breach of trust (CBT) charges to only three charges in his trial involving funds belonging to Yayasan Alkalbudi. A three-member bench led by Chief Judge of Malaya Tan Sri Azahar Mohamed in ruling that there was no contravention of section 153 (2) of the Criminal Procedure Code said the section was not a mandatory provision. “We therefore agree on this issue with the Court of Appeal that it is not mandatory for all 12 charges of CBT to be amalgamated or consolidate to only three charges,“ he said when dismissing Ahmad Zahid’s appeal. ....

A five-member bench led by Chief Judge of Malaya Tan Sri Azahar Mohamed held that the relief sought by the former Umno members in their judicial review application has become academic as the party had completed its party election at all levels. He said the status of former Umno members were undisputed as they were no longer members of the political party by virtue of clause 20.7 of the Umn Constitution. ....
