That is just a smattering of the editorial responses to the news from last week that British oil company Cairn Energy successfully petitioned a French court to freeze real estate properties in Paris belonging to the Indian government valued at around $24 million. The company said the court order was a “necessary preparatory step to taking ownership of the properties and ensures that the proceeds of any sales would be due to Cairn”, based on the $1.2 billion arbitration award it won in 2020 against tax claims by the Indian government.
More bad news could be on its way. Cairn has filed similar cases in eight other countries, including the US and the UK, which have signed the 1958 New York Convention on the Recognition and Enforcement of Foreign Arbitral Awards. ....

The international arbitration tribunal had held India’s retrospective levy as unfair and asked the government to return $1.7 billion to Cairn. What’s troubling is, with India refusing to pay, Cairn has registered cases across multiple jurisdictions and if it succeeds, we will join countries like Pakistan and Venezuela that have had assets seized for dishonouring international rulings. ....

Law360 (July 7, 2021, 7:22 PM EDT) Antrix urged a Washington federal court Tuesday to block an Indian satellite company s shareholders attempts to track down assets and enforce a $1.3 billion arbitral award, minutes after the investors sought to force a response from the Indian space agency.
Investors in Devas MultimedIa Pvt. Ltd. and an American subsidiary of the company sought the court s assistance in turning over discovery needed to enforce the award. The intervenors say the move is necessary to counteract Antrix s attempts to deprive Devas of the ability to collect the multi-billion dollar judgment. ....
