Weld Board of Appeals affirms AT&T cellphone tower permit


According to the Board of Appeals ruling, specific requirements not met included:
• The September meeting was plagued with technical difficulties such that Planning Board members and attendees couldn’t hear one another.
• Roll call votes, required by state law, weren’t taken.
• The Planning Board failed to address each of the nine standards included under Article 21, the commercial and industrial structures section of the Weld Building Ordinance.
• The Planning Board concluded incorrectly that the deed AT&T submitted showed sufficient proof of right title and interest.
Later that month the Planning Board took no action on a request to reconsider the AT&T cellphone tower application. ....

WELD The Board of Appeals on Tuesday sent AT&T’s permit to build a 190-foot cellphone tower back to the Planning Board with instructions to provide more information.

Among the issues it cited are determining if the company has right, title and interest in the property, and clarifying its written findings. Planners are also instructed to hold further proceedings as it deems necessary or appropriate.
The 190-foot tower would be across from Lost Cove, just before Fire Lane 17 and beyond the Weld Inn on the Phillips Road. AT&T has leased the site from Kevin and Holly Cochran. ....

An appeal of a proposed move of Unity’s Dunkin’ to the town’s downtown district was unanimously denied 5-0 during a Unity Planning Board of Appeals hearing Monday night, allowing the coffee shop to go forward with its plan for the Main Street location.
The Unity Planning Board of Appeals made its decision after a nearly two-hour interactive discussion via the online platform Cisco Webex with attorneys and the Planning Board. When going through each aspect of the appeal, the board made no comments. ....
