Landowner of former garage hit with enforcement notice for failing to clear site of waste

THE landowner of a former garage has been fined after failing to remove flytipping from their land used by an operator to illegally store waste.
An Untidy Land Enforcement Notice under s215 of The Town and Country Planning Act 1990 has been served at the former Yates Garage at Islands Brow in Blackbrook.
Once in effect, the notice requires the landowner to remove and suitably dispose of all remaining flytipped waste within 28 days – and to remove the foil-backed insulation from the roof of the building.
Failure to comply with the order would see the council look to prosecute which carries a fine of up to £1,000 as well as taking direct action to clear the land which would be recharged to the landowner. ....

Councillors will decide if an enforcement notice is necessary to order the removal of caravans and mobile homes from green land.
A report from Folkestone and Hythe District Council (FHDC) states that the erection of the homes, plus laying of hardsurfacing, alterations to access and erection of fencing, were not authorised for the plot off Canterbury Road, in Selsted, near Folkestone.

The literature says that, following complaints, a council officer visited the land, which is within the Kent Downs Area of Outstanding Natural Beauty, in June 2020. ....

A Blackburn takeaway will be shut most of January pending a review after breaching planning rules.
A Temporary Stop Notice has been served on 16th Street on Shear Brow which is operating as a takeaway despite having no planning permission to do so.
The firm had applied to Blackburn with Darwen Council in 2017 to open as a sandwich or coffee shop but has been operating as a hot food takeaway which requires a different planning permission.
The closure order started on Thursday, December 31 and the notice will be reviewed in 28 days.
There had been complaints regarding anti-social activity around the takeaway, with the police attending the premises several times, at a time when the borough is subject to strict and increasing national Covid restrictions. ....
