Bringing Dark Patterns to Light,” to examine “dark patterns.” In her opening remarks, Acting FTC Chairwoman Rebecca Kelly Slaughter broadly described “dark patterns” as “user interface designs that manipulate users into taking unintended actions that may not be in their interests.” Chairwoman Slaughter highlighted several examples of dark patterns, including confusing cancellation procedures that force users to navigate multiple screens, online applications that hide the material terms of a product or service through the use of inconspicuous drop down links and auto-scroll features, and the addition of products to users’ shopping carts without their knowledge or consent. ....

Vivint Smart Home to Pay Million for Violating the Fair Credit Reporting Act

Washington, DC - The Department of Justice, together with the Federal Trade Commission (FTC), announced a $20 million settlement resolving alleged violations of the FTC Act and the Fair Credit Reporting Act (FCRA), including violations of the Red Flags Rule. The settlement includes $15 million in civil penalties, which represents the largest civil penalty ever paid to resolve FCRA violations under the FTC Act.
Vivint Smart Home Inc. sells “smart” home security and monitoring systems, largely via a sales force that sells door-to-door. The complaint alleges that Vivint failed to implement an Identity Theft Prevention Program, allowing its sales representatives to obtain credit reports of unsuspecting consumers without the consumers’ knowledge or consent, and unfairly sold false debt to buyers or debt collectors. According to the complaint, the defendant’s lack of an Identity Theft Prevention Program violated the FTC’s Red Flag ....

FTC Reaches $20M Settlement with Vivint Smart Homes over 'White Paging' Scheme

On Thursday, the Federal Trade Commission (FTC) announced that it reached a settlement with Vivint Smart Homes Inc., a smart home security and monitoring company, thus settling claims that the company “misused credit reported to help unqualified customers obtain financing for the company’s products and services.”
Previously, the United States, acting on behalf of the FTC, filed a complaint in the District of Utah against Vivint, alleging that Vivint violated the Fair Credit Reporting Act (FCRA) by improperly obtaining credit reports in order to qualify potential customers for financing for its smart home monitoring and security products. The FTC also averred that Vivint violated its Red Flags Rule because it failed to implement an identity theft prevention program as required for companies that regularly use or obtain credit reports. Scammers are in it for the bottom line, and while losing money to a scammer is one thing, at least 30 folks who were looking for a COVID vaccine when they were hard to find, gave up something much more costly.
An individual who had announced on Facebook that he had developed a COVID-19 vaccine and offered to vaccinate people at $400 each.  In the course of the investigation, he admitted that he had injected 30 individuals with this product,” Cynthia Alexander, Washington State assistant attorney general said. ....
