In June, 2016, Justice Samuel Alito took the unusual step of reading aloud from the bench a version of his lengthy dissent in the case of Fisher v. University of Texas. A white applicant who had been denied admission had sued, saying that she’d been discriminated against because of her race. The Supreme Court, by the narrowest of margins and on the narrowest of grounds, upheld Texas’s admissions policy.
