A Michigan state judge has just ruled that the Democratic Secretary of State did violate the law when she issued unlawful guidance on how ballot counter should evaluate absentee ballots:
BREITBART – A Michigan judge ruled last week Secretary of State Jocelyn Benson (D) broke state law when she unilaterally issued rules related to absentee balloting, legitimizing a key claim made by the Trump campaign in its legal challenges to the 2020 election.
Benson issued several unilateral orders during the 2020 election including sending absentee ballot applications to all registered voters. She also issued “guidance” on how to evaluate absentee ballots, a move Michigan Court of Claims Chief Judge Christopher Murray held violated the state’s Administrative Procedures Act. ....

MI Judge Rules That Michigan Sec. of State's Unilateral Absentee Ballot Order Broke the Law

Months after it would have made a difference, a judge has ruled that Michigan Secretary of State Jocelyn Benson (D) broke the law when she unilaterally issued directives related to absentee balloting in the 2020 election, Breitbart reported.
In October of 2020, Benson unilaterally ordered that absentee ballot applications be mailed to all registered voters, and issued “guidance” on how to evaluate the absentee ballots.
Michigan Court of Claims Chief Judge Christopher Murray ruled in Genetski v. Benson that Benson’s directives violated the state’s Administrative Procedures Act.
In the guidance, Benson said “slight similarities” in signatures on absentee ballots should lead a counter to decide “in favor of finding that the voter’s signature was valid.” ....

A Michigan judge has ruled that the state’s Secretary of State Jocelyn Benson’s guidance last October relating to ballot signature verification wasn’t in compliance with the law and is invalid.
“The standards issued by defendant Benson on October 6, 2020, with respect to signature-matching requirements amounted to a ‘rule’ that should have been promulgated in accordance with the APA,” Christopher Murray, the chief judge from the Michigan Court of Claims, ruled last week in the court order. APA refers to the state’s Administrative Procedures Act.
“And absent compliance with the APA, the ‘rule’ is invalid.” ....
